RESOLUTION NO. 604 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING' A CONDITIONAL USE PERMIT UPON SPECIFIED CONDITIONS TO CONSTRUCT AND OPERATE A RESTAURANT WITH AN OPEN PATIO AT 1220 SOUTH BALDWIN AVENUE IN SAID CITY AND RECOMMENDING THE WAIVER OF CERTAIN MUNICIPAL CODE REQUIREMENTS. WHEREAS, proceedings were regularly instituted and duly conducted for a conditional use permit to Lum's of Arcadia, Inc. to construct an outdoor eating area for a restaurant loca,ted on property known as 1220 South Baldwin Avenue in the City of Arcadia, County of '. Los Angeles, State of California, more specifically described as follows: All of Lot 3 and the southerly 4 feet of Lot 2 of Tract No. 5659, as recorded in Book 115, page 100, of Maps, in the off1,ce of the Recorder of said County; and, WHEREAS, after due notice as required by the Zoning Ordi- nance of said City, a p~blic hearing was duly held on the matter by and before this Commission on the 8th day of November, 1966, at which time all interested persons were given a full opportunity to be heard and to present evidence; NOW, THEREFORE~ THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. That the granting of such conditional use per- , mit will not be detrimental to the pUblic health or welfare or in- jurious to the property or improvements in such zone or vicinity. That the use applied for at this location is properly one for which a conditional use permit is authorized. That the site abuts streets ~- ~4 ( Cur#. :) ? . . . and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. That the granting of such conditional use permit will not adversely affect the comprehensive general plan. SECTION 2. That for the foregoing reasons, this Commission hereby grants a conditional use permit to the extent that the same is necessary for the construction and operation of a restaurant with an outdoor eating area on the above-described property subject to com- ~ 1/ pl1ance with all applicable regulations of the Arcadia Municipal Code, except such portions of Titles 3, 5 and 6 of Division 3 of Part 6 of Chapter 2 of Article IX thereof as may be waived by the City Council and upon the following additional conditions: 1. That final working drawings be in substantial compli- ance with the approved preliminary plans; 2. That detailed pians be submitted to and approved by the Department of Public Works, said plans to show ex'isting and finished surface grades in the parking lot, the proposed method of drainage, and the type and thickness of paving; 3. That concrete bumper blocks be provided in the parking stalls; 4. That the existing power pole behind the metal shed be relocated to the northeast or southeast corner of the property to clear the proposed parking area. SECTION 3. This Commission further recommends to the Arcadia City Council that the provisions of Title 3 and Title 5 and Section 9263.6.4 of Title 6 of Division 3 of Part 6 of Chapter 2 of Article IX of the Arcadia Municipal Code be waived for the reason that the strict adherence to said provisions would be inappropriate or inapplicable to the intended use of the property in view of its proposed expansion. -2- 604 .. . . SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwar.ded to the City Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Planning Commission held on the 22nd day of November, 1966, by the following vote: AYES: Commissioners Golisch, Kuyper, Lauber, Stewart and.
