RESOLUTION NO. 668 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR A RESTAURANT' AT 815 SOUTH - -- . BALDWIN AVENUE. WHEREAS, there was filed with this Commission on the 31st day of December, 1968, the application of General Foods Corporation, as Lessee, for the use of ~he property known as 815 South Baldwin Avenue, more particularly described on the plot plan submitted with the application, for restaura.nt purposes; and WHEREAS, a public hearing was duly held on said matter by and before this Commission on the 14th day of January, 1969, at which time all interested persons were given full opportunity . to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. That the subject property is located on the west side of Baldwin Avenue just south of Huntington Drive in a C-2 zone, Property on either side is similarly zoned. The property to the rear is zoned C-O and D. The applicant proposes to remove the existing structures on the property and construct a restaurant facility. SECTION 2. This Commission finds tha,t: 1. The granting of a conditional use permit as herein- . after provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. -1- 668 / . . . .,~ . . 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is'adequste in size and shape to accommodate said use, and all yards", parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the general plan. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit for the use of said property for the construction of a restaurant facility in accordance with the plot plan submitted with the application and the use thereof for restaurant purposes, all in compliance with applicable regulations of the Arcadia Municipal Code, and upon the following conditions: 1. All regulations governing Zone C-2 shall be complied with. 2. A lot split application proposing to divide the sub- ject site from the northerly 125 feet of the lot of which it is a part shall be filed and approved prior to the issuance of a building permit. 3. Water service shall comply wit.h the Uniform Plumbing Code and be to the satisfaction of the Water Department. 4. All existing structures and signs shall be removed from, the subject site. -2- 668 , .. . . . 5. A detailed site plan showing existing and finish surface elevations shall be submitted to the Public Works Department for approval. 6. A full parkway width sidewalk with tree wells shall be constructed on Baldwin Avenue. 7. All utilities shall be installed underground in accordance with approved plans. 8. The restaurant shall be operated as a "sit-down" restaurant in accordance with the definition of a restaurant as set forth in Arcadia Municipal Code Section 9220.51.1; no food shall be consumed on the property except within the building. 11. The owner of said property shall consent and agree in writing to the terms and conditions of this permit. 12. This permit shall be submitted to the City Council for its approval or disapproval and it shall not be effective until approved by the Council. SECTION 4. BALDWIN AVENUE ZONE C':'2 & H ' APPlICA TION This application filed on December 31, 1968 by General Foods Corporation (Burg~r Chef Division) proposes to construct an eating establishment. PRESENT ZONING AND LAND USE The. subject site is zoned C-2 & H and the proposed use is properly one for which a conditionar-use 'permit is authorized. Adjacent property is also zoned C-2 & H. The proposed building site is occupied bya garage and several accessory buildings. The northeasterly portion of the site is developed with a service station facility. PROPOSED DEVELOPMENT The proposed development would remove all existing structures south of the service station facility. The site has a total area of appraximately 17,220 sq. ft. The proposed building would have a floor area of 1,764 sq. ft,. Parking regulations require 10 spaces per 1000 sq. ft. of gross floor area or 18 spaces. Twenty five spaces are proposed. AREAS OF NONCOMPLIANCE WITH APPLICABLE REGULATIONS 1. Three feet high decorative masonry wall required between the parking area and the landscaped area adjacent to the street property line. 2. An on-site loading area is required. These deficiencies are not major and may be corrected without difficulty. RECOMMENDATION The Planning Department recommends approval of this application subject to the fallowing conditions: 1. All regulations governing Zone C-2 & H shall be complied with. 2. Apr'i115, 1969 HONORABLE MAypR AND MEMBERS OF THE CITY COUNCIL ARCADIA, CALlFORN IA SUBJECT: CONDITION NO.9, RESOLUTION NO. 668 JAX RESTAURANT - 815 S. BALDWIN AVENUE The Planning Commission at its regular meeting of April 8, 1969 approved a request to strike Conditi,?n No. 9 of Resolution No. 668 that requires the praperty owner ta dedicate the southerly 20 feet of the site for alley purposes. This request was made by Mr. Frank B. Myers, applicant of Conditional Use Permit No. C. U. P. 68-20. The applicant contended that the 20 foot easement made the property tao small for the purpose of constructing the proposed Jax ,Roast Beef Restaurant. If-the City Council concurs with the Planning Commission's action this condition will be stricken from Resolution No. 668. Baldwin ~ This memo is in reply to your conununication dated April 2, 1969 rela- tive to this department's reconunendation of an irrevocable offer of dedica- tion for a future alley at subject site. The remark contained in your memo relative to your viewpoint regarding creation of an unbuildable site at 722 W. Huntington Drive if the alley is constructed was taken into consideration, as I am sure the same point was considered at the time the City acquired deed U1276 conunitting the property at 726 W. Huntington Drive to an irrevocable offer of dedication of alley right-of-way. It should be noted that the offer does not amount to outright dedication and that future dedication would be totally dependent on complete development of the 722 W. Huntington Drive property. It is not at all inconceivable that at some future date the southerly portion of this iot would be split off and sold to the properties fronting on Baldwin Avenue; and again ,it is not in- conceivable that with R-3 development on the total property at 722 W. Huntington ))rive that the alley could be put through bisecting a complete R..3 use, and with Council concurrence possibly the alley could be constructed over sub- terranean parking facilities at this location. When this alley was constructed extending easterly from Hungate Lane 700 lineal feet, it is the writer's considered opinion that this length of alley was not permitted without the ,definite intention that it would ultimately be extended to Baldwin Avenue, and is further verified by deed #1276. The exist- ing alley clearly exceeds even that length of residential street that is allowed by the Arcadia Municipal Code to terminate in a cul-de-sac. For the above cited reasons the writer feels. that the irrevocable offer is needed at subject location. However, when the alley will be extended is dependent on the future development of 722 W. Huntington Drive, and since the writer would not care to guess when this may occur, or what the develop- ment will consist of, it is my reconunendation that the City avail itself of the present opportunity of obtaining the irrevocable offer of dedication for the alley outlet. It would be much easier at some future date to quitclaim the irrevocable offer than it would be to attempt to obtain the dedication at a future date when it is desirous and possible to extend this alley. ct~7/ ~ CHESTER N. WHEREAS, there was fil~d with this Commission on the 31st day of December, 1968, the applicati6n of General Foods Corporation, as Lessee, for the 'use of ~he property known as 815 South Baldwin Avenue, more particularly described on the plot plan submitted with the application, for restaurant purposes; and .
