A RESOLUTION OF THE CITY PLANNING COMMISSION '?f'7
OF THE CITY OF ARCADIA DENYING A CONDITIONAL
USE PERMIT FOR THE USE OF THE PROPERTY AT
218 EAsT HUNTINGTON DRIVE FOR A DRIVE-IN
RESTAURANT.
WHEREAS, there was filed with this Commission on 30
April 1969, the application of Bob: s Beefburger., Inc., by Robert
F. Kleckner, owner, for a conditional use permit for a drive-in
restaurant at 218 East Huntington Drive, more specifically
described as follows:

Lot 1 of Tract No. 5205 as recorded in Map
Book 54, Page 61 in the office of the ~ounty
Recorder of Los Angeles County, State of
California.
WHEREAS, a public hearing was duly held on said matter,
CUP-69-7, by this Commission on 10 June 1969, at which time all
interested persons were given full opportunity to be heard and to
present evidence.
NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY
OF ARCAI;lIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS:

SECTION 1. That the site, of the proposed restaurant
would be the westerly 135 feet nine in'ches of said Lot 1 meaSured
along Huntington Drive; itois presently occupied by a nonconforming
drive-in restaurant. The easterly 65 feet of said lot, measured
along Huntington Driv~ is occupied 'by a used car lot. Thesubject
property is in zone C-2. On the southw,es t the property is bordered
by the Santa Fe right-of-way. Adjacent property is also zoned
C-2 and developed with a variety of commercial uses. The applicant
proposes to remodel the existing structure, construct an auto-
mobile shade canopy 15 X 77 feet, install two planting areas
totaling 116 .square feet and a free standing sign. The total !ire a
of the parcel is 9,548 square feet.

SECTION 2. This Commission finds that the proposed use
'of the property does not meet current standards in the following
respects:
1. The site is inadequate insize'and shape for the
proposed use.
2. The site area is less than 10,000 square feet, the
.
minimum size required by the Municipal Code..
3. Parking does not meet Code requirements.
4. Landscaping does riot meet Code requirements.
5. Utilities are no~ underground.
6. Outside storage is not screened by a masonry wall.
7. Restroom doors are not screened.
8. Light standards exceed the 15 foot maximum required.
SECTION 3. That for the foregoing reasons, this Commission
denies a conditional use perntl:t as requested by the applicant.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Planning Commission held on the

APPLlCA TION
This application, filed on April 30, 1969 in the name of Bob's Beefburger, Inc. by
Robert F. Kleckner, proposes to re,model existing 'struc'tures and add a sJa'de canopy
, for parked c:ars to a drive-in restuarant. !, .

CHARACTERISTICS OF THE SUBJECT SITE AND SURROUNDING AREA
The subject property is in Zone C-2 and D and developed with a drive-in restaurant.
Property to the north and east is also zoned C-2 and D and developed with a
variety of commercial uses. Property to the.south and west bordering the subject
site consists of Atcheson, Topeka & SOn to Fe Railwoy right-of-way track.

This application has been filed on part of a triangular plot of land under one ownership
bounded by the A, T & SF Railway, Third Avenue and Huntington Drive. The
westerly 135 ft. .9 in. of the Huntington Drive frontage isthe subject of this
application. No changes are propased for the remaining 65 ft. along Huntington
Drive presently developed with a used car lot.
PROPO SED DEVELOPMENT
Improvements proposed consist of a mansard roof treatment of the existing structures
and construction of a shode canopy 15'x 77' as illustrated on the attached drawings.
Other improvements proposed consist of 2 planting areas totaling 116 sq. Ft. and a
freestanding sign 24 ft. in height and 142 sq. ft. in area.
COMPLIANCE WITH THE DRIVE-IN AND C-2 ZONING REGULATIONS
Existing development on this property does not comply'with a II of the zon ing
regulations and' the proposed improvements do not correct all of the deFiciencies.
The Following is a summary of elements of the proposal which do not comply with
zoning regulations.
Park ing
Nine parking spaces and one loading zone is required. Eight spaces are indicated
on the plan ond no loading space is provided.
Drive-in facilities require provision for employee parking. None is indicated.

Landscaping
Five ft. wide required planters between the street and parking and drive areos are
not indicated.
Three faot wide planter areas along the interiar property lines ta a distance equal
to the building 'setbock are not provided For.
Three percent (3%) interior parking lat landscoping is not provided for.
Thirty sq. ft. of required planting to be,located along"the building facade fronting
the street is nat indicated.
Lot Area and General Regulotions
The drive-in restaurant Facility is located on an area containing 9,548 sq. ft.
Ten thousand sq. ft. is required,
Utilities are not provided to be installed underground.
Outside starage is not screened by a mosonry wall..

Screening of restroom doors not indicoted.
Lighting stondords exceed the 15 ft. maximum requirement.
ANALYSIS
As presented this application would provide For a general iinprove~ent ta part of a lot
used for a drive-in restaurant. With the exception tb the oddit,ion of two planters and
a sign improvements 'proposed are for the building. Although the applicant is handicapped
in providing required landscoping alo.ng the street frontage due ta the placement of
existing buildin'gs little has been done to c9rrect other plan deficiencies. In the opinion
of the staff, with some changes in the circulation and lot area provided for the use all
other requirements could be complied with.
In anolyzing the circulation pattern it could be said that it would be desirable to have
additional standing space for waiting automobiles but palice record~ and observotions do not
indicate a porti<;ular troHic hozard.
Since the Full lot includes all the property easterly to Third Avenue, improvements
proposed would bring the entire property under the concurrent improvement regulations
requiring standard street improvements to 011 street ond sidewalks bordering the property.
This part of the report is covered by the recommendation made by the Department of
Public Works. It can be a matter of some latitude os ta whether the Planning Commission
wants to consider all site improvements ind/uding the used car lat.
In the opinion of the staff the opplicant has the obility ta conform to all drive-in
businesses and C-2 regulotionsexcept the landscape provisions. If the opplicant submits
revised pions complying with these requirements this development could be evaluated
substantiolly complying with the intent of the Zoning Ordinance.

RECOMMENDATION
The Plann ing Department recommends that the application be approved provided that
revised plans be submitted for Planning Commission approval Incorparating the followir.g
conditi01s:
1. The drive-in business shall comply with all conditional use and C-2 zoning
regulotionsJ except waiver of the requirements for street sid,. planting, under-
ground utilities and height of lighting standords is recommended.

2. All conditions of the attached report from the Department"of Public Works shall
be complied with ta the satisfoction of ,the Director of Public Works.
