RESOLUTION ~O. 632 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING AMENDMENr OF THE ARCADIA MUNICIPAL CODE BY ADDING THERETO A NEW SECTION 9247.4. THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, DOES DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That on January 23, 1968, .the City Planning Commission instituted proceedings for the purpose of holding hear- ings, receiving evidence, considering and, making recommendations concerning the amendment of Chapter 2 of Article IX of the Arcadia Municipal Code, containing zoning regulations, pursuant to which a . public hearing for such purposes was scheduled for Tuesday, February 13, 1968, which hearing was continued by the Secretary of the Com- mission until February 27, 1968, due toa lack of quor~. There- after, on February 27, 1968, said public hearing was held, at which time all interested persons were given full opportunity to be heard and to present evidence. SECTION 2. That as a result of said hearing and based upon evidence and reports received and. filed thereat, the City Planning Commission hereby recommends to the City Council of the City of Arcadia that Chapter 2 of Article IX of the Arcadia Munici- pal Code be amended by adding thereto a new Section 9247.4, the same to read as follows: . 9247.4. PUBLIC ACQUISITION. Whenever any lot, any build- ing or any structure is rendered nonconforming within the meaning of this Code solely by reason of a reduction in a required front yard setback, yard area, lot area or reduction in off~street -1- 632 .. . . . parking facilities, occurring after the adoption of this Section and solely by reason of: a. dedication to, or purchase by, the City for any public purpose; or b. eminent domain proceedings, which result in the acquisition by the City of a portion of such property, the same shall not be deemed nonconforming within the mean- ing of this Part. SECTION 3. The Secretary shall certify to the adoption of this resolution a.nd shall cause a copy hereof to be forwarded to the City Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing resolution was adopted ~ at a regular meeting of the City Planning Commission of the City of Arcadia held on the 27th day of February , 1968, by the following vote: AYES: Commissioners Cahill, Kuyper, Livingston, Parker, stewart and Lauber NOES: None ABSENT: Commissioner Godfrey Zt!.~ J( ;/~~ .
