OF THE CITY OF ARCADIA GRANTING A CONDITIONAL

NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY
OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS:

The Subdivisio", Committee met on Mondoy evening at 7:30 p.m. in the Conference
Room with Mr. Koppel, the property owner of the subject site; Mr. Ramirez,
President of Ponchitos; Mr. Robert Martin, the Contractor; and the Planning Department
staff.
The purpose of the meeting was to review the original lot split map and the revised plol
plans. Action on this application had been deferred pending the development of (J
satisfactory parking lot, landscaping, and access layoul.
The Committee recommends approval of the lot split applicCltion subject to the following
conditions some of which more rightfully belong in the resolution approving the
conditional use permit.

The conditiolis o.pplicable to the lot split are CIS follows:
1. The conditions of approval specified in the report of the Deportment of
Public Works dated January 8, 1969 shall be completed.
2. The conditions of approval specified in the Water Deportment report dated
JanuOlY 7, 1969 shall be completed.
3. A covenant in a form and content approved.by the City Attorney shall be
recorded simultaneously with the final parcel map. This covenant shall be
enforceable by the City cmd shall provide that the driveways on both
parcels shall be mutucdly usable by both properties.

This opplicatian, filed on December 31, 1968 in the name of Sydney E. Koppel, owner,
proposes to construct two eating estaplishments.

PRESENT ZONING & LAND USE
The attached map indicates the surrounding zoning and uses. The site proposed for use as
Minnie Pearl's Chicken is presently occupied with a vacant hamburger stand. The site
proposed far use as Ponchito's Taco House is vacant except far asphalt paving. The .25'
easement presently serves three landlocked single family dwellings north of the site. The
,easement and the property it occupies is owned by the applicant.
PROPOSED DEVELOPMENT
A. MINNIE PEARL'S CHICKEN, 305 E. FOOTHill
The proposed development would remove the existing structures in order to develop
the site far an eating establishme':lt.
The area of the site is approximately 29,000 sq. ft. The southerly 135' is in
Zone C-2 and the northerly 113.,31' in Zone PIH. The building is proposed to
contain 1,644 sq. ft. including an area for eating inside. The plan proposes
18 parking spaces or two more than the minimum requirement.
AREAS OF NON-COMPLIANCE WITH APPLICABLE REGULATIONS
1. Three foot high decorative masonry wall required between the parking area
and the landscaped area adjacent to the'street property line.
2. An an-site loading area is required.
3. A 6' high masonry wall and a 5' wide landscaped buffer strip is required
where the site abuts on R-Zone. The,site abuts a PR-1 Zone on the north.

4. The parking area is not provided with the required 3% of landscaping.
Note: These deficiencies are not major problem areas and can be corrected
without difficulty.
B. PONCHITO'S TACO HOUSE, ,309 E. FOOTHILL
-~ The area of the site is approximately 14,590 sq. ft. The northerly 113.31 feet is
zoned PR-1 and the larger remaining portion is in Zone C-2. Approximately
1,680 sq. ft. of building area is proposed plus 100 sq. ft. for a canopy an the
easterly side. This focil ity has been determined to be a drive-in restaurant requiring
20 parking spaces per 1000 feet of gross floor area,. Only 14 spaces are proposed in
lieu of 34 required. However." provision for additional parking has been made
available by the easement along the westerly property line to the PR-l property
adjacent to and north of bath Panchito's Taco House and Minnie Pearl's Chicken.
The Plans indicate that the applicant proposes ta leave this portion vacant.
. AREAS OF NON-COMPLIANCE WITH APPLICABLE REGULATIONS

without difficulty.
RECOMMENDA TION
The Planning Department recommends that this application be approved subject to the
following conditions:

1. The development plans for these parcels indicate provisions for traffic circulation
via the alley running easterly to Valencia Way. The 'Department of Public Works

has recommended that this short stretch of alley be fully improved to eliminate
potential dust and nuisance problems and all casts to be paid by the developer.
An alternate requirement should receive consideration from the Commission.
Either the recommendation of the Public Works Department should be made a
condition of approval or access to the alley should be terminated to prevent
thru traffic from Foothill Boulevard to Valencia Way.
The staff suggests that this could best be accomplished by requiring the applicant
to dedicate access rights to the alley and construct a 6' high ornamentol masonry
wall 5' south of the existing alley. A 5' wide planter should be adjacent to the
wall to provide continuity with the wall and planter t hat is required far a
buffer between, C-2and R zones. Further, a 3' high ornamental masonry wall
also having an adjacent planter should be constructed an the easterly property
line of the Panchito's site.

I All conditional use and C-2 regulations shall be complied with.
y Water service shall comply with the Uniform Plumbing Code and be to the
satisfaction of the Water Department.
