RESOLUTION NO. 684 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR THE USE OF PROPERTY AT 143 EAST FOOTHILL BOULEVARD FOR AN EATING ESTABLISHMENT. WHEREAS, Stephen A. Frohling as lessee of the property known as 143 East Foothill Boulevard on 26 August 1969 filed an . application for a conditional use permit, Planning Department File No. C.U.P. 69-11, for the use of said property for an eating establishment, more particularly for the expansion and remodeling of the existing McDonald's Hamburgers facili1;y; and WHEREAS, a public hearing was held on said matter before the Planning Commission on 23 September 1969, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. The applicant proposes to expand and remodel an existing eating establishment which is located in a C-2 zone, and is surrounded by property which is commercially zoned and developed. SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or welfare or injurious to .the property or improvements in such zone . or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. -1- 684 v . . \, . . 3. The site for the proposed use is adequate in size and shape to accommodate said use, and all yards, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the general plan. 6. The proposed use will not substantially increase vehicular traffic on any street in a residentially zoned district. 7. The proposed use will not lessen suitability of any nearby commercially zoned property for commercial use by interference with pedestrian traffic. SECTION 3. That for the foregoing reasons, subject to the approval of. the City Council, this Commission grants a conditional use permit for the use of saiq property for an eating establishment upon the following conditions: 1. The remodeling of the existing building, including removal of the "arches" below the roof line, shall 'be done in accordance with plans which have been approved by the Planning Department. 2. A solid, ornamental masonry wall shall be constructed along the Foothill frontage and landscaping installed in accord- ance with current regulations and in accordance with plans which . have been approved by the Planning Department. -2- 684 \ . . . . SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. C.U.P.-69-11 - "Since the previous meeting I the applicant Mr. Stephen A. Frohling has revised his original proposalond earlier today informed the Planning Deportment of these plan revisions. The original pion coiled for the construction of a gloss enclosure (winter front), ond the construction of. additionol patio area. The revised plan proposes to construct a winter front and remove the portion of the golden arches below the roof line and to cop the existing building with used brick, (the previously proposed increosein potio area is no longer a port ofthis application.) The Planning Department recommends approval of the application subject to the following conditions: 1. The applicant shall prepare ond,submit 0 revised landscaping plan to the Planning Deportment for its opproval which would be in substantial compliance with existing regulations. 2. The Applicont shall submit a revised plot pion to the Planning Department for its approval. 3. The existing legal non-conforming free-standing sign shall comply with present free-stonding sign regulations. '.
