A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A CONDITIONAL USE PERMIT UPON SPECIFIED CONDITIONS FOR CHURCH PURPOSES AFFECTING PROPERTY LOCATED AT 146, 152, 156 AND 160 WEST DUARTE ROAD IN SAID CITY. . WHEREAS, there was filed with this Conunission on the 12th day of September, 1966, the application of The Church of Jesus Christ of Latter-Day Saints for a conditional use permit for church purposes affecting property located at 146, 152, 156 and 160 West Duarte Road in the City of Arcadia, County of Los Angeles, State of California, more specifically described as follows: 146 W. Duarte Road - That portion of Lot 4 of Santa Anita Colony Tract, as per map recorded in Book 42, page 87 of Miscellaneous Records, in the office of the County Recorder of said County, described as follows: Beginning ot a point in the north line of said lot, distant South 800 36' 30" West 544.34 feet from the Northeast corner of said lot; thence along the north line South 80036' 30" West, 121.46 feet; thence South 90 09' 10" East 208.45 feet; thence South 12028' 25" East 99.50 feet; thence North 890 36' 30" East 67.38 feet, more or less, to a point designated "A" in a line extending from the point of beginning to a point in the south line of said lot, distant westerly 537.65 feet from the southeast corner of said lot, said point designated "A" being distant north 0024' West along said extended line 340.45 feet from the south line of said lot; thence North 0024' West 322.32 feet to the point of beginningj . 152 W. Also except the northerly 12 feet measured at right angles of said landj -1- 599 ~. . . . .. . and., WHEREAS, a public hearing was duly held on said matter by and oefore this Conunission on the 27th day of September, 1966, at ~lhich time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. That the proposed site consists of approximately 99,000 square feet with 380 feet of frontage along Duarte Road and an average depth of 280 feet. That the entire site is in Zone R-l with most of the surrounding properties zoned R-l. That the property to the north is also partially in Zone R-2 and used for the High School si te . That property to the east ispa,rtially unzon~d for the Ci ty Library. That the proposed use can be adjusted to be compatible with the residential area to the south and the west. That the use applied for is properly one for which a conditional use permit is authorized. That the site is adequate in size an<~ shape to acconunodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required, to ad.just the use with the land and uses in the neighborhood. That the site abuts Duarte Road, one of the City's arterial streets, which is adequate in width and pavement type to carry tre kind of traffic generated by the proposed use. That the granting of such conditional use permit will not adversely affect the comprehen- sive general plan as it has previously been determined that the site is appropriate for public and semi-public use. SECTION 2. That for the foregoing reasons, this City Plan- ning Commission does hereby grant a conditional use permit to allow the above-described property to be used for church purposes upon the follow- ing conditions: -2- 599 '> , '. . . . . 1. The wall on the south property line shall be located on the property line and shall have a five foot planting strip adjacent to it. B. The wall on the west property line shall be located on the property line and shall have a five foot planting strip adjacent to it. The wall shall be reduced to a height of three feet in the building setbock area. '. C. A five foot planting strip shall be located adjacent to the proposed. wall to be constructed on the east property line. (NOTE: Wall heig hts sholl be measured from adjoining properties and shall be in no case less than five fee six inches high when measured from within the site at points ad'jacent to the wall.). . 3. All utilities shall be installed underground as required by Department of Publ ic V'{orlts Standards. Underground service plans must be approved by Edison Company, upon applicant's submission, prior to commencement of final structural plan check. 4. All curb cuts sholl meet with the approval of the Department of Public Works. 5. Prior to any construction on site all existing structures shall be removed or demolished; 6. Alllandscoped areas shall be planted, irrigated and maintained in perpetuity. 7. All planting areas shall be separated from asphalt parking lot paving by concrete curbing. . 8. Complete landscape planting and sprinkler irrigation plans prepared by a Registered Landscape Architect shall be submitted as part of the working drawing package. 9. Circulation, paving, stall size, aisle width, stall marking, planting and irrigation shall be arranged and installed in compliance with parking lot layout standards on fi Ie in the Planning Deportment of the City af Arcadia. . A. Parking spaces shall be provided on the basis of one (1) parking space .for four (4) seats, plus one (1) additional space for each church official resident on the premises. B. Tree cutouts shall be provided in locations specified by the Planning Deportment and approved by the Planning Commission. 10. All exterior lighting shall be hooded and dj"rected away from adjoining properties and streets. Light standards shall not exceed ten feet in height when measured from adjacent finish grades. 11. Sidewalks, street lighting, street trees shall be installed in locations approved by the Department of Public Works. 12. Any signs sholl be approved by the Planning Commission at the time of submission of pions for .approval. -3- 599 '. . ... . . . 13. Any outside refuse storage area shall be screened on three sides by a six foot high solid fence or wall. 14. Church steeple or other appurtenances shall not exceed a height of fifty feet. 15. Water services shall meet with standards set forth in the Uniform Plumbing Cade and shall be approved by the Water Superintendent. 16. Concrete sidewalk and driveway aprons shall be constructed to conform to Drawing No. 148 of the Public Works Department. 17. Driveway and parking areas shall be paved in conformance with the provisions , of the Arcadia Municipal Code. 18. Concrete bumpers shall be installed in parking stalls. 19. .A complete grading and drainage plan, prepared by a Registered Civil Engineer, including pump drainage design if applicable, shall be approved by the Department of Public Works. . 20. Complete working drawings in substantial compliance with the approved preliminary plans shall be submitted and approved by the Planning Commission prior to the issuance of a building permit. ~ 21. The .City Planning Commission sholl res'erve the right witho'ut necessity of further noti<:e of hearing to make minor modifications of any of the foregoing conditions, if such modification will achieve substantially the same results and will in no way be detrimental to adjacent properties or improvements than wi II the strict compliance with said conditions. 22. The conditional use permit shall not become operative until final plans are submitted and approved by the Planning Commission. 23. That 12 feet at 152 West Duarte Road and the balance re- quired at 146 West Duarte Road shall be dedicated for the widening of Duarte Road, those portions dedicated to be improved in accordance with requirements of the Public Works Department. SECTION 3. The Secretary shall certify to the adoption of this resolution. September 27, 1966 TO: pLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: CONDITIONAL USE PERMIT APPLICATION (C.U.P. 66-16) SOUTHSIDE OF PUARTE ROAD BETWEEN EL MONTE AVENUE AND SANTA ANITA AVENUE. APPLICATION The application is filed in the name of The Church of Jesus Christ of Latter-DQy, Saints to allow the property to be used for church purposes. The property is located on. the south side of Duarte Rood between Santa Anita Avenue and EI Monte Avenue, and is commonly known as 146-152-156 and 160 West Duarte Rood. SUBJECT PROPERTY, SURROUNDING LAND USE AND ZONING . The proposed site consists of approximately 99,000 square feet with 380 ft. of frontage along Duarte Road, and an average depth of 280 ft. ~ The entire site is in Zone R-l. Under provisions specified in Resolution No. 3714, however, the property can be used for Planned Residential Unit Development. This would allow a greater density than is permitted. under existing R-l regulations. The properties surrounding the subject site are in the following zones: A. The property to the north is zoned partially R-l and partially R-2. . It is used for the High School site. ~. The property to the east is partially zoned R,..1 and partially unzoned (City Library). It is developed with publ ic and semi-public uses consisting of a church, Masonic Temple and the City Library. In addition, the First Church of Christ Scientist has been granted permission to b.uild a new church building. C. The property to the south is in Zone R-l and is developed with single-family residences. . D. The property to the west is zoned R-l and I ike the subject property has the Planned Residential Unit Development option granted by Resolution No. 3714. The properties in the area with the exception of those along EI Monte Avenue are developed with older residential structures. - 1 - / .t/ bt/.-Jvl :-1# / 5 I . . . C.U.P.66-16 September 27, 1966 Page Two PROPOSED SITE DEVELOPMENT Although no specific site development plan accompanies this application, it is proposed that the property be used .for church purposes. ANALYSIS Churches are allowed by Conditional Use Permit to locate in Zone R-l. The analysis of the subject application must, therefore, be based upon the compatibility of the use with surround- ing uses. Pertinent to this discussion is a determination made by the City Council that the property is appropriate for uses other than. R-l (See attached Resolution, No. 3714). This resolution allowed the property to be used for Planned Unit Residential Development. This concept would allow a greater density than R-l. . It was cited in making this decision that one of the considerations was the previous determination by the City that the subject property should be developed for public ond semi-public uses. The additional development option for Planned Unit Residential Development was given. Since that time no interest has been shown for development under this original concept. The subject appl ication is certainly within the intent of the original concept of publ ic and semi-public uses. In order to grant a conditional use permit, however, the use must be evaluated on the following requirements set forth as prerequisite conditions before a Con- ditional Use Permit can be granted: A. Such Co"ditional Use will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. The property across the street is owned by the Arcadia Unified School District and is developed with the Arcadia High School buildings. The proposed use can be adjusted to be compatible with residential area to the south and west. B. The use applied for at the location indicated is properly one for which a Conditional Use permit is authorized. As has been stated previously, churches are permitted by Conditional Use Permits in Zone R-l. . -2- . . . C.U.P.66-16 September 27 , 1966 Page Three C. The site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required, to adjust 'the use with the land. and uses in the neighborhood. Them is sufficient area for this purpose since the subject property has in excess of 99,000 square feet and is ample in terms of width and depth. D. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use., DlDrte Road is one of the City's arterial streets and qualifies in this manner. The proposed use would be the fifth major traffic generator to locate in this area. The Staff, however, does not anticipate any severe problems provided that adequate parking is provided. . E. The granting of such Conditional Use Permit will not adversely affect the comprehensive general plan. If the previous policy of the City Council and Planning Commission that the site is appropriate for public and semi-public use is still applicable, then this use would not affect the general plan for.the area. In terms of environment and accessibil ity, the site is an appropriate lo.cation for a church. The site is on an arteriol street where it is easily accessible from scattered parts of the community. The above analysis is based upon the use of the subject property and not a specific set of development plans. Based upon the use, the Planning Department recommends that the appl ication be approved, subject to the following conditions: . 1. Preliminary development plans shall be submitted to and approved by the Planning Commission before the Conditional Use Permit becomes effective; such plans to be drawn to scale and to comply with the requirements on file in the Planning Department office.
