RESOLUTION NO. 672
A RESOLUTION OF THE CITY PLANNING
COMMISSION OF THE CITY OF ARCADIA
GRANTING A CONDITIONAL USE PERMIT
FOR A RESTAURANT AT litOO SOUTH
BALDWIN AVENUE.
WHEREAS, there was filed with this Commission on
February 10, 1969, the application of the Original House of Pies,
Inc., as lessee, for the use for restaurant purposes of the property
known as 1400 South Baldwin Avenue, more particularly described as
follows:

Lots 28 and 29, Tract No. 4611, as shown on map
recorded in Book 51, Page 82 of Maps in the office
of the Recorder of Los Angeles County, Excepting
therefrom the following described parcels:
Parcell - Beginning at the northwesterly corner of
Lot 2/j; thence southerly along the westerly line of
said lotto the southwesterly corner thereof; thence
easterly along the southerly line of said lot to a
line that is parallel with and distant 20 feet
eas terly of said wes~terly line; thence North 30
46' 00" East 14.51 feet along said parallel line
to the.beginning of a tangent curve that is concave
to the southeast and having a 15 foot radius and a
central angle of 740 58' 2911; thence northerly and
easterly 19.63 feet along said curve; thence tangent
to said curve North 780 44' 29" Eas~ 161.15 feet,
more or less, to the northeast corner of Lot 28;
thence westerly along the northerly line ,of said lot
to the point of beginning.
Parcel 2 - The easterly 20 feet of Lot 28, measured
at right angles to the easterly line of said Lot 28.
WHEREAS, a public hearing was duly held on said applica-
tion on February 25, 1969, at which time all interested persons
were given full opportunity to be heard and to present evidence.

NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE
CITY OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS:

SECTION 1. That the subject property is located on the
southeast corner of Baldwin Avenue and Naomi Avenue, and is zoned
C-2 and H. Adjacent property on both sides of ~aldwin Avenue is
in a C-2 zone. The applicant proposes to remove existing structures
on the property and to construct a new restaurant facility.
SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to the public health or
welfare or injurious to the property or improvements in such zone
or vicinity.
2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size
and shape to accommodate said use, and all yards, parking, loading,
landscaping, and other features required to adjust said use with
the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in
width and pavement type to carry the kind of traffic generated by
the proposed use.
5. The granting of such conditional use permit will
not adversely affect the general plan.
SECTION 3. That for the foregoing reasons, supject to
the approval of the City Council, this Commission grants a conditional
use permit for the use of said property for restaurant purposes
upon the following conditions:
1. All applicable regulations of the Arcadia Municipal
Code shall be complied with.

2. The restaurant facility shall be constructed sub-
stantially in accordance with the plans submitted with the applica-
tion provided that a five foot wide landscaped border and a solid
ornamental masonry wall three feet in height shall be constructed
between the paved parking area and Baldwin Avenue.
3. All existing structures shall be removed.
4. Wheel stops shall b,e provided where parking spaces
abut a wall, building or adjacent property.
5. Water service shall comply with the Uniform Plumbing
Code and be to the satisfaction of the Water Department.
6. A sidewalk, the full width of the parkway and with
tree wells, shall be constructed on Naomi Avenue.
7. All utilities shall be constructed underground.
8. A detailed site plan showing existing and finish
surface elevations and the method of drainage, shall be submitted
to and subject to approval by the Department of Public Works.
9. The easterly 20 feet of Lot 29 shall be conveyed to
the City for alley purposes.
10. The owner of said property shall consent and agree
in writing to the terms and conditions of this permit.
11. This permit shall be submitted to the City Council
for its approval or disapproval and it shall not b,e effective
until approved by the Council.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to
the. City Council of the City of Arcadia.
