GRANTING A CONDITIONAL USE PERMIT UPON SPECIFIED CONDITIONS FOR THE EXPANSION OF AN EXISTING SERVICE STATION BUILDING ON PROPERTY LOCATED AT 11 EAST LIVE OAK AVENUE IN SAID CITY AND RECOMMENDING THE WAIVER OF CERTAIN MUNICIPAL REQUIREMENTS. WHEREAS. there was filed with this Commission on the 14th day of June, 1966, the application of Union Oil Company. as optionee, for a conditional use permit for the expansion of an existing service station on property known as 11 East Live Oak Avenue in the City of Arcadia, County of Los Angeles. State of California, more specifically described as follows': . Those portions of Lots 6 and 7, Tract No. 11438, per map recorded ih Book 234, Page 22, of Maps, reCOrds of said County, described as follows: Beginning at the southeasterly terminus of that certain curve in the southwesterly line of said Lot 7. having a radius of 15 feet; thence North 80009'1511 East 107.46 feet; thence North 0055'25" West parallel to the westerly line of said Lots 6 and 7, a distance of 125.00 feet; thence South 80009'15" Wes,t parallel to the southerly line of said Lot 7, a distance of 125.00 feet to a point in the wes~erly line of said, Lot 6; thence South 0055'25" East along the westerly line of Lots 6 and 7, a distance of 107.46 feet to the beginning of a curve concave northeasterly and having a radius of 15 feet; thence southeasterly along said curve 25.90 feet to the point of beginning; and, WHEREAS, a public hearing was duly held on said matter by and before this Commission on the 28th day of June. 1966, at which 4It time all interested persons were given full opportunity to be heard and to present evidence,; NOW. THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, HEREBY DETERMINES AND RESOLVES' AS FOLLOWS: -1- 594 v . . . . . SECTION 1. That subject property is in Zone C-l. The prop- erty to the south and west is in Zone C-2; to the east :l:n Zone C-l and C-O; and to the north in Zone PR-3 and PR-l. That the location and zoning of the station are proper under the terms of the conditional use permit. That the property is commercially zoned and does not in- terrupt or pose a danger to pedestrian traffic in the commercial area. Its location at the intersection affords ease of ingress and egress and there is sufficient area on the site to provide adequate space for parking. That the property abuts Live Oak Avenue and Santa Anita Avenue, streets that are adequate in width and pavement type to carry the kind of traffic generated by the proposed use. That the granting of such conditional use permit will not adversely affect the compre- hensive general plan. SECTION 2. That for the foregoing reasons, this Commission hereby grants a conditonal use permi,t for the expansion of an existing service station on the above-described property subject to compliance with all applicable regulations of the Arcadia Municipal Code, inclu- ding those specified for drive-in businesses and for businesses in Zone C-l, except such portions of Title 4 of Division 5 of Part7 of Chapter 2 of Article IX thereof as may be waived by the City Council, and upon the following additional conditions: 1. The site drainage shall be handled in a manner so that nuisance drainage is intercepted and conveyed under the sidewalk, through the curb, and into the street, per City Standard No. 148. 2. Full parkway width concrete sidewalk shall be construc- ted on the balance of the frontage of Lot 6 on Santa Anita Avenue. 3. Final plans in substantial compliance with approved preliminary plans shall be submitted to and be approved by the Plan- ning Department. -2- 594 . ,. .. . . . SECTION 3. This Commission further recommends to the Arcadia City Council that Sections 9275.4.9, Paragraphs 1 and 4 of Section 9275.4.11, and 9275.4.16 of the Arcadia Municipal Code be waived, for the reason that the strict adherence to said Sec- tions would be inappropriate or inapplicable to the intended use of the property in view of its proposed expansion. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Planning Commission held on the 28th day of June, '1966, by the following vote: . The free standing sign exceeds the 25 ft. height limit by II feet (36 ft. high). 2. The free standing sign projects over publ ic right of way approximately 3 ft. which is not permitted. 3. The free standing sign is proposed to revolve, which is not permitted. 4. A 6 ft. wall is required where site adjoins on R- zone - none is proposed (This is PR...3 Zone, however, and is used for parking. A wall in this location is not necessary). 5. Landscaping adjacent to pump islands as required is not proposed (The existing improvement would make this difficult to comply with) 6. PI~ntelli along interior property lines do not extend to the building setback line os required. 7. Landscaping along the building facades does not comply. (The existing development would make compliance difficult.) 8. Restraom screening os required is not proposed. 9. Outside storage shown on the plot plan includes 0 tire display cabinet, a soft drink dispenser and oil dispenselli on the pump islands. 10. At present there are some trailers parked on the site. This is not permitted by th/i! ordinance. RECOMMENDA TIONS The Planning Department recommends approval of the expansion ,of the station, subject to the compliance with the regulations for drive-in businesses, Zone C-l and the Arcadia Municipal Code. Other conditions of approval sholl be: 1. Final plans in substantial compliance with approved preliminary plans sholl be submitted to and be approved by the Planning Deportment. Under Section 9275.5, however, requirements may be waived where they ore inappropriate or inapplicable to the intended use of the property or to the property itselF. The Planning Deportment would recommend the following sections of the regulations be waived. 1. Section 9273.4.9 Fire Resistant WaU. This section should be waived as inappropriate. The PR-3 property to the north is used for parking purposes. 2. Port of Section 9275.4.11, landscaping should be waived os inappropriate. The pump islands as installed and existing improvements do not provide sufficient width to allow the required planting strip. 3. Port 4, Section 9275.4.11 be waived as inappropriate. Present design and con- struction do not provide on adequate placement of such ,planting areas. 4. Section 9275.4.16. Storage and Displays be waived in part to permit oil display cabinets on the pump islands and the soft drink dispenser in on enclosure approved by the Planning Department. NOTE. The above waiver does not exempt the applicant from fulfilling the remaining code requirements, including signs, landscaping, and ather specified building and zoning regulations.
