RESOLUTION NO. 611 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A /'13 CONDITIONAL USE PERMIT UPON SPECIFIED CONDITIONS C1 . FOR THE REMOVAL OF EXISTING FACILITIES AND CONSTRUCTION OF A NEW SERVICE STATION ON PROPERTY LOCATED AT 4 EAST FOOTHILL BOULEVARD IN SAID CITY AND RECOMMENDING THE WAIVER OF CERTAIN MUNICIPAL CODE REQUIREMENTS. . WHEREAS, there ,was filed with this Commission on the 6th day of April, 1967, the application of Texaco, Inc., as Lessee, for a con- ditional use permit for the purpose of removing all existing facili- ties and constructing a new service station on property located at 4 East Foothill Boulevard in the City of Arcadia, County of Los Angeles, State of California, more specifically described as follows: The northerly 105.00 feet of the southerly 287.40 feet of the westerly 105 feet of Lot 8 of C. B. Clapp's Subdivision of Lot 14 in Block 89 of Santa Anita Rancho, per map recorded in Book 31, page, 30, of Miscellaneous Records, in the office of the County Recorder of said County; and, WHEREAS, a public hearing was duly held on said matter by and before this Corrmdssion on the 25th day of April, 1967, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. That subject property is in Zone C-2 and cur- rently used for service station purposes and is surrounded by property ~ zoned and used for C-2 purposes. The plans submitted comply with the regulations concerning minimum setbacks and lot area requirements. That current use of the property, surrounding use, zoning and location at the intersection of two major arterials meet the criteria. for loca- tion of a service station. That the .operation will not be detrimental to the public health or welfare or injurious to the property or im- provements in such zone or vicinity since this is a continuation of -1- 611 v ~ . . . the present business. That the location on a commercially zoned property is a zoning district in which conditional use permits are authorized. That the site is adequate in size and all other features required to adjust the use with land and uses in the neighborhood. That the site abuts two major arterials, both of which are adequate in width and pavement to carry the kind of traffic generated by the proposed use. That the granting of a conditional use permit will not adversely affect the comprehensive general plan. SECTION 2" That for the foregoing reasons, this Commission hereby grants a conditional use permit for the removal of the existing facilities and the construction of a new service station on the above- . described property subject to compliance with all applicable regula- tions of the Arcadia Municipal Code. except such portions of Title 4 of Division 5 of Part 7 of Chapter 2 of Article IX thereof as may be waived by the City Council, and upon the following additional conditions: 1. That a corner cut-off based on a 15-foot property line radius shall be dedicated. 2. That existing curb,gutter and sidewalk shall be re- paired to the satisfaction of the Department of Public Works. 3. That City-standard tree wells shall be constructed on Santa Anita Avenue and Foothill Boulevard. , 4. said plans to installation. That all utilities shall be installed underground with be approved by the Department of Public Works prior 'to 5. That detailed grading and drainage plans shall be sub- mitted to the Department of Public Works for approval. 6. That all nuisance drainage shall be colle.cted by appro- priate facilities and piped under the sidewalk and through the curb face. . 7. That easements for joint use of driveway aprons as in- dicated on the plans shall be obtained as well as easements to per- mit drainage onto adjoining property as shown,. SECTION 3. This Commission recommends to the Arcadia City Council that the provisions of Section 9275.4.5, subsection 1; Sec- tion 9275.4.11, sullsection 2; Section 9275.4.16; Section 9275.4.17; and Section 9275.4.8, subsection 5. of Title 4 of Division 5 of Part 7 of Chapter 2 of Article IX of the Arcadia Municipal Code be waived -2- 6n , ~. . . . for the reason that the strict adherence to said provisions would be inappropriate to the intended use of the property. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy hereof to be forwarded to the City Council of the City of Arcadia. As indicat'ed. above, the subject proper,ty is in Zone C-2 currently used for service stotion purposes, and is located at the southeast comer of Foothill Boulevard and Sonto Anita Avenue. The subject property is surrounded by C-2 zoned and used property. - 1 - . . . C.U.P.67-3 April 25, 1967 Page Two COMPLIANCE WITH DRIVE-IN FACILITIES REGULATIONS Minimum setbacks and lot area requirements comply with the regulations. Other areas where compliance with the regulations is indicated on the plans or assumed is for accessways, walls, lighting, utilities, operation and del,iveries, Areas of non-compliance are as follows: 1. Parking - other than two parking slots in the lubrication bays and possibly one other space, the parking requirements are less than required by code. (Does not allow for sufficient employee parking.) 2. S'igns - Two pylon sign~, mounted on the wall of an architectural projection c;re"bove the roof line and the free-stancling sign indicates 0 rotating movement. . 3. Landscaping - The corner planter is deficient by 42 square feet, planting areas adjacent to the building are not indicated and planters required along the interior property lines hove been eliminated. ' 4. Restroams - The restraoms are located on the street side of the building and entrances and ore not screened. 5. Storage and Displays. Oil display on pump islands. 6. Trash Area. Steel enclosure. ANALYSIS AND RECOMMENDATION Current use of the property,surrounding use, zoning, and location at"the intersection of two major arterials, in the opinion of the Staff, supply justifications sufficient to meet the criteria for location of.a service station. Some modification of the plan os presented is necessary to comply with the regulations and harmoniously adjust the use to its surroundings and the general plan.
