RESOLUTION NO. 622 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A CONDITIONAL USE PERMIT TO ALLOW'A PORTION OF THE ARCADIA BAPTIST CHURCH PROPERTY LOCATED AT 805 NORTH FIRST AVENUE, IN SAID CITY TO.BE USED FOR A FORTY-PUPIL CHRISTIAN PRE-SCHOOL DAY NURSERY. WHEREAS, there was filed with this Commission on the 14th day of November, 1967, the application of the ARCADIA FIRST BAPTIST 'CHURCH, a California Corporation, for a conditional use permit to allow a portion of the property located at 805 North First Avenue, Arcadia, California, to be used for a forty (40) pupil Christian Pre-School Day Nurllery, which property is specifically described as follows: Lots 67 to 73 inclusive, of Tract 7820 of the City of Arcadia, County of Los Angeles, State of Cali- fornia, as per map recorded in Book 83, Page 30 of Maps in the office of the County Recorder of 'said County, together with all of the fifteen foot vacated alley lying easterly of and adjoining said Lot 72, excepting therefrom the easterly ten feet of said Lots 67 to 71 inclusive, conveyed to the City of Arcadia for public street and highways by deed recorded in Book 7431, page 262 of Official Records. . Also the northerly 100 feet of the westerly 65.00 feet of Lot 7 and the northerly 150 feet of the easterly 62.5 feet of Lot 7, Tract 3112 of the City of Arcadia, County of Los Angeles, State of California, Book 29, Page 68 of Official Records, and the north 56.7 feet of Lot 8 of Tract No. 3112, City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book ~9, Page 68 of Maps, in the office of the County Recorder of said County, excepting therefrom the East 10 feet thereof, conveyed to the City of Arcadia for street purposes, by deed recorded in Book 17413, Page 46, Official Records of Los Angeles County, California, and, WHEREAS, after due notice as req1J.ired by the Zoning Ordi- nance of said City~ a public hearing was duly held on the matter by -1- 622 v " . . '. . . . and before this COlIilnission on the 28th day of November, 1967, at which time all interested persons were given full opportunity to be heard and to Present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, HEREBY DETERMINES AND RESOlVES AS FOLLOWS: SECTION 1. That the subject property is in Zone R-2, as are the properties to the north and east; the properties to the south and southeast are zoned R-3. That the property is located directlY north of the proposed Foothill Freeway and directly east of the Santa Anita off~ramp. That existing on. the site is a church building with adjoining rest rooms, offices and a school area, which school area is proposed to be used for the nursery school. That the proposed site is one which could accommodate a school of this type and not be detrimental to the surrounding residential property. That First Avenue is a wide arterial street which provides sufficient separation from the residential properties to the east. That the location of the site on First Avenue also provides a street which is equipped to handle traffic to and from the site and from widely scattered parts of the community without causing a residential traf- fic problem, and the existing driveways on the property give easy ingress and egress to the site and provide a safe means for leaving and picking up children. SECTION 2. That a school as proposed is allowed in Zone R-2 under a conditional use permit, That the granting of such con- ditional use permit will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required ~2- 622 " .. . , . to adjust said use with the land and uses in the neighborhood. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. That the granting of such conditional use permit will not adversely affect the comprehensive general plan. SECTION J. That for the foregoing reasons, this Commission hereby grants a conditional use permit to use a portion of the above- described,property for the conduct and operation of a Christian Pre- School Day Nursery substantially as outlined in the application, upon the fOllowing conditions: 1. A six (6) foot high chain link fence shall be installed '. and maintained to enclose the children's play area. 2. That the provisions of Title 3 of Division 5 of Part 7 of Chapter 2 of Article IX of the Arcadia Municipal Code be at all times complied with. 3. The camper and boat presently being stored on the church parking lot shall be adequately screened from public view. SECTION 4. That the within conditional use permit shall become effective ten (10) days after the date hereof', unless an appeal from the granting thereof be filed within said time pursuant to Section 9275.2.9 of the Arcadia Municipal Code, in which event the conditional use permit shall become effective only if granted , and upon such condltionsas may be imposed by the City Council. That the property may not be used for the purpose permitted by the ~ within conditional use permit prior to compliance with condition number 1 contained in Section 3 hereof. SECTION ~). The existing structure is presently used for Sunday School classes, nursery through high school, Sunday morning, Sunday Evening, Wednesday Evening, and at any special events such as vacation Bible Schaal. It is proposed by the applicant for use as a Christian Pre-school Day Nursery. Hours of opE!ration would be: Monday, Wednesday, Friday, 9:00 a.m. to 11:30 a.lll, Tuesday ~lOd Thursday 9:00 a.m. to 11:30 a.m. and 1:00 p.m. to 3:30 p.m. . ZONING AND LAND USE The subject properly is in Zone R-2. Properties to the north and east, are also .in Zone R-2. The properties to the south and southeast are Zoned R-3. The property is located directly' north of the proposed Foothill Freeway and directly east af the Santa Anita off-ramp. PROPOSED USE Existing ,on the site is a church building with adjoining rest rooms, offices and a school area. The plan praposes to use the school area for the nursery school. No additional structures are proposed. The school Qrea includes 1668 square feet of floor area, plus adjoining kitchen both, and office space. There is also a smaller room of approximately 380 square feet that joins the school area which can be used. ANALYSIS The Department of Social Welfare has reviewed the building plans and have found them adequate for forty (40) children. . The site fronts on First Avenue which is adequate in width and pavement type to carry the kind of traffic'generated by the proposed use. - 1- . . . Mrs. Lowe's qualifica~ions for the position of director of the nursery school seem excellent. Her personality also indicates that she can work well with young children. . Our review of your building plans indicates that the large room has adequate play space for approximately 30 children. The smaller room will accommodate ten children.
