A RESOLUTION OF THE CITY PLANNING
COMMISSION OF THE CITY OF ARCADIA,
CALIFORNIA, GRANTING A CONDIT,IONAL
USE PERMIT UPON SPECIFIED CONDITIONS
FOR THE REOPENING OF AN EXISTING
SERVICE STATION ON PROPERTY LOCATED
AT 424 EAST FOOTHILL BOULEVARD IN
SAID CITY, AND RECOMMENDING THE WAIVER
OF CERTAIN MUNICIPAL CODE REQUIREMENTS.
WHEREAS, there was filed with this Commission on the 25th
day of January, 1968, the application of BLAINE STRONG, for a condi-
tiona1 use permit for the purpose of reopening an existing service
station which has been unused for a period in excess of ninety (90)
days, which facility is located on property at 424 East Foothill
_ Boulevard in the City of Arcadia, County of Los Angeles, State of
California, more specifically described as follows:
Lots 1 & 2, Block A, Tract 7723, as per map
recorded in Book 93, Pages 41 and 42 of
Miscellaneous Records in the office of the
County Recorder o.f said County;
and

WHEREAS, a public hearing was scheduled for Tuesday,
February 13, 1968, which hearing was continued by the Secretary of
the Commission until February 27, 1968, due to a lack of quorum, at
which time said public hearing was held, and all interested persons
were given full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY
OF ARCADIA, CALIFORNIA, HEREBY DETERMINES AND RESOLVES AS FOLLOWS:

SECTION 1. That subject property is in Zone C-2. All
four corners of the intersection are commercially zoned and used
for that purpose. The properties to the west are zoned C-2, to the
North. 0-3, and to the South R-l. The properties on the east side

of Fifth Avenue are. in Monrovia and are zoned C-3 and R-3. That
the existing service station facilities upon the subject site are
proposed to be.used after certain alterations are made in the land-
scaping of the site and the removal of an existing light standard
adjacent to the alley. That the station is in good condition and
probably has a number of years of useful life remaining before re-
development takes place. That the granting of a conditional use

permit as hereinafter provided will not be detrimental to the public
health or welfare or injurious to the property or improvements in
such zone or vicinity. That the location and zoning of the service
station are proper under the terms of conditional use permits.
That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking,
loading, landscaping, and other features required to adjust said use
'with the land and uses in the neighborhood. That the site abuts
Foothill Boulevard which is adequate in width and pavement type to
carry the kind of traffic generated by the proposed use. That the
granting of a conditional use permit as hereinafter provided will
not adversely affect the comprehensive general plan.

SECTION 2. That for the foregoing reasons, this Commission

hereby grants a conditional use permit for the reopening of, an exist-
ing service station on the above described property subject to com-
pliance with all applicable regulations' of the Arcadia Municipal Code
except such portions of Part 7 of Chapter 2 of Article IX thereof as
may be waived by the City Council, and upon the following additional
conditions:
1. A corner cut-off based on a 15' pr.operty line radius
shall be dedicated to the City.

2. Potteu plants at northerly corner of building shall
be permanently attached.
3. Restrooms shall be screened from public rights-of-way
by a decorative screening device and subject to Planning Department
approval.
4. An outside trash enclosure shall be installed.
5. A City standard tree well shall be installed on Fifth
Avenue.

6. Existing curb, gutter, sidewalks and driveway aprons
not reconstructed shall be repaired.
7. Working drawings shall be reviewed and subject to
approval by the Planning Department.
8. Any work done in the Fifth Avenue parkway shall be
by permit of the City of Monrovia.
SECTION 3. This Commission further recommends to the
Arcadia City Council that Sections 9275.4.4, 9275.4.5, 9275.4.11,
9275.4.12 and 9275.4.16 of the Arcadia Municipal Code be waived
for the reason'that the strict adherence to said Sections would
work a hardship and not secure the appropriate development of the
site.
SECTION 4,. The Secretary shall certify to the adoption
of this resolution and shall cause a copy hereof to be forwarded
to the City Council of the City of Arcadia.

------- APPLICATION
This appl ication filed in the name of Blaine Strong, purchaser, proposes to reopen existing
'service station facilities at the southwest corner af Foothill Blvd. and Fifth Ave, A condi-
tional use permit is required because of the expiration of the business license.

ZONING AND LAND USE
The subject property is zoned C-2 and presently developed with service station facil ities.
The properties on the east side of Fifth Ave. (Monrovia) is zoned C-3 and R.,3 and developed
with a drug store, c market and . The property on the northwest and northeast
cO,rners of Foothill and Fifth (Monrovia) is zone C-3 and developed wi th a service statio(l,
a drive-in dairy, a real estate office and an automotive garage. The properties to the west
are zoned C-2 and developed with real estate offices, an antique store and an aportment
building. The property to the south is zoned R-I and residentiallydeveloped.
PROPOSAL
The plan proposes tel utilize the existing facilities for service station uses after certain alter-
ations are made. The proposed alterations include a 3' x 30' planter along the east property
line, a planter at the northeast corner of the site, portable planters at the northerly corner
of the building and removal of an existing light standard adjacent to the alley.

ANALYSIS
.
The subject property has an area of (92.5 x 105.01') 9,713 square feet (10,000 sq ft. is required)
was developed in December of 1954 and has been operated as a service station and tire business
for the past thirteen years.. The station has two boys, is in good condi'tion and I ikely has a
number of years af useful Ufe remaining before redevelopment takes place.

A similar application (C.U.P~6-18 Harlor Service Stations, Inc.) to reopen the subject
facilities was approved by the Planning Commission in December of 1966. That application
differed however, in that the property adjacent to the west which is developed with an office
building and an apartment building was inclt,ded as part of the site. Under that application
it was proJ:lased to remove the office building on the front of the site. A condition of approval
was to remove both the office building and the apartment building on the rear of the site.
The applic:ation was allowed to expire with the exception of'theshifting of one pump island
and the addition of a small amount of brick veneer on the building . The two proposals
(service station site only) are basically the same.
The ten foot width between the pump islands and the property lines is not sufficient to accom..
modate the required five foot wide planters. The corner planter is proposed to have an area of
110 square feet in lieu of 150 square feet required. As noted on the plot plan, the area aid
shape of this planter is governed by vehicular clearance to and from the pump island on Foothill.
A 15' (radius) corner cut-off would reduce the area of this planter.
The proposed potted plants along the narrow ledge at the northerly corner of the building
should be attached to insure their permanency.

The subje<:t property although large enough for a service station site is not developed in such
a manner that it can comply in total with the landscaping req'uirements fora drive-in business.
Restrooms, which are required to be-screened, are located in the northerly end of the building.
The building has been repainted and miscellaneous rubbish is currently being removed from the
site.
The Planning Department has encouraged redevelopment and remodeling of existing service
station properties
The location and zoning of the property is proper under the terms of conditional use permits.
Application of the code requirements and conditions as specified below will harmoniously
adjust the use to the area. A waiver of some requirements is suggested where such require-
ments would work' a hardship and not secure' the appropriate' development of the site:'

d. that display regulations (section 9275.4 16) be modified to permit oil dispensers,
windshield cleaning accessories and cash. boxes on the pump islands,
e. that underground utility requirements (section 9275.4.12) be'modified to permit use
