' ~ ~J..i;l:S:.n~rJ A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE DENIAL OF A ZONE VARIANCE TO PERMIT THE CONSTRUCTION OF A DRIVE-IN RESTAURANT WITH OUTDOOR EATING FACILITIES AT 147 EAST DUARTE ROAD IN SAID CITY. WHEREAS, there was filed with this Commission on the 4th day of May, 1966, the application of Harold B. Jepson as Optionee for a zone variance to permit the construction of a drive~in res- taurant with outdoor eating facilities on property located at 147 East Duarte Road in the City of Arcadia, County of Los Angeles, State of California, more specifically described as follows: All of Lot 17 and the westerly 23 feet of Lot 18 in Block 62 of Arcadia Santa Anita Tract per map recorded in Book i6, page 58" of Miscellaneous Records in the office of the County Recorder of said County, together with the southerly one-half of the alley vacated by Arcadia City Ordinance No. 661 adjacent to said land; , EXCEPT the interest in the northerly 20 feet and the southerly 12 feet of said land as conveyed to the City of Arcadia for street, alley and highway purposes, by deed recorded in Book 48339, page 132, Official Records; and, WHEREAS, after notice duly given as required by the Zoning Ordinance, a public hearing was duly held on the matter by and before this Commission on May 24, 1966, at which time all interested persons were given a 'full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. That subject property is in Zone C-l which permits only restaurants where all customers are served at a table or counter. That there are no exceptional or extraordinary circum- stances or conditionsapplicab1e to the property or to the intended use thereof that do not apply generally to the property or class -1- 591 v' - . . . of use in the same zone or vicinity. That the traffic and incidental problems of operation of this type of use have been found to be inap- propriate for C-l zoning and therefore the granting of the requested variance will be materially detrimental to the public health or wel- fa:t'e and injurious to the property and improvements in such zone or vicinity. That there are no other facilities of this type in Zone C-1 and the granting of said variance would grant an additional right which is not possessed by other property in the same zone and vicinity. That the granting of the requested variance would adversely affect the comprehensive general plan. SECTION 2. That for the foregoing reasons, this Commission he~eby recommends to the City Council of the City of Arcadia that a . va:t'iance to permit the construction of a drive-in restaurant with outdoor eating facilities on the above-described property be denied. SECTION 3. The Secretary shall certify to the adoption of this resolution and shall cause a copy hereof to be forwarded to the City Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Planning Commission held on the 28th day of June , 1966, by the following vote: AYES: Commissioners Ferguson, G011sch, Hanson, Lauber and Kuyper NOES: None ABSENT : ABSTAINING: Commissioner Parker Commissioner Norton . JEPSEN, OPTIONEE, of real property located within the City of Arcadia, California, and hereinafter described, has filed with the Planning Commission of the City of Arcadia, a Variance application, The subject property is located at 147 East Duarte Rood. The legal description of the property is: . NOW, THEREFORE, NOTICE IS HEREBY GIVEN that on Tuesday, May 24, 1966, at the hour of 8:00 o'clock p.m., in the Council Chamber of the City Hall, 240 West Huntington Drive, Arcadia, California, the Planning Commission will hold a publ ic hearing on the request. TO: FROM: APPLICATION . · V ~ MAY 24, 1966 PLANNING COMMISSION PLANNING DEPARTMENT SUBJECT: VARIANCE APPLICATION V-66-S 147 EAST DUARTE ROAD ZONE C-l OUTDOOR EATING AND DRIVE~IN RESTAURANT The application filed in the name of Harold B. Jepson for the purpose of constructing a drive-in restaurant with outdoor eating facilities. SUBJECT'PROPOSAL . ANALYSIS The 'proposed building would be located on the property'known as 147 East Duarte Road. This property, as is the property to the east, west and south, is in Zone C-l. C-l zoning permits, only restaurants where all customers are served at a table or counter. Therefore, to allow a use of the type proposed, a variance is required. The plot plan of this development is attached. Before a variance may he granted, four conditions must be, satisfied, FIRST, there should be exceptional or extraordinary circumstances or conditions applicable to the property involved, or to the intended use of the property, that do not apply generally to the property or class of use in the same zone or vicinity. This property daes not meet this condition since it is not unlike the other C-l properties in the same zane and vicinity. The Staff can find no exceptional, extraordinary circumstartces or conditions that are applicable to this praperty that would differentiate it from any other C-l property in the City, THE SECOND condition to be satisfied is the granting of such variance will not b,a materially detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. It has long been the desire of the Planning Commission and the City Council to prevent uses of this type from being located in Zone C-l. The traffic and incidental problems of operatian of this type of use have not been judged as appropriate ,for the C-l category. . . " V-66-S Page Two . . A THIRD condition to be ,satis,fied is that such variance is necessary for the preservation and enjoyment of a substantial pr9perty right of the applicant possessed by other property in the same zone and vicinity. This condition has not been satisfied. There are na other facilities of this type in Zone C-l, therefor.e, ,the"applicant would be granted an , ,additional right which would not .be possessed by other praperty in the same zone and vicinity. THE FINAL condition to be satisfied is .that the,granting af such variance will not adversely affect the comprehensive general plan. In the case of the subject application, the granting of a variance in Zone C-l would produce a major policy change which could adversely affect the general planning of the Community. RECOMMENDATION Because the application does not meet all the requirements of a variance, the Staff recommends that the application be denied.
