RESOLUTION NO. 660 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR A SERVICE STATION AT 5 WEST LIVE OAK, AVENUE. WHEREAS, there was filed wi th this Commis,sion on the 20th day of August,1968, the application of PHILLIPS PETROLEUM COMPANY for a conditional use permit for the use of the property known as 5 West Live Oak Avenue, more particularly ,hereinafter described, for a gasoline service station; and WHEREAS, after due notice as required by the zoning ordinances of said City a public hearing was duly held on the mat- ter by and before this Commission on the 10th day of September, . 1968, at which time all intereste,d persons were given full oppor- tunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. That the subject property is in a C-2, General Commercial Zone and is presently developed with a non- conforming gasoline service station which is now closed. This property is on the northwest corner of Live Oak Avenue and Santa Anita Avenue and is contiguous on two sides to the new Santa Anita Shopping Center. A solid masonry wall has been constructed on the boundary between the two properties. Vehicular access between the two properties is prohibited until such time as the applicant . ,receives and complies wi th a conditional use permit. SECTION 2. The Planning Commission f-inds al!d determines that said property may appropriately be used for a gasoline ser- vice station. However, any building or structure on the property -1- 660 ./ ..--' \ . \, . . . s,hould harmonize with the new buildings within the Santa Anita Shopping Center. The Planning Commission finds and determines that the granting of such conditional use permit will not be detri- mental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. That the use applied ror at the location indicated is properly one for which a conditional use permit is authorized. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loag.ing, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated . by the proposed use,. That the granting of such conditional use permit will not adversely affect the comprehensive plan. SECTION 3. That for the foregoing reasons, 'subjec t to the approval of the City Council, a conditional use permit is hereby granted for the use of said property for a gasoline service station on the condition that a ranch style building, having rear service bays, architecturally compatible with the Santa Anita Shop- ping Center, be constructed in compliance with the regulations governing drive-in businesses and subject to approval of the plans for said building and other improvements by the Planning Commission. This permit shall not take effect before its approval by the City Council. . Said property is described as follows: That portion of Lot 69 of the Santa Anita Colony, in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 42, page 87 of Miscellaneous RecordS, in the office of the County Recorder of said County, described as follows: -2- 660 .. ... ... . . .. . Beginning at a point in the east line of said lot that is distant along said east line North 00 59' 25" West 107.17 feet from the northerly extremity of the curve described in the decree in Case No. 274177 Superior Court of said County as concave to the northwest and having a radius of' 15.00 feet and a length of 21.21 feet; thence along said east line South 00 59' 25" East 107.17 feet to said northerly terminus; thence southerly along said curve 21.21 feet to its point of tangency with a line that is parallel with and distant northerly 25.00 feet, at right angles, from the southerly line of said Lot 69; thence along said parallel line South 800 05' 15" West 59.94 feet to a point in the northeasterly line of Las Tunas Drive at the easterly extremity of the curve described in said decree as concave to the north and having a radius of 450.00 feet; thence westerly along said curve 77.53 feet; thence parallel with the east line of said lot, North 00 59' 25" West 120.00 feet; thence North 820 49' 44" East 150.00 feet to the point of beginning. SECTION 4. The Secretary shall certify to the adoption of this resolution. PRESENJ ZON ING AND LAND USE The subject property is in Zone C-2 ond presently developed with s!!rvice-station facilities. Adjacent property to the north and west is also zoned C-2 ond Is developed. with a shopping center. The corner property across Santa Anita Avenue to the eost. . is zoned C-2 and developed as 0 service station. The southeast corner of Santa Anita. and Live Oak is also zoned C-2 ond occupied by a market. The property across live Oak Avenue to the south is zoned C-M and developed. with 0 beer bar and Chinese restaurant. The southeast corner of Santa An ita and Live Oak,is occupied by a pottery shop, and outdoor furniture store. EXISTING DEVELOPMENT The subject site" containing approximately 16,500 sq. ft. is presefltlydeveloped with a two bay service building and two pump islands. There is also a 24 hour .self-serv.ice. ice chest located to the rear of the site. HISTORY AND BACKGROUND Historically this station has not been successful. There have been ot leastsix-diHereFl+ ~....- owner/aperators in the past ten years. Perhaps the basic design an:d layout of this station is at fault and could be corrected by redesigning this facility to make..-this choice cor:ner more advantageous. Simple refurbishing of the existing facilities will not ochieve the architeetural compatibility that is expected of commercial property adjacent to a shoppiog. center of this scope and quality. An element of good planning would be to redesign the...,. ... service station in such a manner as to make it part of cin organized community ceflter-. rather than an attachment. Landscaped planters are proposed along the walls of the interior property Jines on both sides of each driveway. a. North side: 3' x 15' and 3' x 25' b. West side: 3' x25' and 3' x 28' 3. A landscaped planter 5' x 31' is proposed between the 2 driveways along. Santa Anita Avenue. 4. ApproximatE:ly 100 sq. ft. of planting at the street corner is proposedinlieu of 150' required. 5. Installation of a 6' x 16' solid masonry screen w<;lll for the restrooms is proposed. ANALYSIS The subject property is located at a major intersection, is commerciall.y zonee-end.. presently developed with a service station. The site is adjacent to..ather-commereiaUy zoned property and has adequate ingress and egress. Santa AIlH-o,ond Live,Qak,Aven\:le bath have adequate widths to accommodate traffic generated by this service station. ~ '1';, This proposal does not comply with the Code requirementS'in the following categories: 1. Landscaping (9275.4. 11.1 ) a. A planter is not proposed between the curb.cut openings-on live-Qo,k Avenue. b. A,pproximately 100 sq. ft. of pianting area .is proposed on the-cornel' of Santa Anita and Live Oak in lieu of 150 sq. ft. required. (9275.4.11.3) c. No planting indicated along the building facade facing Live Oak. - . Thirty sq. ft. of raised pianting area is required. (9275.4.1 LA) 2. Access ways (9275.4.6) It is questionable as to whether the two additional access ways (one on the north and one on the east) would create a traffic hazard that could possibly endanger the safety of pedestrians or motorists caused by vehicular movement into or from the proposed use. -~------ --~- RECOMMENDA TION The Planning Department recommends that C. U. P. 68-16 beapprov'ed provided that a ranch style building, having rear service bays, be architecturally designed to be compatible with the center, and constructed in compliance with the regulations governing drive-in businesses. Howevp.J: if the Planning Commission decides to approve the application as. submitted the following conditions of approval are recammended: . 1. All landscaping shall be braught up to the standards set forth in the .Aree<lia . Municiple Code. This shall include increased planting af .the-corner'of.Santa Anita and Live Oak and a 5 ft.. planter between the curb cut openings on Live Oak Avenue. 2. Section 9275.4.17 of the A.M. C. should be waived to permit the existing. 5 ft. metal wall enclosing the trash area in Jieu of the 5 ft. block wall required. 3. The existing 24 hr. self service ice chest shall be removed from the site. 4. The installation of grating type catch basins behind the driveway aprons "to_, . intercept the drainage and pipe it beneath the sidewalk to existing.storm drai" catch basins in conformance with Article 9262.3.7 of the, Arcadia Municipal Code. 5. Install concrete bumpers in the parking stalls. 6. Install all utilities undergrou nd including underground electric service. .
