RESOLUTION NO. 683 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR THE USE OFPRQPERTY AT 233 EAST HUNTINGTON DRIVE FOR A RESTAURANT. WHEREAS, R. E. Cayer, Genevieve C. Cayer and Dominic C. Sturniolo are the owners of Lots 7, 8, 9, 10, ll, 12, 13, 14, 15, 18 and 37 of Tract 6860, said lots comprising a contiguous parcel separated only by Third Avenue; and WHEREAS, the Derby Restaurant is located on the westerly side of Third Avenue, known as 233 East Huntington Drive, and that part of the parcel on the easterly side of Third Avenue is . used as a parking lot for said restaurant; .and WHEREAS, said owners on 23 July 1969 filed an application for a conditional use permit, Planning Department File N~. C.U.P.-69- 10, for the use of said property for restaurant purposes, more particularly for the expansion and remodeling of the existing restaurant; and WHEREAS, a public hearing was held on said matter before the Planning Commission on 26 August 1969 at which time all inter- ested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE~. THE CITY PLANNING COMMISSION OF THE CITY , ~;' . ,-'~ ' .' '. J OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS.~: . SECTION 1. The subject property is zoned C-2 and D. Commercial buildings are east, south and west of the site in a C-2 and D zone. Single family residences are north and east of the site in a C-2 and D and M-l zones. The applicant proposes to expand and remodel a~ existing restaurant. -1- 683 ;/ . . . , . . SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use, and all yards, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the general plan. SECTION 3. That for the foregoing reasons, subject to the approval of the City Council, this Commission grants a condi- tional use permit for the use of said property for restaurant pu~poses upon the following conditions: 1. The expansion and remodeling of the restaurant shall b,e done in accordance wi th the plans filed by the applicant. Off- street parking and landscaping shall be done in compliance with revised plans which shall be in substantial compliance with existing regulations and subject to approval by the Planning Department. 2. That portion of the site which is on the east side of Third Avenue shall be used only for automobile parking for the --2- 683 ~ . . , ~ restaurant. The owners of said property shall execute and record a covenant that said property will be used only for parking purposes in connection with the restaurant operation. 3. Attendant parking shall be provided at any time the banquet room is in operation. 4. Existing driveway aprons on Huntington Drive and Third Avenue which will not be used shall be removed and City standard concrete driveway aprons shall be constructed at the locations shown on the plans. . . ~ ' . 5. Full parkway width concrete sidewalks with tre,e wells shall be constructed on Huntington Drive and Third Avenue and park- . way trees shall be planted in accordance with City standards. 6. All surface. drainage shall be intercepted !ind piped under the sidewalk to the gutter. 7. Any new utilities shall be installed underground. 8. Corner cut-offs shall be irrevocably dedicated for street purposes which shall be accepted by the City after 4 April 1975. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. C.U.P.-69-10 EA TING ESTABLISHMENT 233 EAST HUNTINGTON DRIVE, ZONE C-2 & D APPLlCA nON This application filed on 23 July 1969 in the names of Mr. & Mrs. R. E. Cayer and Mr. Dominie C.Sturniolo, owners of the property at 233 East Hun tingtan Drive, Commonly known as the DERBY RESTAURANT, proposes to build an additional bonquet room and a cupala. ' PRESENT ZONING AND LAND USE The subject site is zoned C-2 & D. Commercial buildings are east, south, and west of the site in a C-O& D zone. Single family residential homes are north and east of the site in an M-l and a C-2 & D zone. (See attached Land Use and Zoning Map.) PROPOSAL AND ANALYSIS The applicant, proposes to build an additional bonquet room and construct a cupala to the existing restaurant. The area of the,site is approximately 41,500 sq. ft. The first Floor of the existing building and propdsed bonquet area contain approximately 9,200 sq. ft., the space on the second Floor is approximately 400 sq. ft." making a ~tal of approximately 9600 sq. ft. of building floor area. The opplicant's proposed development is substandard in terms of parking stall requirements, aisle width, ,rear yard and landscaping. The applicant's pro'posed plat plan indicates 75 parking spaces in I ie.u of the ,96 spaces required, a deficiency of 21 parking spoces. Proposed parking qrea 1 (see attached plot plan) has five parking stalls adjacent to the south side of the "Derby" which infringe on the public right-of-way, creating a potential hazard. In proposed parking area 2 the presert location of a utility paleond one arresting cable I imit a proposed aisle width to approximately 15 ft. (see attached plot plan). Ordi- nance requires a minimum of25 Ft. In proposed parking area 1 and2, additional walls and landscaping borders ore necessary to conform to the existing ordinances. The Municipal Code requires a minimum of 5 ft. landscaped border and 03 ft. high solid masonry wall ta be erected where parking area front, side, or rear on a street. Adjacent to the north side of the proposed bonquet area a 15 ft. rear yard is proposed; existing ordinonce requires a rear yard minimum depth of 20 ft. This would be an attractive architectural feature, however its height does not conform to the exist ing ordinance limit of 35 Ft. The proppsed cupola without the use of the spiral, appears to be high enough to cover existing air conditioning a!1d mechanical equipment on the roof. RECOMMENDA nON The Planning Department recommends approval of this application subject to the Following conditions: 1.
