RESOLUTION NO. 685 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR CONSTRUCTION OF A RESIDENTIAL HOME FOR BOARD AND CARE OF WELL AGED PERSONS ON PROPERTY LOCATED AT 53i-601 DUARTE ROAD. WHEREAS, an application was filed on 24 September 1969 by Daniel R. and Patricia J. Burschinger, John K. arid Grace E. Waken, and W & M Properties" for a conditional use permit for the construc- tion of a combination convalescent hospital and board and care home on property loca.ted at 531-601 Duart,e Road, in the City of Arcadia, County of Los Angeles, State ,of California, more specifically described as follows: . Lot 45 together with the westerly 70.Jl feet of Lot 46, Tract 3430 as per map recorded in Book 42, pa.ge 32 of Maps in the office of the County Recorder of said County; and, WHEREAS, a publiC hearing was held on 14 October 1969 at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. That the proposed site is in the R-l zone and consists of approximately 90,244 square feet. The property at the present time is vacant, and extends from Duarte Road to Arcadia Avenue. The property north of Arcadia Avenue is in the R-3 zone . and is developed with multiple apartment's. The property to the east is in zone R-l and pursuant to Resolution No. 3356 is devel- oped with an apartment complex. Property to the west is zoned -1- 685 / . . . . . R-I and is occupied by a mortuary pursuant to Variance No. V-58-1. That the granting of such conditional use permit will not be detri- mental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. Tr.at the use applied for at the location indicated is properly one for which a conditional use permit is authorized, provided that the zoning of the property is changed from R-l toR-3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. That the granting of such conditional use permit will not adversely affect the comprehensive general plan. SECTION 2. That for the foregoing reasons a conditional use permit is granted, subject to the approval of the City Council, for the use of the above described property for the construction of a residential home for board and care of well, aged persons u~on the following conditions: 1. This permit shall not be operative unless and until said property is rezoned from R-l to R-3. This conditior: shall not change the normal effective date of this permit an~ the usual time for expiration of the permit shall be applicable. 2. The property shall be developed in substantial compli-- ance with the preliminary plans which have been filed with the Planning Department. Working drawings which shall include land- scaping and irrigation plans and a parking plan shall be in substantial compliance with existing regulations and 'shall be s~bject -2- 685 . . . Q . to approval by the Planning Department. Working drawings shall also include a grading and drainage plan which shall be sUbject to approval by the City Engineer. 3. The number of beds shall not at any time exceed 112. 4. The working drawings shall be subject to approval by the Department of Social Welfare of the State of California. 5. The driveway adjacent to the westerly property line shall be a minimum of twelve and one half feet (let) in width and have a minimum vertical clearance of thirteen (13) feet; it shall be used only as a one-way drive north bound and shall be clearly marked for one-way use with a "One Way Do Not .Enter" sign at the north end.. 6. The outside refuse collection area shall be enclosed on three sides with a five foot high masonry wall. 7. All delivery to the facility shall be made between the hours of 7:00 a.m. and 10:00 p.m. 8. All utilities shall be installed underground; owners shall furnish necessary public utility easements. 9. Existing driveway open~ngs on Duarte Roa~ shall be closed and a five foot cpncrete sidewalk shall be constructed along Duarte Road. 10. Fire protection facilities shall be furnished in accordance with the Fire Department. SECTION 3. The Secretary shall certify to the'adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. -3'" 685 . . . C.U.P.-69t2 BOARD ~ND CARE FACILITY I 531-601 WEST DUARTE ROAD ' APPLlCA TION, This application, filed o'n 24 September 1969 in the names of Daniel R. & Patricia J. Burschinger, John K. & Grace E'. Woken, and W &,M Properties, owners of the property at 531-601 West Duorte Road, proposes this property to be reclassified From Zone R-l to Zone C-O and requests a conditional use permit for the purpose of constructing a 114 bed board and care facility for healthy aged persons. ' FROM: SUBJECT: PROPOSAL & ANALYSIS The Following describes the zoning and land use of the subject site and the surrounding property : . \' The proposed site consists of Lot 45 together with the westerly 70.31 ft. of Lot 43, Troct 3830. The proposed site is'an irregularly shoped parcel with lot Frontage of approximotely 216.97 ft. on Duart~ Road and opproximately 214.79 Ft. on Arcodia Avenue, ond hos a depth of approximotely 411.40 ft. on the easterly boundary and approximately 432.01 ft. on the westerly boundary. All subject lots are presently zoned R-l and are vaca:nt. The property to the north across Arcadia Avenue is zoned R-3and is occupied by apartments and single family residences. The property to the east is 'zoned R-1 and is occupied by opartments (Permitted by Resolution No. 3356). The property to the south, across Duorte Road, is zoned R-l and C-O & D and is occupied by medical offices and a church. The property to the west is zoned R-l and is occupied by a mortuary (Permitted by V-58-1). (See Land Use & Zoning Map.) The provisions of City Council Resolution No. 3356 permit the subject property to be used For any R-3 use. In August, 1968, a conditional use permit application was approved For the construction of a combination convalescent hospital and board and care home on the subject site. No subsequent action was taken and this approval has since lapsed. The present application (C.U. P.-69-12) is For a board and care Facility only, and as such requires a change of zone. A board and care Facility is a permitted use with a conditionol use permit in Zones R-2, R-3 and C-O. The Following describes the propased development with exist:ing code requirements: LOT AREA Required by Code: Not ta be less than 20,000 sq. ft. Propased: 90,244 sq. ft. DENSITY Required by Code: The number of beds shall not exceed one bed for each 800 sq. Ft. of lot area. The area of the subject site (90,244 sq. ft.) permits a maximum of approximately 112 beds. Proposed: 114 beds. . PARK ING Required by Cade: One parking space For every two beds making a total of 57 parking spaces and 25 ft. aisle width. Propased: 57 parking spaces and 13 ft. and 15 ft. aisle widths. SIGN Required by Code: Only those signs shown on the approved plot plan. Proposed: Nonesubmitted DECORA TlVE MASONRY WALL Required by Code: A 6 ft. high solid masonry wall on interior property lines when the subject site adjoins property in a residential zone. When the wall reaches a paint 25 Ft. backof the street property line, it decreases to a height of 30 inches. Next to these walls a 5 Fl. landscape area is required. Proposed: The 6 ft. and 30 inch walls ore proposed; however the proposed westerly landscape area does not concur with Code. . LANDSCAPING Required by Code: Five ft. wide plantingadjocent to three sides of the porking area. Pro~sed: Five ft. wide planting area is proposed on the north, east and west side of t e parking lot. STATE APPROVAL Required by Code: Written proof by the State indicating approvol and limitation of licensing ta be submitted at the time of application. . The State Department of Social Welfare, which is the agency responsible for the licensing of this type oFFacilify has stated that a comprehensive study of eoch application, is made prior ta the issuonce of a license. Prior to the completion of the full study and evaluation of the data, preliminary or tentative approval is not possible. . . . Proposed Zone C'hange No. Z-69-3 and Conditional Use Permit No. C.U.P.-67 Board and Care Facility 531-6Ql West Duorte Rood 14 October 1969 Page Four " ADDITIONAL REQUIREMENT The proposed 12 ft. wide driveway adjacent to the westerly property line would ingress off Duarte Road. In order to comply with Arcadia's Fire Department requirements, thiS driveway must be 0 minimum of twelve and one half Ft. (12 1/2 ') in width with a minimum vertical c1eorance of 13 ft. Relocating the proposed building 3 Ft. in an eosterly direction would create a 17 ft. side yard adjacent to the west side of the proposed building. The side yard width would be sufficient to permit the applicants to provide the required 12 1/2 ft. wide driveway and substontially camply with landscaping requirements. The side yard odjocent to the east side of the building would be reduced from the required 10 ft. to a substandard 7 ft. However, a 6 ft,. wall and driveway would separate the propased Facility From the odjoining apartments enobling the propased site to substantially comply wit h Code. i. It is the Planning Departments contention that the subject property should be rezoned R-3 rather thon the opplicant's proposed G-O. There are approximately 30.5 acres of Zone C-O property within the City, most of which hos not as yet been utilized for Zone C-O purpases. In recent Planning Commission octions, the Commission has been reluctant to increase the amount of commercia I zoning whi Ie there ore these lorge amounts of property yet usused for the purpose ,For which they were zoned. However, since the applicants' proposal is for a board and care facility, which is a permitted use in Zone R_3 with a conditional use permit, and since Resolution No. 3356 already permits the subject property to be used For any R-3 use the Planning Department believes that the subject property should be rezoned R-3. . RECOMMENDA TIONS The Planning Department recommends approval of this application subject ta the Following conditions: 1. All conditions of the Department of Publi c Works as outlined in the written report shall be complied with to the satisfaction of the Directar of Public Works. v2. The subject property sholl be rezoned R-3. /3.
