Avoid the 100 DUI Campaign (East) - Los Angeles County
(PARTICIPATION AGREEMENT)
This Agreement for participating in the Avoid the 100 Los Angeles County DUI Task Force Project
(AL0984) is made and entered into this ± day of 'tI2<_ 2008, between the

Police Department.
RECITALS
A. The Glendora Police Department is a Grant Administrator for a countywide traffic safety
grant (hereafter the 'grant') entitled "Avoid the 100 DUI Campaign (Easy - Los
Angeles County" (hereafter 'Avoid the 100'). A copy of the Grant Agreement is attached
hereto as Exhibit A and made a part hereof. The Avoid Grant Program Manual is
referenced herein and made a part hereof. As the Grant Administrator, the Glendora
Police Department will provide a lieutenant (Grant Manager) to coordinate the grant,
provide a Community Services Officer (CSO) to administer the grant, and provide. an
account manager to handle the fiscal processing, including reimbursement to each of the
participating agencies for authorized overtime incurred as a result of enforcement
operations related to the grant.
B. The Avoid the 100 program provides for reimbursement to the Participating Agency for
personnel working overtime shift(s) to staff special enforcement operations as detailed in
the grant and scheduled and approved by the Grant Manager.
C. The Glendora Police Department has agreed to act as the Grant Administrator, and as
such will coordinate activities involving the contracted agencies to meet the goals and
objectives of the grant.
D. The Participating Agency is an agency participating in the Avoid the 100 grant program.
The Participating Agency hereby agrees to comply with the terms and conditions of the
Avoid the 100 grant, and to work with the Glendora Police Department as the grant
administrator as more specifically set forth in the grant, the Grant Program Manual, and
this agreement.
AGREEMENT
The Glendora Police Department and the City of 'Arcadia, a public entity. (the
Participating Agency) hereby agree as follows:
1. SCOPE OF OVERTIME SERVICES
The DUI Enforcement Nights:
The Participating Agency shall provide two Officers, or more, as staffing levels allow, and as
approved by the Grant Manager, for staffing DUI roving patrols and/or DUI checkpoints, as
scheduled by the Grant Manager, with.members of neighboring agencies in a locally designated
region for the primary purpose of identifying and arresting under the influence drivers. Each
region will be coordinated by a volunteering agency which shall additionally provide one Regional
Coordinator /Supervisor and one Communications Officer as approved by the Grant Manager.
Arrest Warrant Operations:
The Participating Agency shall provide two Officers, or more, as staffing levels allow, as approved
by the Grant Manager, for staffing DUI and Suspended License arrest warrant details.
Operations will be held In locally designated regions for the primary purpose of locating persons
with outstanding arrest warrants for DUI or Driving on a Suspended License. Each region will be
coordinated by a volunteering agency which shall additionally provide one Regional
Coordinator /Supervisor and one Communications Officer as approved by the Grant Manager.
2. SCOPE OF TRAFFIC COMMITTEE ACTIVITIES
The Participating Agency shall designate a representative to attend the POALAC Traffic
Committee meetings, which take place on the 2nd Wednesday of every other month, as
announced by the Grant Administrator. This representative will work with the Traffic Committee
In developing countywide traffic safety programs.
3. PERIOD OF PERFORMANCE
This agreement is to commence on October 1, 2008, and shall conclude on September 30, 2011
unless earlier terminated by either party with or without cause by giving at least thirty days written
notice to the respective party and specifying the effective date thereof '(or may be extended by
written mutual agreement of the parties).
4. FORCE MAJEURE
The Participating Agency shall not be in default by reason of any failure in the performance of this
Agreement in accordance with the terms, if such failure arises out of causes beyond the control
and without the fault or negligence of the Participating Agency. Such causes may include, but
are not restricted to, acts of God or a public enemy, acts of the government in its sovereign
capacity, strikes or freight embargoes, not withstanding that in every case the failure to perform
must be beyond the control and without the fault or negligence of the Participating Agency.
5. INDEMNIFICATION
Each party agrees to defend, indemnify and hold the other party, their elected officials, officers,
directors, employees, agents, and volunteers free and harmless against and from any and all
losses, claims, demands, actions or causes of actions, for damage to persons or property,
including wrongful death and attorneys' costs and expenses of suit, resulting from any cause
arising out of or pertaining to this Agreement, except to the extent caused by the negligent or
intentional ads of the indemnified party, its agents or employees.
6. GOVERNING LAW
This Agreement shall be interpreted and construed according to the laws of the State of
California. Venue shall be in Los Angeles County.
T. ENTIRE AGREEMENT
This Agreement contains the entire understanding between the Glendora Police Department and
the Participating Agency. Any prior agreements, promises, negotiations or representations to
expressly set forth herein are of no force or effect. Subsequent modifications to this Agreement
shall be effective only if in writing and signed by both parties.

8. ALLOWABLE COSTS AND PAYMENTS
A. Allowable Costs
The Participating Agency shall bill for overtime services rendered at the actual rate of the
employee working overtime and in no case will it exceed the maximum rate of $100.00
per hour. The Participating Agency shall be responsible for invoicing the City of Glendora
before any reimbursement is made for the overtime services of officers and/or other
personnel
The Participating Agency shall maintain complete and accurate records with respect to all
the services rendered under this Agreement. All such records shall be clearly
identifiable.
B. - Payments
Payments to the Participating Agency for services rendered under the terms of this
Agreement shall be limited to the actual amount of compensation for overtime services.
Payments to the Participating Agency for the services rendered will be made by the City
of Glendora within forty-five (45) days of receipt of complete and accurate invoices
submitted'by the Participating Agency, or in the event of any question or discrepancy, the
Grant Administrator shall provide the Participating Agency with a written statement
objecting to the charges within thirty (30) days of the receipt of invoice.
C. Invoice Requirements
Invoices shall include the date of services, officer's name, officer's overtime salary rate
with allowable benefits, number of hours worked, and total amount requested for
overtime reimbursement. Invoices shall be received by the Grant Administrator no later
than forty -five (45) days after the date services were rendered or more than forty-five (45)
days after this Memorandum of Understanding terminates, whichever is earlier.
8. ON TICES
Formal notices, communications, and demands for payment shall be made in writing and faxed to
the Grant Administrator.

Notice shall be deemed received as follows, depending upon the method of transmittal: by facsimile, as of
the date and time sent; by messenger, as of the date delivered; and by U.S. mail, certified, return receipt
requested, as of 72 hours after deposit of the U.S. Mail.

10. COOPERATIONS: FURTHER ACTS
The Parties shall fully cooperate with one another, and shall take any additional acts or sign any
additional documents as may be necessary or appropriate to attain purposes of this Agreement.
11. ATTORNEY'S FEES
In the event of any action or proceeding brought by either party against the other under this
Agreement, the prevailing party shall be entitled to recover for the fees of its attorneys in such
action or proceeding, including costs of appeal, if any, in such amount as the court may adjudge
reasonable as attorney's fees.
12. PARTIAL INVALIDITY
Any provision of this Agreement which shall prove to be invalid, void, or illegal shall in no way
affect, impair or invalidate any other provision thereof and such other provision shall remain in full
force and effect.
IN WITNESS WHEREOF, the City of Arcadia, a public entity, and the
Glendora Police Department have caused this Agreement to be executed and attested by their
respective officers duly authorized as of the date set forth above.

5. PROJECT DESCRIPTION
The Glendora Police Department will serve as the host agency for a Regional DUI effort in Los Angeles County to
reduce alcohol - involved fatalities and injuries and raise general public awareness regarding the problems associated
with drinking and driving. Participating agencies include Police Departments from the cities of Alhambra, Arcadia,
Azusa, Baldwin Parks, Bell Gardens, Burbank, Claremont, Covina, Downey, El Monte Glendale, Glendora,
Irwindale, La Verne, Monrovia, Montebello, Monterey Park, Pasadena, Pomona, San Fernando, San Gabriel, San
Marino, Sierra Madre, South Pasadena, West Covina, Whittier, Community College Police, School Campus Police,
Cal State University Police, Los Angeles Police Department, Los Angeles County Sheriffs and Probations
Department, ABC and the California Highway Patrol. Activities will include DUI checkpoints, DUI saturation
patrols, DUI Task Force Operations and Warrant/Probations operations for repeat DUI offenders during the
Memorial Day, Fourth of July, August -Labor Day Mobilization, Winter Holiday Mobilization, and designated
special events with identified DUI problems.
6. FEDERAL FUNDS ALLOCATED UNDER THIS AGREEMENT SHALL NOT EXCEED: S 1,561,551.00

PROBLEM STATEMENT
Though significant progress has been made in reducing the frequency of driving under the influence (DUI) and
related injuries and fatalities, alcohol remains the number one Primary Collision Factor (PCF) in fatal crashes.
In 2007, Statewide Integrated Traffic Records System (SWITRS) provisional data shows 32,133 people were
killed and injured in alcohol - involved crashes reflecting a 1.7 percent decrease from 2006. DUI incidents are
typically at their highest during the winter holiday period (Christmas and New Years), Memorial Day,
Independence Day and Labor Day weekends. Other high incident periods include Halloween, Super Bowl
Sunday, Cinco de Mayo and local festivals/events with identified DUI problems.
The Los Angeles County statistics shown below indicate persons killed and injured in alcohol: involved
collisions during these campaign periods.

PROJECT GOALS
The overall goal of the project is to enable Los Angeles County law enforcement agencies to publicize the
combined DUI efforts of all law enforcement agencies in Los Angeles County and to raise general public
awareness regarding the problems associated with drinking and driving.
To reduce the calendar year 2007 base number of persons killed in alcohol - involved collisions each
holiday enforcement period:
a. Winter Holiday Mobilization to lower /maintain from 18 to 16 during mid - December 2008 to
January 1, 2009; mid- December 2009 to January 1, 2010; and mid- December 2010 to January 1,
2011.
.b. Memorial Day holiday weekend to lower /maintain from 3 to 2 during the period of May, 2009;
May 2010; and May 2011.
c. Fourth of July holiday weekend to lower /maintain from 5 to 4 during the period of July 2009;
July 2010; and July 2011.
d. Labor Day holiday Mobilization to lower /maintain from16 to 14 during the period of mid -
August- September 2009; mid- August- September 2010; and mid- August - September 2011.
2. To reduce the calendar year 2007 base number of persons injured in alcohol - involved collisions each
holiday enforcement period:
a. Winter Holiday mobilization to lower from 411 to 370 during mid - December 2008 to January 1,
2009; mid- December 2009 to January 1, 2010; and mid- December 2010 to January 1, 2011.

b. Memorial Day holiday weekend to lower from 143 to 129 during the period of May, 2009, May
2010; and May 2011.
c. Fourth of July holiday weekend to lower from 80 to 72 during the period of July 2009; July
2010; and July 2011.
d. Labor Day holiday Mobilization to lower from 424 to 382 during the period of mid- August-
September 2009; mid- August- September 2010; and mid- August - September 2011.
3. To reduce the number of persons killed in alcohol - involved collisions 10% from the calendar 2007
base year total of 290 to 261 by September 30, 2011.
4. To reduce the number of persons injured in alcohol - involved collisions 10% from the calendar 2007
base year total of 7,729 to 6956 by September 30, 2011.
PROJECT OBJECTIVES
1. To ensure that a minimum 50% of sworn police department personnel conducting DUI enforcement
with grant funding have received NHTSA- CERTIFIED (POST) Standardized Field Sobriety Testing
(SFST) training by September 30, 2009.
2. To conduct a minimum of 48 DUI/DL checkpoints (16 per year - 4 regions, 4 checkpoints) as follows:
a. 4 during each Winter Holiday Mobilization during mid - December, 2008 to January 1, 2009, mid -
December, 2009 to January 1, 2010, mid - December, and 2010 to January 1, 2011.
b. 4 during each Cinco de Mayo weekend during May 2009, May 2010, and May 2011.
c. 4 during each Independence Day holiday weekend during July, 2009, July, 2010, and July, 2011.
d. 4 during each Summer Mobilization of mid August through the Labor Day weekend of 2009,
2010, and 2011.
Note: For combination DUI/DL checkpoints, departments must issue press releases that mention D/L's will be checked at
the DUUDL checkpoint. Also, according to the Attorney General's Office all DUUDL checkpoint operations must have
signs reading "DUUDriver's License Checkpoint Ahead."
To maximize effectiveness, it may be necessary to conduct a checkpoint operation at more than one location on any given
day /night. Each checkpoint should be highly publicized and visible. No occupant restraint citations will be issued at the
checkpoints. OTS does not fund or support independent DL checkpoints. Only on an exception basis and with OTS
pre - approval will OTS fund checkpoint operations that begin prior to 18M hours.
3. To conduct 112 DUI saturation patrols (4 patrols per year x 4 regions x 7 2- officer patrol cars =112),
by September 30, 2009, an additional 112 patrols by September 30, 2010, and an additional 112 patrols
by September 20 2011
a. 28 during each Winter Holiday Mobilization during December, 2008 to January 1, 2009;
December, 2009 to January 1, 2010; December, and 2010 to January 1, 2011.
b. 28 during each Memorial Day 4 -day holiday weekend during May 2009; May 2010; and May
2011.
c. 14 during each Independence Day holiday weekend of July, 2009; July, 2010; and July, 2011.
d. 14 during Other Special events for example: -St Patrick's Day or a community event such as the
County Fair.

e. 28 during each Summer Mobilization of the August/September Labor Day weekend
August/September, 2009; August/September, 2010; and August/September 2011.
4. To Conduct I Multi- Agency DUI Task Force Operation during each Halloween of 2008, 2009 and
2010, 2 Multi- Agency DUI Task Force Operation during the Super Bowl Sunday period of 2009, 2010
and 2011 and 1 Multi- Agency DUI Task Force Operation during a City Festival in 2009, 2010 and
2011
To Conduct a total of 12 Warrant Service Operations as follows:
a. 6 Warrant Service Operations (1 operation per year x 2 regions x 3 years) targeting repeat DUI
offenders who fail to appear in court or who violate probation during the Winter Mobilization
Periods of 2008, 2009, and 2010; and,
b. 6 Warrant Service Operations (I operation per year x 2 regions x 3 years) during the Summer
Mobilization of 2009, 2010 and 2011.
6. Following each of the above NHSTA Holiday Mobilization Campaigns, data required for the Schedule
C will be captured from all DUI grant activities and the NHTTA Mobilization Data shall be forwarded
via fax or email to the OTS Avoid Coordinator for reporting to NHSTA and their National Mobilization
campaign reporting.
7. To increase the calendar 2007 base year DUI arrests by 2% each holiday enforcement period:
a. Memorial Day 4 day holiday weekend from 832 to 848 during May 2009; 848 to 865 during
May 2010; and 865 to 882 during May 2011.
b. Independence Day holiday 4 day weekend from 904 to 922 during the period of July 2009; 922
to 940 during July 2010; and 940 to 958 during July 2011.
c. Summer Mobilization -Labor Day holiday mobilization from 2990 to 3140 during the period of
Mid - August through Labor Day, 2009; 3140 to 3297 during Mid - August through Labor Day,
2010; and 3297 to 3462 during Mid- August through Labor Day, 2011.
d. Winter Holiday Mobilization from 3348 to 3414 during Mid- December, 2008 through January 1,
2009; 3414 to 3482 during Mid- December 2009 through January 1, 2010; and 3482 to 3550
during Mid - December 2010 through January 1, 2011.
e. Other Special events i.e.: Super Bowl Sunday, St. Patrick's Day, Cinco de Mayo, Halloween
weekend or other special community events with identified DUI issues such as the county fair,
etc. and to increase annual DUI arrests countywide from 55,787 to 56,902 by September 30,
2011.
8. To conduct an annual DUI Seminar and awards presentation to disseminate DUI information and
enforcement strategies to enforcement agencies by December 31 of each grant year.
Note: Nothing in this agreement shall be interpreted as a requirement, formal or informal, that a particular
police officer issue a specified or predetermined number of citations in pursuance of the goals and objectives
hereunder.
MEDIA OBJECTIVES
1. To issue a press release announcing the kick -off of the project by October 31, 2008. All Grant related
press releases and media advisories, alerts, and materials must be forwarded to your OTS Regional

Coordinator and the OTS Public Information Officer at pio a ots.ca.aov for approval 14 days prior to
the issuance date of the release.
2. To conduct "Avoid the 100" public information campaigns during the periods of
a. May, 2009; May, 2010 and May 2011.
b. Independence Day holiday period July 2009, July 2010, and July 2011.
c. August/Labor Day Mobilization Period, 2009; 2010; and 2011.
d. December, 2008 to January 1, 2009; December, 2009 to January 1, 2010; and December 2010, to
January 1, 2011.
e. To collect all countywide DUI arrest / DUI collision data and report daily during each campaign
period via www Californiaavoid.= website.
3. To prepare complete press information for your allied agencies and for broadcast reporters during each
campaign period including a main press release, campaign calendar, departmental plans and fact sheet.
The material will emphasize the campaign's serious, aggressive enforcement and the high cost of DUI in
terms of money, criminal consequences and human misery. The information for each campaign period
will be completed by December 1; May 15; June 15 and August 1, of each grant year.
4. To conduct a press conference or media event for each campaign period in cooperation with all other
regional Avoid projects for the NHTSA Mobilization by Maid- December 2008, 2009, 2010 and opening
press conference or media event for each campaign period in cooperation with all other regional Avoid
projects for the NHTSA Mobilization by Mid- August, 2009, 2010, 2011. The press releases and media
advisories, alerts, and materials must be forwarded to your OTS Regional Coordinator and the OTS
Public Information Officer at pio @ots ca.gov for approval 14 days prior to the issuance date of the
release.
5. To conduct an intensive news bureau media effort, including daily reporting of statistics on DUI arrests,
injuries and deaths to the list of major local newspaper(s) TV and Radio. The news bureau will report
statistics every morning before 11 a.m. during the periods of:
a. Memorial Day Weekend May, 2009; May, 2010; and May, 2011.
b. Independence Day Weekend July 2009; July 2010; and July 2011
c. August Mobilization/Labor Day Weekend, 2009; 2010; and 2011.
d. Winter Mobilization Mid- December, 2008 to January 1, 2009; Mid- December; 2009 to January
1, 2010; and Mid- December 2010 to January 1, 2011.
e. To collect all countywide DUI arrest and collision data and report daily during each campaign
period via www Californiaavoid.ora website.
6. To issue at least eight Winter Holiday Mobilization news stories via email or fax to daily and weekly
newspapers, to radio and television, to wire services and to the Office of Traffic Safety each project year
by January 1, 2009, January 1, 2010 and January 1, 2011.
7. To issue at least eight Summer/Labor Day Holiday Mobilization news stories via email or fax to daily
and weekly newspapers, to radio and television, to wire services and to the Office of Traffic Safety each
project year by August 1, 2009, August 1, 2010, and August 1, 2011.
8. During each campaign period of each project year, to place at least:

a. Four newspaper stories, 2 radio and 2 television stories during the Memorial Day Holiday during
May 2009; May 2010; and May, 2011.
b. Four newspaper stories, 2 radio and 2 television stories during the Independence Day Holiday
during July, 2009; July, 2010; and July, 2011.
9. Where applicable, County Avoid programs will partner in the Regional Avoid media campaigns in the
major media markets to maximize the overall goals of the Avoid Grants — Enforcement and
Community Awareness. To collect all countywide DUI arrest and DUI collision data and report daily
to the media during each campaign period via www.Californiaavoid.ore website
10. To use the following standard language in all press, media, and printed materials: "Funding for this
program was provided by a grant from the California Office of Traffic Safety, through the National
kghway Traffic SafetyA&dnistrad6n"
METHOD OF PROCEDURE
Phase 1— Program Preparation (October 1, 2008 — October 31, 2008)
Develop a memorandum of Understanding (MOU) with each participating agency that details enforcement
activities to be conducted and personnel, number of hours required, and rate of compensation for each position.
To form an "Avoid Committee" comprised of representatives of all agencies participating in the program by
November 1' of each project year.
To collaborate with Alcoholic Beverage Control, District Attorney's Offices, and community based
organizations to gain program support.
To hold the first Avoid the 100 Regional Coordinator Committee by November 30, of each project year (By
November 1 st during initial preparation — 2009). The Regional Coordinator Committee shall be comprised of
at least four-members representing local, county and state law enforcement. The committee will create and
coordinate all enforcement operational plans.
To gain commitment from law enforcement executives in the county annually on the campaign and to
encourage them to emphasize DUI enforcement during all phases with officers on regular patrols and by
allocating overtime hours to extra units, participating in forming special teams and in conducting DUI
checkpoints, and contributing to all public information elements of the campaign.
To develop an Enforcement Operational Plan for each phase of the campaign by:
• May 1, of each project year.
• June 1, of each project year.
• August 1, of each project year.
• December 1, of each project year.
Note: The Regional Coordinator committee will develop the Operational Plans with final approvals given by
the committee.
SCHEDULE A
To assign by December 1 st each year, a Public Information Officer (PIO) from one of the involved agencies to
perform all program coordination and public information functions in relation to the project (by November I st
during initial preparation — 2008). To develop, purchase, and/or order campaign materials for distribution.
Phase 2 — Program Operations (October 1, 2008 — September 30, 2011)
Schedule and conduct enforcement and public information campaigns for each campaign period according to
the Operational Plan.
Phase 3 — Data Gathering & Reporting (Throughout Project Period)
Agencies are required to collect and report quarterly, appropriate data that support each of the goals and
objectives progress.
To collect all countywide DUI arrest and DUI collision data and report daily during each campaign period via
www Califbmiaavoid.ora website.
To measure the grant's impact on crime by tracking non- traffic-related arrests that initiate from DUI
checkpoints and/or other grant supported activities or operations. Some of the crime statistics to be collected
include narcotic arrests, confiscated weapons, stolen vehicles recovered, criminal misdemeanor arrests, criminal
felony arrests, and misdemeanor /felony warrant arrests.
Statistical data relating to the project goals and objectives will be collected, analyzed, and incorporated in
Quarterly Performance Reports (QPRs). QPRs for the quarter ending September 30 will include year to date
comparisons of goals and objectives. The Quarterly Evaluation Data Form, Schedule C, will be completed each
quarter and submitted as part of the QPR.
These reports will compare actual project accomplishments with the planned accomplishments. They will
include information concerning changes made by the project Director in planning and guiding the project
efforts.
Reports shall be completed in accordance with OTS requirements specified in the Grant Program Manual,
Chapter 7, and submitted in compliance with the signed Acceptance of Conditions and Certifications (OTS -33)
included within this agreement. '
METHOD OF EVALUATION
Using the data compiled in Phase 3, the project manager will evaluate: (1) how well the stated project goals and
objectives were accomplished, (2) if all the activities outlined in the "Method of Procedure" were performed in
accordance with the project agreement; and (3) was the project cost effective?
ADMINISTRATIVE SUPPORT
This program has full support of the City of Glendora Every effort will be made to continue the activities after
the project conclusion. The City Council of Glendora has endorsed this grant by resolution

Avoid the 100 - Campaign EAST
Project Objectives:
The East County Task Force is divided up into four smaller regions consisting of
between 5 and 7 cities each. Each region will have a Regional Coordinator
appointed by the Grant Manager. The Regional Coordinator will be responsible for
coordinating the following events in their region:
1. It is requested (not required) that 50% of personnel conducting DUI enforcement
with grant funding should have received NHTSA- Certified (POST) Standardized
Field. Sobriety Testing (SFST) training (Academy SFST training qualifies).
2. Each region will coordinate 4 checkpoints per year: One each during the Winter
Holiday, Cinco de Mayo weekend, 4th of July Weekend and the Labor Day
Holiday period.
3. Each region will coordinate 4 saturation patrol nights per year. One each during
the Winter Holiday, Memorial Day weekend, 0 of July Weekend and St.
Patrick's Day or other event.
4. Two of the four regions shall conduct Warrant Service operations per year.
5. Additional multi- agency DUI Task Force Operations will be available to your
cities for any type of event which typically involves the consumption of alcohol
i.e. city events, festivals, fairs, sporting events or other holidays including
Halloween and Super Bowl. Contact the Grant Administrator, CSO Wendy Soos
to organize additional DUI assistance in your city.
* *Participation for each deployment is not mandatory. Should
any agency be unable to supply officers on overtime due to
staffing restraints, the positions may be backfilled by other
agencies up to the maximum of two per agency.
