RESOLUTION NO. 618 A RE'SOLUTlON OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A CONDITIONAL USE PERMIT TO AUTHORIZE THE REMOVAL OF EXISTING SERVICE STATION AND TO CONSTRUCT &7-(; NEW SERVICE STATION FACILITIES ON 'TI-jE NORTHWEST CORNER OF HUNTINGTON DRIVE AND BALDWIN AVENUE IN SAID CITY, UPON SPECIFIED CONDITIONS. WHEREAS, there was filed with this Commission on the 18th day of July,I967, the application of Union Oil Company of California, as Lessee, for a conditional use permit for the purpose of removing all existing facilities and constructing a new service station on property located on the northwest corner of Huntington Drive and Baldwin Avenue in the City of Arcadia, County of Los Angeles, State of California, more specifically described as follows: . and, Beginning at the intersection of the east line of Lot 6, Tract 949 (said east I ine being the center line of Baldwin Avenue) as established and shown on County Surveyor's Map B-lll, in the office of the surveyor of Los Angeles County, with the north line of Huntington Drive, as described in the deed to the City of Arcodia, recorded in Book 9396, page 145, Official Records, thence South 850 06' 50" West 55.47 feet, along said north line af Huntington Drive, to the true point af beginning; thence along said north line South 850 06' 50" West 145.86 feet; thence North 040 01' 00" West 164.66 feet; thence North 85006' 50" East 80.22 feet; thence South 20 58' 25" West 0.75 feet; thence South 870 01' 35" East 98.00 feet toa point on the westerly line of Baldwin Avenue; thence South 2058' 25" West along said westerly line, a distance of 138.85 feet; thonce a long a curve concave to the northwest hav ing a radius of 15 feet, a distance of 21.50 feet to the point of be- ginning, WHEREAS, a public hearing was duly held on said matter by and before this Commission on the 8th day of August, 1967, at which time all interested persons were ,given full opportunity _ to be heard and ta present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION I. That subject property is in Zone CO, and currently used for service station - I - 618 v' r ,0 . . . purposes. The plans submitted comply with the regulations concerning minimum setbacks and lot area requirements. That current use of the property, zoning and location at the intersection of two major arterials meet the criteria for location of a service station. That the operation will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity since this is a continuation of the present business. That the location on a commercially zoned. prop~rty is.a zoning district in;,which conditional use permits are authorized. ,Thai- the site is adequate in ,size and all other features required to adjust the use with land and uses in the'neighborhood. That,the site abuts two major arterials, both of which are adequate in width and pavement to carry the kind of traffic generated by the proposed use. That the granting of a conditional use permit . will not adversely affect the comprehensive general plan. SECTION 2. That for the foregoing reasons, this Commission hereby grants a conditional use permit for the removQI of the existing facilities and the construction of a new service station on the above described property, subject to compliance with all applicable regulations of the Arcadia Municipal Code, except such portions of Title 40f Division 5 of Part 7 of Chapter 2 of Article IX thereof as may be waived by the City Council, and upon the following additional cond i tions: 1. That two (2) feet for widening Baldwin Avenue and a fifteen (15) foot radius corner cut-off be dedic:ated to the City of Arcadia. 2. That the existing catch basins, traffic signals, etc. be relocated and that Baldwin Avenue be widened four (4) feet on the west side. Plans for the proposed widening shall be appraved by the Director of Public Works. . 3. That a full parkway width sidewalk on Baldwin Avenue and Huntington Drive shall be canstructed. 4. That all utilities shall be installed underground with said plans to be approved by the Department of Publ ic Works prior to the installation. 5. That all nuisance or surface drainage shall be collected by appropriate facilities and piped to gutter or existing catch basins. 6. That detailed grading and drainage plans shall be submitted to the Department of Public Works for approval. 618 - 2,- . . . . 7. That all water r.ervice shall be as required by the Water Department, and shall be in compliance with the Uniform Plumbing Code. 8. That a six (6) f<Jot high masonry wall shall be located along the north and west line of the 70 foot by 100 foot parcel north of and adjacent to the subject site, and also along the north line of the subject site where it abuts a residential zone. The six (6) foat high wall shall be reduced to a height of thirty (30) inches when it reaches a point twenty-five (25) feet back of the street side praperty line. 9. That a, planter having a minimum width of three (3) feet in width shall be located in front of the pump islands and five foot planters along the wes't and 'north walls. SECTION 3. This Commission recommends to the Arcadia City Council that the provisions of Section 9261.4.1, and Section 9275.4.16 of Title 4 of Division 5 of Part 7 of Chapter 2, of Article IX of the Arcadia Municipal Code be waived for the reason that the strict adherence to said provisions would be inappropriate to the intended use of the property. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause . a copy hereof to be forwarded to the City Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Planning Commission held on the 8th day of August, 1967, by the following vote: AYES: Commissioners Godfrey, Livingston, Parker and Louber.
