RESOLUTION NO. 669B A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDI'rIONAL USE PERMIT FOR A RESTAURANT AT 309 EAST FOOTHILL BOULEVARD. WHEREAS, there was filed with this Commission on the 31st day of December, 1968, the application of Sycney E. Koppel, as owner, for the use for restaurant purposes of the property known as 309 East Foothill Boulevar~, more particularly described and shown as Parcel 1 on the tentative map on file in the Planning Commission Lot Split Case No. L-68-16; and WHEREAS, the application included a request for use of the adjoining property at 305 East Foothill Boulevard, shown as . Parcel 2 on said tentative map; and WHEREAS, a public hearing was duly held on said matter by and before this Commission on the 14th day of January, 1969, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. That the subject property is located on the north side of Foothill Boulevard between Second Avenue and Valencia Way. Lot Split L-68-16, which is being approved by the Planning Commission concurrently with the adoption of this resolution, creates the lot upon which this use permit will operate and one . other lot upon which another restaurant will be located under a conditional use permit being approved concurrently with this permit. (See Resolution No. 669A). -1- 669B v . . . .. \ .. . That the subject property is partially in a C-2 zone and partially in a PR-l zone. Adjacent property to the east and west is in a C-2 zone. Abutting property at the rear is in a R,-l zone. SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use, and all yards, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. 4. The site 'abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the general plan. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit for the use of said property for the construction of a restaurant facility, for restaurant purposes, all in compliance with applicable regulations of the Arcadia Municipal Code, and upon the following conditions: 1. All conditional use and C-2 regulations shall be complied with. -2- 669B .. \. . . . 2. Water service shall comply with the Uniform Plumbing Code and be to the satisfaction of the Water Department. 3. The requirements of Lot Split 68-16 shall be complied with. 4. All existing structures and buildings shall be removed. 5. The permittee shall arrange for rear property utility s~rvice and dedicate necessary easements to utility companies. 6. A full parkway width sidewalk with city standard tree wells shall be constructed on Foothill Boulevard. Ex~sting driveway openings not to be used shall be closed and hew concrete driveway aprons constructed per City Standard #148 where required. " . 7. All drainage shall be intercepted and piped under the sidewalk to the gutter. 8. Detailed plans showing existing and finish surface elevations shall be submitted for approval. 9. The improvements shall be constructed in accordance . with the final working drawings which shall be in substantial compliance with the revised plot plan approved concurrently with the adoption of this resolution. 10. The final working drawing package shall include landscape, irrigation, and lighting plans. These plans shall be in substantial compliance with the revised plot plan approved con- currently with the adoption of this resolution,. 11. The restaurant shall be operated as a "sit-down" restaurant in accordance with the definition of a -restaurant as set forth in Arcadia Municipal Code Section 9220.51.1; no r food shall be consumed on the property except within the building. -3- 669B "., .\ '10- . . . 12. This permit shall be submitted to the City Council for its approval or disapproval and it shall not be effective until approved by the Council. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. FOOTHILL BOULEVARD The Subdivision Committee met on Monday evening at 7:30 p.m. in the Conference Room with Mr. Koppel, the property owner of the subject site; Mr. Ramirez, President of Ponchitos; Mr. Robert Martin, the Contractor; and the Planning Department staff . The purpose of the meeting was to review the original lot split map and the revised plot plans. Action on this application had been deferred pending the development of a satisfactory parking lot, landscaping, and access layout. . The Committee recommends approval of the lot split application subject to the following conditions some of which more rightfully belong in the resolution approving the conditional use permit. The conditions applicable to the lot split are as follows: 1. The conditions of approval specified in the report of the Department of Public Works dated January S, 1969 shall be completed. 2. The conditions of approval specified in the Water Department report dot ed January 7, 1969 shall be completed. 3. A covenant in a form and content approved by the City Attorney shall be recordedsimultoneously with the final parcel map. This covenant shall be enforceable by the City and shall provide that the driveways on both parcels shall be mutually usable by both properties.
