RESOLUTION NO. 664 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA DENYING A CONDITIONAL USE PERMIT FOR THE USE OF THE PROPERTY AT 140 EAST FOOTHILL BOULEVARD FOR A DRIVE-IN RETAIL PHOTOGRAPHIC SUPPLIES AND EQUIPMENT STORE,. . WHEREAS, there was filed with this Commission on the 27th day of September, 1968, the application of .Fotomat Corporation, as Lessee, for a conditional use permi,t for construction of a building and the use thereof for a retail photographic sales and equipment business at 140 East Foothill Boulevard in the City of Arcadia, County of Los Angeles, State of California, more specific- ally described as follows: Lots 8 and 9 and the easterly 11.83 feet of Lot 10 in Block G of Tract No. 7723, per map recorded in Book 93, pages 41 and 42 of Maps, in the office of the County Recorder of said County; and, WHEREAS, a public hearing was duly held on said matter by and before this Commission on the 22nd day of October, 1968, and on the 26th day of November, 1968, at which times all interested persons were given full opportunity to be heard and to present evidence,; NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. That the subject property is in Zone C-2. The property has 91.83 feet of frontage on Foothill Boulevard and is 105.74 feet deep. The property contains 9700 square feet and is vacant except for one billboard. The property across Foothill Boulevard to the north is in a C-2 Zone and is developed -1- 664 ~ . . .~ . . with a shopping center and a drive-in eating establishment. Adjacent property east and west is zoned C-2; on the west it is developed with a retail flower shop and on the east with office buildings. There is a 16 foot wide alley at the rear of the property. Property southerly of the alley is zoned R-l and is developed with single-family residences. The applicant proposes to construct a one-story building, 9 feet X 4~ feet, containing approximately 40 square feet. The building will be designed as a drive-in facility so that customers may remain in their automobiles while being served. SECTION 2. This Commission finds that: 1. The lot area of the subject property contains less than 10,000 square feet and the frontage is less than 100 feet. 2. That because of traffic considerations, the proposed use is not a suitable one for the subject property. SECTION 3. That for the foregoing reasons this Commission denies a conditional use permit for the use of said property for the construction of a building and the use thereof for a retail photographic sales and equipment business. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. -2- 664 .- . .. . CHARACTERISTICS OF THE SUBJECT SITE & SURROUNDING AREA . Area of site: 9,700 sq. ft. (91.83 X 105.74) Zonin~ & Land Use: The subject site is zoned C-2 and is vacant except for one billboard. It is intended to serve customers desiring film service without leaving their vehicle. THE FOLLOWING IS A COMPARISON ,OF THE PROPOSAL WITH THE REGULATIONS GOVERNING DRIVE-IN BUSINESSES LOCATED IN A C-2 ZONE. . Note: This proposed use would require at least 3 parking spaces plus space for loading & unloading vehicles to avoid undue interfetence with public use of streets and alleys. ANALYSIS & RECOMMENDATION The subject site is located on an interior lot which may lessen the suitability of any nearby commercially zoned property for commercial use by interfering with pedestrian and vehicular traffic. The proposed use would be more amply suited to a location in a shopping center complex. If a single lot is proposed, the lot should be a corner lot that provides access from two streets and not as l:kely to interfere with commercial pedestrian and vehicular traffic. The proposed ,pplication does not comply with Code requirements in the following categories: a. Lot area b. Signs c. Landscaping d. Location Therefore, the Planning Department recommends that C.D.P. 68-18 not be approved. Submit detailed site plan showing existing and finish surface elevations, type ~ thickness of paving, location and type of driveway aprons and parkway sidewalk. 2. Driveway access to FoothiH Boulevard shall be via neW concrete driveway aprons constructed per City Standard #148. 3. One is I tem No.8 on the agenda which is a conditional use permit application. The other item is No.9, the "Plan Review" of the canva'escent hospital at 1601 South Baldwin Avenue. One C.U.P.68-18 140 E. Foothill Boulevord The applicants have requested perm ission to construct and operate a drive-in business at 140 East Foothill Boulev!,rd. The business is proposed to consist of a retoil film supply and pick. up delivery .service. . ' The property is in Zone C-2 and is located on the south side of Foothill Boulevard one lot east of Wigwam Avenue. On the property is an outdoor odvertising display board. The balance of the praperty is vacant. The intended retail use of the property is ane which is per"1itted in Zone C-2. However the drive-in characteristics of the proposed use is not automatically, permitted. Drive-in businesses in Arcadio are subject to special regulations specified in the ordinance. These special ,re.gulations were designed to insure auto and pedestrian safety and to provide continuity and Jinkage for commercial areas. . After reviewing the plot plan the Committee_decided that the application should not be approved because. the plans are at voriance with the drive-in regulations i~' te rms of lot size, signs and landscaping. I n addition the location of a, drive-in type business on an interior lot is not as desirable as placing it on a comer because of the conflicts created with automotive traffic. . - - s~ G(",,1 .. 01".
