RESOLUTION NO. 656 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA GRA~~ING A CONDITIONAL USE PERMIT FOR CONSTRUCTION OF A RESIDENTIAL HOME FOR BOARD AND CARE OF WELL, AGED PERSONS ON PROPERTY LOCATED AT 531-601 DUARTE ROAD. WHEREAS, an application was filed on May 24, 1968 by Fred Heyden for a conditional use permit for the construction of a . combination convalescent hospital and board and care home on property located at 531-601 Duarte Road, in the City of Arcadia, County of Los Angeles, State of Cali~ornia, more specifically described as follows: Lot 45 together with the westerlY-70.31 feet of Lot 46, Tract 3430 as per map recorded in Book 42, page 32 of Maps in the office of the County Recorder of said County; and, WHEREAS, public hearings were held on said application; and WHEREAS, thereafter the application was modified to request a board and care facility only; and WHEREAS, thereafter a public hearing was held on August 13, 1968, at which time all interested persons were given full oppor- tunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. That the proposed site is in the R-l Zone and consists of approximately 90,244 square feet. The property at the . present time is vacant. Property to the north and at the rear of the site is dedicated for the proposed extension of Arcadia Avenue arid beyond this property the area is zoned R- 3. The property to the east is in Zone R-l and pursuant to Resolution No. 3356 is developed " , -1- 656 ( , , , . . . with an apartment complex. Property to the west is zoned R-l and is occupied by a mortuary pursuant to Variance No. V-58-I. That the granting of such conditional use permit will not be detrimental to the puqlic health or welfare or injurious to the 'proper:ty or improve- ments in such zone or vicinity. That the use applied for at the location indicated is properly one for which a conditional use per- mit is authorized. That the site for the proposed use is adequate in size and shape to accommoda te said use" and all yards, spaces, walls, fences, parldng, loading, landscaping, and other features required to adjust said use with the land and uses in the neighbor- hood. That the site abuts streets and highways adequate in width . and pavement type to carry the kind of traffic generated by the proposed use. That the granting of such conditional use permit will not adversely affect the comprehensive general plan. SECTION 2. That for the foregoing reasons a conditional use permit is granted, subject to the approval of the City Council, for the use of the above described property for the construction of a residential home for board and care of well, aged persons upon the following conditions: 1. This permit shall not be operative untii final working drawings have been submitted to and approved by the Planning Com- mission. Without limitation, said drawings shall show and include the following limitations and features: . a. All details shown on the preliminary plans, including elevation plans. b. All signs to be placed on the premises; said'signs shall comply with the C-O Zone sign regulations. -2~ 656 , , '. , . . . c. Landscape and irrigation plans, prepared by a registered landscape architect. d. . Anyincinera tors" which shall be located entirely within an enclosed building. e. The drawings shall show a minimum se'tback from Duarte Road o~ not less than 40 feet for a two-story building and not less than 24 feet ,for a single~story building. f. Block walls sha'll be constructed with a decorative me.terial. g. Any mechanical equipment on the roof shall not exceed a height of 10 feet, shall be screened . 50 that it' cannot be seen f.rom ground level, and shall be designed so as to present a harmonious relationship to the building architecture, as viewed from above. h. The working drawings shall be approved by the Department of Social Welfare of the State of California or any ,successor agency of the State performing the functions presently performed by said Department. i. The drawings shall provide for not more than 114 beds. 2, No structure shall be placed on said property unless shown on the working drawings, and the project shall be constructed ... in strict ac~ordance with the. working drawings. 3. Detailed grading and drainage plans, prepared by a registered civil engineer, shall be submitted to and approved by the City Engineer. All drainage must be intercepted and conveyed -3- 656 ! . . . . . . to an approved water course. Pump drainage, if necessary, shall be installed in accordance with design data on file in the office of the City Engineer. 4. Easements will be granted as required for rear line utilities. All utilities shall be installed underground. S. A five-foot wide concrete sidewalk shall be constructed adjacent to the curb on Duarte Road across the entire width of the property. 6. Existing driveway openings on Duarte Road shall be closed and access from Duarte Road shall be limited to one 3S-foot dri veway opposi t'e the Lovell Avenue intersection. 7. One parking space shall be provided for each two beds. 8. Wheel stops shall be provided for all parking spaces for the protection of planted areas. 9. Parking lot light standards shall not exceed a height of lS feet, measured from the adjacent pavement. The lighting source shall be shielded and arranged to reflect away from adjoining prop- erties and streets. 10. ,No building o,r other s,tructure, other than fences, walls, lighting equipment, bumper strips, Iandscape architectural features and uncovered automobile parking places, shall be erected or maintained within the rear lS feet of the property line. 11. All 'water service shall be as required by the Water Department, and ,shall be in compliance with the Uniform Plumbing Code. 12. The home shall at all times have, and be operated in such a manner as to require, a license from the state Department of Social Welfare. 13. This permit shall not take effect until it is approved City Council. -4- 6S6 ~ .. : l \ . . . SECTION 3. The Secretary shall certify to the adoption of this resolution 'and shall cause a copy to be forwarded to the City Council of the City of Arcadia.
