RESOLUTION NO. 614 A RESOLUTION OF THE CITY PLANNING CO~aSSION OF THE CITY OF ARCADIA, , CALIFORNIA, DENYING THE GRANTING OF A CONDITIONAL USE PERMIT TO MAKE /1 ,j STRUCTURAL ALTERATIONS TO A NON- @ '1 CONFORMING SERVICE STATION ON PROPERTY LOCATED AT 420 NORTH SANTA ANITA AVENUE IN SAID CITY. WHEREAS, there was filed wi.th this Commission on the 28th day of April, 1967, the application of Bryce W. Parker, as agent . for the owner, for a conditional use permit to make structural altera- tions to an existing service station on property located at 420 North S.anta Anita Avenue in the City of Arcadia, County of Los Ange- les, State of California, more specifically described as follows: Lots 32, 33 and 34 of Block 82, Santa Anita Tract, as recorded in Book 15, pages B9 and 90, of Miscellaneous Records, in the office of the County Recorder of Los Angeles County; and, WHEREAS, after due notice as required by the Zoning Ordi- nance of said City, a public hearing was held on the matter by and before this Commission on May 23, 1967, at which time all interested persons were given full opportunity to be heard and to present evi- dence; NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, HEREBY DETERMINES AND RESOLVES' AS FOLLOWS: SECTION 1. That said application is filed with respect to a non-conforming service station site to add a 30-inch wide eave . overhang with light fixtures. That site development as proposed . ' does not conform with the provisions of the Zoning Ordinance and particularly with Sections 9275.4.7, paragraph 2, 9275.4.8, 9275.4.11 and 9275.4.18 of the Arcadia Municipal Code. -1- 614 V" ~ . . . SECTION 2. That for the foregoing reasons, this Commis- sion hereby denies the requested conditional use permit for struc- tural alterations on a non-conforming service station on the above- described property. SECTION 3. The Secretary shall certify to the adoption of this resolution. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Planning Commission of the City of Arcadia held on the 13th day of June , 1967, by the, following vote: AYES: Commissioners Ferguson, Kuyper, Stewart and Golisch . May 23, 1967 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: CONDITIONAL USE PERMIT 67 - 4 - 420 NORTH SANTA ANITA AVENUE APPLlCA TlON This applicatil)n is filed on a non-conforming service station site, requesting' permission to make structural alterations to an existing building by adding a 30 inch wide eave overhang with light fixtures. No other changes are proposed on'the site. The subject property is located on the southeast corner of Santa Anita Avenue and, Colorado Boulevard in.theM-l P.LD. zoning district. ANALYSIS Service ,stations may be permitted in Zone M-l provided that they comply with the Conditional Use requirements for drive..in: businesses and provide essential service facilities to the uses in the zone. Location of this facility at the intersection of two major streets and bounded on three sides by industrial zoning places it in a location to meet Conditional Use requirements and provide an essential service facility in the industrial area. Site development as proposed, however, ,does not meet all zoning ordinance requirements. The. most notable deficiency is the absence of required landscaping. Other than meeting our ordinance requir,ements there appears no obstacle to gronting the request for the building alteration. ' RECOMMENDA TlON The Planning Department recommends that Conditional Use Permit No. 67-4 be approved subject to the following conditions: " 1. A revised set of plans shall be submitted to and approved by the Planning Department and Department of Public Works. 2. NOW, THEREFORE, NOTICE IS HEREBY GIVEN that on Tuesday ,MAY 23, 1967, at the hour of 8:00 o'clock p.m., in the Council Chamber of ,the City Hall, 240 West Huntington Drive, Arcadia, California, the Planning Commission will hold a public hearing on the request. An opportunity will be afforded to persons particularly interested, and the public generally, to be heard on all matters concerning said Conditional Use Permit.
