HomeMy WebLinkAbout0595 o . , ~ ct11.(),,..,~ <, RESOLUTION NO. 595 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A CONDITIONAL USE PERMIT UPON SPECIFIED CONDITIONS FOR THE REMOVAL OF ALL EXISTING FACILITIES AND THE RECONSTRUCTION OF A RESIDENTIAL TYPE TWO-BAY SERVICE STATION ON PROPERTY LOCATED AT 1127 SOUTH BALDWIN AVENUE IN SAID CITY AND RECOMMENDING THE WAIVER OF CERTAIN MUNICIPAL CODE REQUIREMENTS. WHEREAS, there was filed with this Conunission on the 14th day of July, 1966, the application of Union Oil Company by R. L. FoUrbee, Manager of General SerVices, for a conditional use permit for the re- moval of the existing facilities and the construction of a residential type two-bay service station on property known as 1127 South Baldwin Avenue in the City of Arcadia, County of Los Angeles, State of Calif- ornia, ~ore specifically described as follows: The easterly 120 feet (measured along the southerly line) of the southerly 110 feet (measured along the easterly line) of Lot 123 of Tract No. 2731, as recorded in Book 33, page 29, of Maps, recorded in the office of the County Recorder of said County; and, WHEREAS, a public hearing was duly held on said matter by and before this Conunission on the 9th day of August, 1966, at which time all interested persons were given full opportunity to be heard and to pre- sent evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. That subject property is in Zone C-2 and is 120 feet by 110 feet and contains a gross area of 13,200 square feet. That the proposed construction will not be detrimental to public~ safety, health or welfare and will greatly improve the appearance of subject property. That drive-in facilities are permitted in Zone C-2, subject -1- 595 v ... '. . . . j . . to the issuance ofa conditional use permit,. That the proposed site is adequate in size and shape to accommodate said use. That subject property abuts Baldwin Avenue and Duarte Road, both thoroughfares adequate in width and pavement type to carry the kind of traffic gen- erated by the proposed use. SECTION 2. That for the foregoing reasons, this Commission hereby grants a condit,ional use permit for the removal of an existing service station and the reconstruction of a residential type two-bay service station on the above-described property subject to compliance with all applicable regulations of the Arcadia Municipal Code, in- cluding those specified for drive-in businesses and for businesses in Zone C-2, except such portions of Title 4 of Division 5 of Part 7 of Chapter 2 of Article IX thereof as may be waived by the City Council and upon the following additional conditions: 1. That prior to the time the future bay is added, pre- liminary plans showing the addition and the manner and location of the required parking and trash areas be submitted to the Planning Com- miss10n for approval. 2. That twenty feet for Baldwin Avenue, ten (10) feet for Duarte Road and a fifteen (15) foot radius PL corner cut off shall be dedicated to the City. 3. That grading and drainage plans shall be submitted for approval by the Department of Public Works. 4. That all utilities shall be installed underground. 5. That all surface drainage shall be picked up by catch basins and piped to gutter or existing catch basins. 6. That existing curb and gutter, sidewalks and driveway aprons shall remain, and where necessary be repaired to the satis- fact10n of the Department of Public Works. -2- 595 . . . . . j . SECTION 3. This Conunission further reconunends to the Arcadia City Council that the provisions of Section 9275.4.5 of the Arcadia Municipal Code be waived, and that the provisions of Paragraph 1 of Section 9275.4.11 ,:>f the Arcadia Municipal Code be waived to the ex- tent necessary to permit a planter of a minimum width of three (3) feet along the Duarte Road side, for the reason that the strict adher- ence to said Sections would be inappropriate or inapplicable to the intended use of the property in view of its proposed expansion. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City . Council of the City of Arcadia. P. 66 - 14 UNION OIL COMPANY - 1127 SOUTH BALDWIN AVENUE APPLlCA TION: Name: Union Oil Company 461 South Boylston Avenue Los Angeles, Calif. Request: A Conditional Use Permit application has been filed requesting permission to remove all existing facilities and the reconstruction thereon of a type 300 R residential type two-bay service station, with a 24 ft. canopy and one pump island on each street, with a No. 276 rotating ball sign to be located at the southeast corner of the property. The appl ication further states: 1. The proposed construction will not be detrimental to public safety, health, or welfare, and will greatly improve the appearance of the property. 2. The subject property is Zoned C-2, on which a Conditional Use Permit is authorized. 3. The proposed site is adequate in size and shape to accommodate said use. 4. The subject property abuts Baldwin Ave. , a major artery; Duarte Road, a secondary highway. Both thoroughfares are adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The removal of the existing facilities and the building of anew 300 R residential type unit will add to the appearance of this property, and will be of aesthetic value to the community and an asset to the neighborhood. The application is signed by R. L. Fourbee, Manager, General Services, Union Oil Co. ZONING AND LAND USE The subject property is in Zone C-2. It is 120 ft. x 110 ft. and contains a gross area of 13,200 square feet. Drive-in-facilities are permitted in Zone C-2, subject to the issuance oF-a Cord itional Use Permit and compliance with the regulations governing such facilities set forth in the Arcadia Municipal Code. - 1 - ~l\~ . . . C.U.P.66-14 Aug. 9, 1966 Page Two REGULATIONS GOVERNING DRIVE-IN-FACILlTIES The regulations for Drive-in-Businesses are set forth in Sections 9275.4 through 9275.18 of the Zoning Ordinance. The plot plans have been checked against the applicable regulations as follows: Regu lations Proposed Lot Area 10,000 sq. ft. 13,200 sq. ft. (NOTE: 3,200 sq. ft. of the existing lot is proposed to be dedi.cated for Baldwin Avenue and Duarte Road. Twelve feet for each street.) Parking About 8 spaces 3 . (NOTE: In addition to the Drive-In-Business regulations Section 9275.4.1 calls for compliance with the C-2 regulations. The C-2 regulations require 5 spaces per 1000 sq. ft. of gross floor area. The building size is about 30 ft. x 40 ft. or 1200 sq. ft. the future bay would add to the building size.) The Planning Department suggests that the Commission recommend tho! the City Council waive the parking requirements and permit 3 spaces as shown. The Commission should also note that the 3 parking spaces and trash area is proposed to also be used as a future bay which would eliminate these.spaces and the trash area from the location shown. If the Commission approves the plot planas submitted and authorize the future bay some consideration should be given to requiring the Company, at the time of expansion to submit for Commission approval plans showing where and how the trash area and parking areas will be replaced. Signs. T ota I Perm i tted Sign Area 240 sq. ft. The plans are not definitive enough to determine the size.and exact location of all of the proposed signs. The Planning Department recommends that the signs proposed on the building comply with regulations. In addition, the free standing sign proposed at the intersection should not exceed 25 ft. in height, should not rotate, should not exceed 100 sq. ft., and should not project over the public right-'of-way. -2 - . . . . . C.U.P.66-14 Aug. 9, 1966 Page Three Londscaping Planteris/ands 5 ft. in width are required in front ofthe pump islands between driveways. In both cases only 3 ft. wide planters are proposed. It appears as though the planter proposed on Baldwin Avenue could easily be widened t05 ft. while the one on Duarte Road is fairly restricted because of insufficient space between the buildings, pump islands and proposed property line. The Planning Department would recommend waiving the 5 ft. planter width requirement only on the Duarte Road side. The planting area along the north property line complies with the ,regulations. However, the planter along the west property line does not. The regulations call for it to extend to the building. It is suggested that this regulation not be waived. Only 90 square feet of planting area is proposed at the intersection. The code calls for 150 square feet. It appears that this area could be enlarged to meet the code without interferring with the operation of the site. The Planning Department recommends that this section of the Code not be waived and the area of the planter incr.eased. Twenty square feet of planting areas are shown along the southside of the building and about 7 square feet along the east side. The Code requires 30 square feet along the building facades fronting the street. There appears to be ample space on both sides of the building to comply with the code. The Planning Deportment recommends compliance. The Code requires thot the planting areas be services by a permanent irrigation system. Such a system is not shown on the plans. Compliance is recommended. Utilities (telephone and power) are required to be underground. The plans do not indicate how these services are proposed. The Department recommends compliance. SUMMARY The shape of the site and the fact that approximately 25% of it will be dedicated for street purposes greatly reduces the versatility of site design. However, even within this restricted framework it appears that a new station can be constructed which would be on asset to the property and to the area. . The Planning Department recommends that the application be approved, subject to the compliance with regulations governing drive-in-businesses, except for the following conditions which the Deportment suggests may be recommended by the Commission to the City Council for waiver: 1. Waive the parking requirements of Zone C-2 and permit the parking as shown on the plan. -3- .. . . C. U. P.66-14 Aug. 9, 1966 Page Fou r 2. Waive the planter size on Duarte Road, permitting a 3 foot wide planter rather than one 5 ft. wide. In addition, Ihe Planning Department recommends: L That prior to the time the future bay is added thai preliminary plans showing the addition and how and where the required parking and trash areas are to be provided shall be submitted to the Planning Commission for approval. 2. Dedicate 20 feet for Baldwin Avenue, 10 feet for Duarte Road and a 15 foot radius PL corner cut off (dedication has been made - D-1532) . 3. Submit grading and drainage plan for approval of Deportment of Public Works. . 4. Install 011 utilities underground. 5. All surface drainage shall be picked up by catch basins and pipe to gutter or existing catch basins. 6.. Existing curb and gutter, sidewalks and driveway aprons to remain, and where necessary be repaired to the satisfaction of the Department of Public Works.
