A RESOLUTION OF THE CITY PLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A CONDITIONAL
USE PERMIT FOR THE PURPOSE OF CONDUCTING A
USED CAR SALES BUSINESS ON PROPERTY KNOWN AS
5 SOUTH FIFTH AVENUE.
WHEREAS, there was filed with this Commission on the
8th day of August, 1968, the application of Rocci Jo Schavoni, and
Lorraine Schavoni, as purchasers, for a conditional use permit for
condUcting a used car sales business on property in the City of
Arcadia, County of Los Angeles, State of california, desc,ribed as
follows:

The easterly 97 feet of the northerly 76 feet of
Lot 9 of Tract 5205 as recorded in Book 54, Page
61 of Maps in the office ,of the County Recorder
of said County, EXCEPT that portion thereof
dedicated for street purposes.
and,
WHEREAS, a public hearing was held on August 27, 1968
and all interested persons were given full opportunity to be heard
and to presentevidencej
NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY
OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS:
SECTION 1. That subject property is presently vacant
and is zoned C-2" as is all other property surrounding said prop-
erty within the City of Arcadia. The property across Fifth Avenue

is in the City of Monroviaj it is zoned C-3 and is presently vacant.
Uses on adjoining property in the City of Arcadia include a used
car sales business, two motels, and a few older residences. An
easement on the subject property prevents the construction of any
building except on a triangle at the southwest corner of the

. property approximately 1,016 square feet in size. The applicant
proposes to construct a small office building in this area. That
the granting of such conditional use permit will not be detrimental
to the public health or welfare or injurious to the property or
improvements in such zone or vicinity. That the use applied for
at the location indicated is properly one for which a conditional
use permit is authorized. ,That the site for the proposed use is
adequate in size and shape to accommodate said use, and all yards,
spaces, walls, fences, parki9;g, loading, landscaping, and other
features required to adjust said use with, the land and uses in the
neighborhood. That the site abuts streets and highways adequate
in width and pavement type to carry the kind of traffi,c generated
by the proposed use. That the granting of such cohditional use
permit will not adversely affect the comprehensive general plan.

SECTION 2. That for the foregoing reasons, subject to
approval of the City Council, a conditional use permit is hereby
granted for the use of subject property for a used car sales busi-
ness upon the following conditions,:
1. All signs shall comply with the regulations governing
Signs for drive-in businesses in Zone C-2 as set fqrth by Section
9275.4.8 of the Arcadia Municipal Code.
2. The property shall be landscaped in accordance with
plans which shall be subject to approval of the Planning Commission.
Without limitation, the plans shall clearly indicate plantihg areas
or islands and the plant species proposed. All ,landscaped areas
shall be maintained by a permanent irrigation system and surrounded
by a continuous raised concre,te curb. No planting area shall have
an average width of less than three feet.

3. Light standards sh~ll not exceed a height of 15 feet
and shall be shielded and arranged to reflect away from adjoining
properties and streets.
4, Suita.ble barriers, subject to the approval of the
Planning Department, shall be constructed so as to preclude the
encroachment of automobiles on the public rights-of-way.
5. Water service shall be installed as required by the
Water Department.
6. A concrete sidewalk shall be constructed on Huntington
Drive and Fifth Avenue between the curb and property line.
7. Driveway access shall be from Fifth Ayenue only.
8. A detailed site plan showing existing and finish sur-

face elevations and proposed method of drainage shall be submitted
for approval of the Department of Public Works.
9. All utilities shall be installed underground.
SECTION 3. This Commission recommends to the City Council
that Section 9263..2.4 of the Arcadia Munic1pal Code be waived so
that the office building may be constructed on the rear 20 feet of
the subject property.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the, City of Arcadia.

APPLICATION:
On May 24, 1968 Fred Heyden filed a conditional use permit to
develop the subject property partly as a convalescent haspital
and a board and care facility.
The Planning Commission beld its first public bearing on the applicatian on
June- 11, 1968.
The Planning Department report of June 11, 1968 recommended approval of tbe
application subject to compliance with many conditions of appraval. The number
of beds were to be reduced from 150 ta 114 and the' setbacks proposed were to be
changed to make tbe proposed buildings be in line witb the existing buildings on
Duarte, Road. These two conditions required tbe preparation of revised plans.
Therefore, the public hearing was continued to June 24, 1968.
On June 18, 1968 the Zoning Committee cansidered the application and reported
to the Commission on June 25, 1968 that the application be approved subject to
compliance with the original conditions specffied in the staff repart af June
11. 1968.
On June 25. 1968 the Planning Commission decided to continue the public hearing
to July 23, 1968 to permit the architect to submit revised plans incorparating
as many of the conditions of approval from tbe staff report as possible.
On July 22, 1968 the Zoning Committee reviewed the revised plans of the project
and nated that the project had changed from a combination convalescent baspital
and board and care facility to a complete board and care institution. The
number of beds had been reduced from 150 to 114 and the proposed building had
been sited to camply with the required setbacks. However, a question concerning
the lengtb af tbe building still bad to be resolved. These facts were presented
to the Commissian on July 23. 1968. At the July 23 meeting the Commission
continued the public hearing until August 13, 1968 to permit time to prepare
another set of revised plans to carrect the length of the building.
REVISED PLANS The Planning Department has reviewed tbe latest plans and finds
that abaut one third of the land area is used for buildings, with tbe balance
of the site about equally divided for use as open space and parking and driveways.
The, plan is recommended for APPROVAL subject to compliance witb the following
conditions. '

This application is filed in the name af F.red Heyden. As purchaser he proposes to
construct a one -story, 100 bed convalescent hospital and a 2-stary, 100 bed board
and care home on the north side of Duarte Road between Baldwin Avenue and la Cadena.
CHARACTERISTICS OF THE SUBJECT PROPERTY AND SURROUNDING AREA
Area of Site: 90,244 sq. ft.
locatian: Narth side of Duarte Road bounded ,an the west by a mortuary, an the east
by an apartment building and on the north by the proposed extensian af Arcadia Avenue.

Zoning, The proposed site consists of lot 45 together with the westerly 70.31 feet of
lot 46 Tract 3430. All lats are presently zoned R-l and are vacant. However a
vorianc,e was granted to this site many years ago ta permit it to be developed with
apartments similar to those recently canstructed an both sides af Duarte Road east of
the site.
Existing Use:
The property is currently vacant.
Adjacent Zaning & Uses:
Property ta the north and at the rear af the site is dedicated far the praposed extensian
of Arcadia Avenue. Other praperty to the north is zaned R-3.
The prapertyon l'he east boundary is Zaned R-l. It is governed by Resolution No. 3356
which permits apartments. The pr operty is developed with an apartment camplex.
The praperty to the west is also zoned R-l and is occupied by a mortuary. This use
came into existence when variance Na. V-58-1 was approved.

The plan praposes a one-story structure having the following setbacks:

The Convalescent Home is prapased ta have appraximately 25,000 sq. ft. ar 28"10 af the
site area. The tv.'o-story Board and Care Hame proposes 24,000 sq. ,ft. on approximately
13"1oof the site. The two buildings combined utilize about 41"10 of the site. Parking
area and driveways utilize 32,000 sq. ft. ar 36"10 of the site leaving 21,000 sq. ft. or
23"10 of the site for open space.

PROPOSAL
The applicant praposes ta operate the ,used car sales ISf from a small affice building,appraxi-
mately 18' x 21', to be canstructed on the southwest carner of the site.. Planters (2' x 6')
are proposed to be spaced evenly alang the, rear (sauth) praperty line. Two more planters of
equal dimensians are proposed to be located on the westerly praperty Iir:le and spaced ellenly
between the office buildi ng and the nartherly praperty line on Huntingtan Drive. Planting
areas are also indicated along Huntingtan Drive and Fifth Avenue but are located outside of
the property line.
ANALYSIS AND RECOMMENDATION
The subject site is a rectangular shaped parcel 56' x 97' minus a triangular parcel (28' 3"
at its base) at the nartheast carner of the property.

following condItions: '
