A RESOLUTION OF THE CITY PLANNING
COMMISSION OF THE CITY OF ARCADIA,
CALIFORNIA, GRANTING A CONDITIONAL
USE PERMIT UPON SPECIFIED CONDITIONS
FOR THE OPERATION OF A RETAIL STORE &71
AND AUTOMOTIVE SERVICE AREA ON -
PROPERTY LOCATED AT 1418 SOUTH BALDWIN
AVENUE IN SAID CITY AND RECOMMENDING
THE WAIVER OF CERTAIN MUNICIPAL CODE
REQUIREMENTS,
WHEREAS, there was filed with this Commission on the 20th
day of January, 1967, the application of Peck Realty Corporation for
Goodyear Tire and Rubber Company for a conditional use permit for the
purpose of operating a retail store and automotive service area for

the installation of products sold on the premises on property located
at 1418 South Baldwin Avenue in the City of Arcadia, County of Los
Angeles, state of California, more specifically described as follows:
Parcell: The northerly 50 feet of Lot 1 of
Tract No. 5907 per map recorded in Book 63,
page 67, of Maps in the office of the County
Recorder of said County;
EXCEPT therefrom that portion of said land
lying easterly of the following described line:
Beginning at a point in the southerly line of
said land distant westerly thereon 120,00
feet from the southeast corner of said land;
thence northerly ina direct line to a point
in the northerly line of said lot distant
westerly thereon }22.76 feet from the northeast
corner of said lot;
Parcel 2: Lot 31 of Tract No. 4611 per map
recorded in Book 51, page 82, of Maps in the
office of the County Recorder of said County;
. and,
WHEREAS, a public hearing was duly held on said matter by
and before this Commission on the 14th day of February, 1967, at
which time all interested persons were given full opportunity to be
heard and to present evidence;

NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY
OF ARCADIA, CALIFORNIA, HEREBY DETERMINES AND RESOLVES AS FOLLOWS:
SECTION 1. Subject property is in Zone C-2 as is the prop-
erty to the north, south and west. Property to the east is in Zone
R-2 and R-l. The property to the south is developed with a church;
property to the north is developed with a small store and the prop-
erty to the west is developed with a market and some small stores.
The property to the east is developed with single-family structures.
It is proposed that approximately 2200 square feet of the structure
will be used for retail sales service and office area; that the floor
are for storage of tires, batteries and accessories will consist of
approximately 2300 square feet; that a service area of 3100 square
feet with eight service bays complete the balance of the gross floor
area of the building. That subject property can be harmoniously ad-
justed to the surrounding uses and the community, and will not be
detrimental to the public health or welfare or injurious to the prop-
erty or improvements in such zone or vicinity. That the 'site abuts
Baldwin Avenue, a major street which is adequate in, width and pave-
ment type to carry the kind of traffic generated by the proposed use.
That the alley to the rear of subject property affords ease of in-
gress and egress to the site. That a wall between the church on
property located to the south and subject property will give protec-
tion to the neigh1:loring use. That 17 parking spaces are indicated
on the plan with 8 additional spaces in a roofed area, which is con-
sidered adequate to meet the needs.
SECTION 2. That for the foregoing reasons, this Commis-
sion hereby grants a conditional use permit for the operation of a
retail store and an automotive service area on the above-described

~ property subject to compliance with all regulations applicable to
drive-in businesses except such portions of the C-2 regulations as
may be waived by the City Council and upon the following additional
conditions:
1. That a 30-inch wall be constructed on the property line
adjacent to the planter;
2. That existing driveway aprons on Baldwin Avenue that
are not to be used be removed and standard curb, parkway width side-
walks and tree wells be constructed to match the existing' facilities;
3. Tha,t a detailed site plan showing existing and finished
surface elevations and proposed method of drainage be submitted to
and approved by the Planning Department;
4. That the City of Arcadia be granted permiss~on in the
. form approved by the City Attorney to continue to use in place the
water lines located within the northerly 10 feet of Lot 1 of Tract No.
5907 for a period of at least 10 years, and thereafter until given
15 months' notice to remove the same.
SECTION 3. The decision of this Commission is final unless
appeal is taken within ten (10) days from the adoption hereof; pro-
vided, however, that the conditional use permit hereby granted shall
not become opera.tive until compliance with condition no. 4 of Section
2.
SECTION 4. This Commission further recommends to the Arcadia

City Council that the provisions of Section 9263.,2.4 of the Arcadia
Municipal Code be waived for the reason that the strict adherence to
said provision would be inappropriate or inapplica.ble to the intended
use of the property.
SECTION 5. The Secretary shall certify to the adoption of
resolution and shall cause a copy hereof to be forwarded to the
Council of the City of Arcadia..

The application wos filed by the Peck Realty Corporotion, for Goodyear Tire and Rubber
Company, for the purpose of operating a retail store and automotive service area used for
the installation of products sold on the premises at 1418 South Baldwin Avenue.
PRESENT ZONING AND LAND USE
The subject property is in Zone C-2, as is the property to the north, south and west. Property
to the east is in Zone R-2 and R-l, The property is to be developed with a new service
store ClOd retail floor area. The property to the south is developed with a church. '."

veloped with a market and some small stores. The property to the east is developed with

PROPOSED DEVELOPMENT
Approximately 2200 SCluare feet of the structure will be used for retail sales service and
office area, Floor area for storage of tires, batteries and accessories will consist of
approximately 2300 square feet. A service area ,of .3100 square feet with eight service
bays complete the balance of the gross floor area of the building.
ANALYSIS
Approximately a year ago the City of Arcadia undertook a study af conditional uses which
resulted in the adoption of a set of new regulations March 16, 1965. It included a new
title regulating drive-in businesses which applies to the subject application. This title
established the requirements to be met before a conditional use permit could be granted.
In analyzing the subject property and its location, the Staff is of the opinion that it can
be harmoniously adjusted to the surrounding uses and the community if the above mentioned
regulations are generally applied. The location on Baldwin Avenue, a major street, with
an alley to the rear, affords ease of ingress and egress to the site, A wall between the
church and the subject property will give protection to that use. Retail and storage floor
areas require a total of 23 parking spaces. 17 spaces are indicated on the plan with 8
additional spaces in a roofed area, or a total of 25 spaces. This is considered adequate

to meet the needs of this facility. Zone C-2 regulations require a rear yard of 10
feet. None is indicated an the plan, The Planning Department recommends that
the building be allowed to be located on the property line, The solid wall with
no apenings is preferable fa a storage or use area when located across the alley
from the residential property.
RECOMMENDA TION
The Planning Department therefare recommends approval, subject to campliance
with regulations for drive-in businesses, and the fallowing conditions:
1. Construct a 30 inch wall on the property line adjacent to the pl~nter.
2. Grant an easement for water I ine purposes to the City of Arcadia over the
northerly 10 feet af Lat I, Tract No, 5907.
3. Existing driveway aprons not to be used on Baldwin Avenue should be
removed and standard curb, parkway width sidewolks and tree wells
be constructed to match the existing facilities.
4. Submit a detailed site plan showing existing and finished surface elevations
and proposed method of drainage.
