HomeMy WebLinkAbout0643 0' '~ , . ." . . . RESOLUTION NO, 643 A RESOLUTION OF THE CITY PLANNING COMMISSION GRANTING A CONDITIONAL USE PERMIT TO ALLOW A NURSERY SCHOOL AT 716 WEST HUNTINGTON DRIVE. WHEREAS. there was filed with this Commission on the 26th day of March. 1968 the application of LUBEN BALABANOFF for a condi- tional use permit for a nursery school to be located on property known as 716 West Huntington Drive, more particularly hereinafter described; and . WHEREAS. after due notice as required by the zoning ordi- nances of said City a public hearing was duly held on the matter by and before this Cownission on the 9th day of April, 1968, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW. THEREFORE. THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. The Planning Commission finds and determines that said applicant has operated a nursery school on said property continuously since September. 1962 pursuant to a variance granted at that time; that there have been no complaints from adjoining property owners regarding the operation of the school and that it appears that continued use of said property for a nursery school is compatible with the use of surrounding property and that good zoning practice justifies continuation of the existing use under a . conditional use permit. SECTION 2. That the granting of such conditional use permit will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. -1- 643 V" , . . . . That the use applied for at the location indicated is properly one for which a conditional use permit'is authorized. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls. ,fences. parking, loading, land- scaping, and other features required to adjust said use with the land and uses in the neighborhood. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. That the granting of such conditional use permit will not adversely affect the comprehensive e5,",Uw.L_l plan. ~J~ ~. SECTION 3. That for the foregoing reasons a conditional use permit is hereby granted to use said property for a nursery . school on the condition that said nursery school continuously com- plies with all regulations applicable to nursery schools, particu- larly the regulations contained in Article IX of the Arcadia Munici- pal Code. Sections 9275.3 et seq. Said property is described as follows: That portion of Lot 23. Tract No. 2731. in the City of Arcadia, County of Los Angeles. State of California. described as follows: Beginning at a point 2.5 feet easterly of the northwest corner of said Lot 23; thence easterly along the northerly line of said lot a distance of 80.0 feet; thence South 30 50' 0" East. a distance of 245.23 feet; thence South 860 10' 10" West, a distance of 80.0 feet; thence North 30 50' 0" West, a distance of 245,11 feet to the, point of beginning. .
