" ALSO EXCEPT theeastelly 125.34 feet of said land; -1- 637 ~' . . . , . vlHEREAS,' a public hearing was held Ma.rch 12, 1968 and all interested persons were given full opportunity to be heard and to present evidenc.e.; NOW, THEREFORE, THE CITY PLA1~ING CO~WITSSION OF THE CITY OF A11.CADIA, HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. That the subject property has an area of 22,000 square feet with the south 135' in Zone C-2 and the north 63.41 in Zone PR-l. The proposed development provides for demoli- tion and remo'v'al of existing structures. The property is subject to an easement which serves three (3) landlocked single-family d\'lellings north of the si te. That the granting of a conditional use permit a,s hereinafter provided will not be detrimental to the . public health or welfare or injurious to the property or :Linprove- ments in such zone or vicinity. That the location and zoning of the eating establishment are proper under the terms of conditional use permits, That the site for the proposed use is adequate in size and sha~e to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the nei~lborhood. That the site abuts Foothill Boulevard which is adequate in width and pavement type to carry the kind of traffic generated by the proposed use. That the gra.nting of a conditional use permit as hereinafter provided vdll not adversely affect the comprehensive general plan. SECTION 2. That for tIle foregoing reasons, this Conunission . hereby grants a ce,nditional use permit for the construction of an eating establishment on the above described property subject to compliance wi th all applicable regulations of the Arcadia I-iunicipal Code and upon the following conditions: -2- 637 '. A lot split application shall be filed, approved and completed showing :the 48.41' of additional depth added to the exist- ing 113,41' X 150' parcel. 3. Permittee shall remove all structures, pump islands, 1.Ulderground storag,e tanks, light standards and billboa,'ds from the $ubject site before commencing construction. 4, Permittee shall construct a full parkway i~idth concrete $idewalk in front of the subject site and close existing drive open- ing not to be used before opening for business. 5. Permittee shall submit detailed plans shOWing existing and finished surface elevations of proposed structures and grading ror approval of the Department of Public Works. 6. All drainage shall be intercepted and conveyed to the street by conduit under the sidewalk meeting with the approval of the Department of PUblic Works. 7. All utilities shall be installed underground, 8. Tree wells shall be installed on Foothill Boulevard as required by the Department of Public Works. 9, Permittee shall submit evidence to the City Attorney that the easement to said residential properties is of record, or at the request of the City Attorney shall execute a covenant pro- Viding an easement as it presently exists for access to said prop- erty, Said easement shall be maintained in an open condition at all times so as to give complete freedom of access and egress to the owners and/or occupants of said residential properties. -3- 637 v. , . . . of' this resolution. PLANNING COMMISSION FROM: PLANNING DEPARTMEN T TO: SUBJECT: C, U. p, 6S-.~ - Eating Establishment - 301 East Foothill Boulevard Zone C-2 & PR-l APPLlCA rlON This application filed in the name of Sydney E. Koppel, owner, proposes to construct an eating establishment having inside and ouhide dining areas, PRESENT ZONING AND LAND USE The attached map indicates the surrolindingzoning and uses. The subject property is presently occupied with a service building, 4 pump islands, a car wash structure, and a billboard, PROPOSED DEVELOPMENT The proposed development would remove the existing structures in order to develop the site for an eating establishment, The site has an area (113.41 x 198,41) of 22,000 square feet with the south 135' in Zone C-2 and the north 63.41 in Zone PR-l, The proposed building would have a floor area of 1250 square feet and have both a n inside and outside eating area, The plan proposes 46 parking spaces which is equal to 37 spaces per 1000 square feet of floor area. A two way driveway is proposed on the site in conjunction with a two way off site vehicular easement which is proposed to be utilized for ingress-egress and also as a turn around area for the 11 parking spaces along the east side of the building, The easement presently serves three landlocked single family dWellings north of the site. The ease'J1ent and the property it '? occupies is owned by the applicant. .\ ~ ~....-~ .LQ..!lC . AREAS OF NONCOMPLIANCE WITH APPLICABLE REGULA TlONS 1. Thirty square feet of planting area required along the front building facade. 2, Three foot high decorative masonry wall required between the parking area and the landscaped area adjacent to the street property line. 3. An on-site loading area is required. 4. Parking spaces on either side of the building are IS' in length in lieu of 20' required. 5. A 6' high masonry wall and a 5' wide landscaped buffer strip is required where the site abuts an "R" zone. The site abuts a PR-l zone on the north, 6. The parking area is not provided with the required 3% of landscaping. 7, Wheel stops are required"ln the parking spaces at the rear of the site and also adjacent . to the building if clirbing is not provided adjacent to the sidewalk and potio area, S, Storage of wares, crates, bottles, etc., to be inside the building. The plan, indicates an enclosed service yard at the rear of the building. . All of the above listed deficiencies can be corrected without difficulty excepting Item #S which oppears to satisfy thll intent of the ordinance, &~ . . . C.U. The appl icant proposes to re-open an existing service station. Because of the size of the si teand the location of existing structures the Comm ission found some of the regulotions that govern drive-in businesses should be waived, The regulations recommMded to be waived are those which pertain to lot size, off street parking, landscaping, outside display of limited merchandise and cash box, and underground utilities. . RESO LUTl0N NO. 636 - A conditional use permit was approved to remodel the existing service station at the northwest corner of Duarte Road and Second Avenue.
