NOTICE IS HEREBY GIVEN that the City Council will hold a public hearing and consider the Planning Commission’s recommendation on the following project:
A. Pursuant to the provisions of the California Environmental Quality Act (CEQA), the City has prepared an Environmental Impact Report (EIR) for the proposed Derby Mixed -Use Development. The Draft EIR analyzed all the potential environmental effects of the proposed Project, identified ways to reduce significant environmental effects, and analyzed feasible alternati ves to avoid or minimize significant effects. The DEIR was circulated for public review from August 4, 2023 to September 19, 2023. The FEIR is available for public review
B. Derby Mixed-Use Development – Ordinance No. 2398 – Zone Change 22-01 and Height Overlay H7, Resolution No. 7530 – Certifying the FEIR, Resolution No. 7531 – General Plan Amendment No. 22-02, and Resolution No. 7532 – Minor Use Permit No. 22-02, Architectural Design Review No. ADR 22-06 with a Density Bonus and Lot Line Adjustment.
Project Description: A request to change the General Plan land use designation from Commercial to Downtown Mixed Use
and rezone the properties from General Commercial (C-G) to Downtown Mixed Use with a Height Overlay of H7 (up to 75’
feet) with a lot line adjustment to accommodate a new mixed -use development that will be six-stories tall with five stories of
residential units (205 for-rent units and 9 affordable units). A portion of the development will be above ground floor
commercial space that will consist of a 3,300 square foot restaurant and 1,400 square feet of café space. The proposal also
includes the demolition of the Derby and former Souplantation restaurants and the construction of a new Derby restaurant
that will be substantially larger with a rooftop restaurant on the same site facing Huntington Drive. The new Derby restauran t
will include many of the existing interior and exterior details. The project would include one level of subterranean parking for
the residents, as well as ground level commercial and valet parking, a podium parking structure and surface parking lot for a
total of 412 parking spaces.
