MEMORANDUM OF UNDERSTANDING
BETWEEN THE CITY OF ARCADIA AND THE CITY OF SAN GABRIEL
FOR FIREARMS RANGE USE AT THE ARCADIA POLICE DEPARTMENT
This Memorandum of Understanding (MOU) between the City of Arcadia, a public entity
and the City of San Gabriel, a public entity, establishes policy and procedures for use,
training, and safety at the Arcadia Police Firearms Range.
PURPOSE
The San Gabriel Police Department (SGPD) firearms training range is not rated to
handle rifle ammunition. The SGPD must maintain firearms proficiency for rifle
deployment with its officers, and, to accomplish that goal, desires to use the firearms
training range of the Arcadia Police Department (APD).
POLICY
All personnel using the APD firearms range shall adhere to the APD Firearms Safety
Policy (copy attached).
SGPD will be responsible for providing a certified Rangemaster for all their department -
based training sessions that take place in the Arcadia Police Firearms Range. APD will
be responsible for staffing a Force Training Unit (FTU) member to manage the facility
whenever SGPD is conducting firearms training on the Arcadia Police Firearms Range.
The APD FTU member reserves the right to stop and /or shut down the training, if, at
any time, he /she perceives a safety violation has occurred and /or potential damage to
the range is imminent.
SGPD will be responsible for payment on anything their personnel damage in the
Firearms Range, Cleaning Room, and /or Training Room, outside of those items
damaged as a result of normal "wear- and - tear ".
SGPD will be responsible for providing their own targets and ammunition for their
department -based training on the Firearms Range. As part of this MOU, APD agrees to
provide SGPD "shelf space ", in the Firearms Range Cleaning Room, to store paper
targets. APD also agrees to provide SGPD lockable "cabinet space ", in the Firearms
Range Operations Room, to store ammunition.
SGPD agrees to comply with the General Management Procedures, a copy of which is
attached hereto and incorporated herein by reference.
FEES FOR FIREARMS RANGE USE
The City of San Gabriel will be charged and shall pay $120.00 (One Hundred Twenty
Dollars) for each day it uses the Firearms Range and Cleaning Room. This fee includes
the use of the Firearms Training Room, as needed, adjacent to the Firearms Range.
Additionally, the City of San Gabriel will be charged and shall pay $80.00 (Eighty
Dollars) per hour, or portion thereof, for the APD FTU member assigned to manage the
Firearms Range during their training sessions. Hourly rates for APD FTU members will
include one additional hour at the end of training sessions for maintenance and cleanup.
Remittance of the aforementioned range fees is payable within 30 days after receipt of
invoice.
TERM
The term of this Memorandum of Understanding shall commence on the date of
execution by the last party to do so, and shall end on June 30, 2010.
REVIEW AND RENEWAL OF AGREEMENT
This Memorandum of Understanding is subject to annual review for the purposes of
setting range use fees and for modifying any condition of use.
If no changes are made with regard to fees or conditions of use, the Memorandum of
Understanding shall be extended in writing each subsequent fiscal year, until either city
requests modification or termination of the Memorandum of Understanding.
CANCELLATION OF AGREEMENT
The City of San Gabriel and the City of Arcadia shall each have the right to cancel this
agreement by providing 30 (thirty) days written notice to the other city.
HOLD HARMLESS AGREEMENT
During the term of this Memorandum of Understanding, the City of San Gabriel agrees
to abide by and maintain in effect the attached "Hold Harmless Agreement" which is
incorporated by reference and made a part hereof. The Hold Harmless Agreement shall
survive the termination or expiration of this MOU.

HOLD HARMLESS AGREEMENT
This HOLD HARMLESS AGREEMENT is made this 5 f day of August, 2009 by and between the
City of Arcadia, a California municipal corporation, located at 240 West Huntington Drive, Arcadia, California
91007, and the City of San Gabriel, a California municipal corporation, located at 425 S. Mission Drive, San
Gabriel, California 91776. The City of Arcadia and the City of San Gabriel are sometimes hereinafter
individually referred to as "Party" and hereinafter collectively referred to as the "Parties."
WHEREAS, the City of San Gabriel desires to use the City of Arcadia's firing range for use by its
Police Department; and
WHEREAS, in exchange for making the firing range available to the City of San Gabriel for its Police
Department, the City of Arcadia desires to be held harmless from any claims and /or litigation arising out of the
City of San Gabriel's use of the firing range.
NOW THEREFORE, in consideration of the mutual covenants and conditions contained herein, the City
of Arcadia and the City of San Gabriel hereby agree as follows:
TERMS
1. Hold Harmless. Upon City of San Gabriel's use of the firing range by any of its employees,
agents, and /or volunteers for the purposes specified herein, the City of San Gabriel shall defend, indemnify, and
hold harmless the City of Arcadia, its officials, officers, employees, agents, and volunteers from any and all
actual or alleged claims, demands, causes of action, liability, loss, damage and /or injury (to property or persons,
including without limitation wrongful death), whether brought by an individual or other entity, or imposed by a
court of law or by administrative action of any federal, state, or local governmental body or agency, arising out
of or incident to any acts, omissions, negligence, or willful misconduct of the City of San Gabriel, its personnel,
employees, agents, contractors, or volunteers in connection with or arising out of the City of San Gabriel's use
of the firing range. This indemnification applies to and includes, without limitation, the payment of all
penalties, fines, judgments, awards, decrees, attorneys' fees, and related costs or expenses, and any
reimbursements to the City of Arcadia, and its officials, officers, employees, agents, and /or volunteers for all
legal expenses and costs incurred by each of them. The City of San Gabriel's obligation shall not be restricted
to insurance proceeds, if any, received by the City of Arcadia, and its officials, officers, employees, agents, or
volunteers.
2. Authority to Enter Agreement. Each Party warrants that the individuals who have signed this
Agreement have the legal power, right, and authority make this Agreement and bind each respective Party.
3 Amendment; Modification. No supplement, modification, or amendment of this Agreement shall
be binding unless executed in writing and signed by both Parties.
4. Waiver. No waiver of any default shall constitute a waiver of any other default or breach,
whether of the same or other covenant or condition. No waiver, benefit, privilege, or service voluntarily given
or performed by a Party shall give the other Party any contractual right by custom, estoppel, or otherwise.
5. Attorneys' Fees and Costs. If any legal action or other proceeding is brought in connection with
this Agreement, the successful or prevailing Party shall be entitled to recover reasonable attorneys' fees and
other related costs, in addition to any other relief to which the Party is entitled.
6. Entire Agreement. This Agreement contains the entire agreement between the Parties related to
the matters specified herein, and supersedes any prior oral or written statements or agreements between the
Parties related to such matters.

Range Manual (Excerpt)
RANGE & FIREARMS SAFETY POLICY.
It shall be the policy of the Arcadia Police Department to conduct
all firearms and range training in such a manner as to promote an
attitude of safety among instructors and participants alike. The
efforts of all personnel involved in training shall be directed
toward ensuring a safe environment within which maximum training
benefit can be realized.
A. Application:
General safety guidelines apply to all Arcadia Police
training programs and range activities. The intent of
these guidelines is to promote participant and staff
safety and to reduce the potential risk for injury.
All members of the Force Training Unit, participants, and
instructional staff will be responsible for adhering to
all applicable safety guidelines, policies and approved
course outlines, and lesson plans.
B. General Range Safety Guidelines & Guidelines for Student -
to- Instructor /Staff Ratio:
1. Whenever possible, there shall be at least one
instructor for each five trainees /participants during
static line courses of fire and during moving courses
of fire. Under no circumstances shall the ratio
exceed one instructor for each six participants.
2. General safety rules and rules unique to the Arcadia
Police range, and outdoor ranges, will be provided to
all training participants.
3. The Arcadia Police Range at 250 W. Huntington Drive,
Arcadia, is an above ground firearms training range
constructed for the specific purpose of firearms
training and qualification. Perimeter containment of
the range is accomplished by the physical layout of
the building with pulverized rubber used as a bullet
trap to minimize ricochet potential. The range was
built to facilitate safe use.
4. The range at Burro Canyon Shooting Park, 22100 East

Fork Road, Azusa, is an outdoor facility constructed
for the specific purpose of firearms use. Perimeter
containment of the range is accomplished by the
physical layout and canyon terrain of the area.
Bullet traps are soft dirt berms which minimize
ricochet potential.
5. Designated safe areas at each of these ranges are at
the rear of the firing lines.
6. The on -site Force Training Unit instructor will
designate safe areas for observers to accommodate
persons not directly involved in the training.
7. Firearms cleaning will only be conducted in the
designated cleaning area of the Arcadia Police
Department indoor range facility.
8. All firearms loading and unloading will only be
conducted in designated areas on the outdoor ranges.
When on the police facility or indoor range, the
designated loading /unloading devices shall be used.
9. Each firearms training facility shall have a
communications process capable of clearly
transmitting instructions to all persons on the
range.
10. Range facilities and bullet impact areas shall be
inspected at least daily for apparent hazards.
11. Adequate emergency lighting shall be provided at the
site of any night -time firearms training.
12. Weather conditions should be considered on outdoor
ranges with regard to the need to provide shaded
areas, shelter or protective clothing.
13. The indoor range shall be adequately ventilated.
14. A first aid kit and Ambu -bag ventilator shall be
readily accessible at each range site while training
is being conducted.
15. Ranges equipped with reactive targets shall be

constructed to minimize the danger of ricochets.

17. Every participant shall be required to wear eye and
ear protection while engaged in shooting or while in
the immediate vicinity of the firing line.
18. The use of soft body armor is encouraged in all
tactical shooting courses and in those courses which
employ reactive targets.
19. All participants shall use only Department approved
firearms and equipment while on the range.
20. Each weapon shall be subject to a basic safety
inspection and approved for use by a member of the
Firearms Training Unit prior to use on the range.
21. A safety check of weapons shall be initiated
following any break in training or whenever
participants have been allowed to leave the training
site.
22. Clothing and footwear appropriate to the course of
fire and terrain of the range shall be required.
23. Force Training Unit instructors must be easily
identifiable. Instructors will wear Department
approved shirts, jackets and /or hats to facilitate
identification.
24. Force Training Unit instructors in certified courses
should have successfully completed a P.O.S.T.
certified Firearms Instructor Course or its
equivalent.
25. Force Training Unit instructors are encouraged to
participate in periodic Firearms Instructor update
courses.
26. Participants should be instructed to wash their hands
and face thoroughly after shooting to remove any lead
particles or other debris deposited as a result of
the weapon's discharge. i

C. First Aid and Emergency Protocol:

A first aid kit and shall be present for immediate access
at each training site. The items will be under the control
of the Police Department Range Safety Officer.
In the event of injury to a training participant or other
individual on site, the following procedures shall be
used:
1. Immediately administer first aid as appropriate
for the injury.
2. Summon emergency medical aid to assist the
injured party.

D. Safety With Firearms:
No firearm has a will of its own. A weapon never "goes
off" unless something causes the discharge. The concept
of safety is central to the handling of firearms and our
training. The following principles must be remembered by
all persons handling a firearm:
1. All guns are always loaded. No exceptions.
Don't pretend, be deadly serious about this
concept.
2. Never let the muzzle cover (or point at
anything you are not willing to destroy.
3. Keep
your
finger off the trigger
until your
sights
are on target.
4. Be sure of
your target. Know what
it is, what
is in
line
with it, and what is
behind it.
Don't
shoot
at anything you have not
positively
identified.
E. Firearms Range Conduct Rules:
1. Unload all firearms to be used on the indoor
range at the loading /unloading box prior to
entering the range proper. When at outdoor
ranges, use the designated loading /unloading
area at the firing line.
2. Loading of firearms will only be on the firing
line with guns pointed down range at the
command of the rangemaster, or at the
loading /unloading box when leaving the range.
3. Keep your handgun holstered except when on the
firing line. All firearms are to remain in the
holster or have the actions open until the
shooter is on the firing line.
4. Always check to see if a firearm is loaded when

taking it from another person or picking it up,
regardless of who had it last.
5. All persons on the range must stay alert,
listen to, and follow commands from the
rangemaster. If your are not sure of what to
do, stop and ask the rangemaster for
assistance. Use common sense.
6. Stand firm on the line. Plant your feet and do
not fidget.
7. Do not turn around with any weapon in your
hand. Holster the weapon or clear the chamber
on rifles and shotguns first, then turn.
8. Do not let the handgun danale in vour hand.
9. Keep the muzzle pointed down range during
manipulation. Insert loaded magazines with the
pistol still holstered unless you are doing a
tactical reload during a firing exercise.
10. Keep the trigger finger outside the trigger
guard when the weapon is in motion.
11. No person is to go forward of the firing line
until the rangemaster has checked to make sure
all shooters are aware of the movement and
their firearms are unloaded.
12. If you need to work with your weapon off the
firing line, inform the rangemaster before
leaving the line.
13. Shooters may not leave the firing line until
the rangemaster has checked to make sure their
weapon(s) are unloaded and has given the "clear
to move" signal.
14. When working with rifles or shotguns, keep the
actions open, except when on target or during a
tactical drill.
15. Do not engage in any horse play. Any such
conduct or mishandling of firearms will be
documented by the rangemaster and may result in
disciplinary action.

WEAPON USED. Shooting for qualification will be done only with a
Department- approved weapon.

RANGE AND FIREARMS SAFETY POLICY (CONT.):

minimize ricochet potential.
6. Designated safe areas at each of these ranges are
at the rear of the firing lines.
7. The on -site Firearms Training Unit instructor will

11. Range facilities and bullet impact areas shall be
inspected at least daily for apparent hazards.

12. Adequate emergency lighting shall be provided at
the site of any night -time firearms training.
13. Weather conditions should be considered on outdoor
ranges with regard to the need to provide shaded areas,
shelter or protective clothing.
14. The indoor range shall be adequately ventilated.
15. A first aid kit and Ambu -bag ventilator shall be
readily accessible at each range site while training is being
conducted.
16. Ranges equipped with reactive targets shall be
constructed.to minimize the danger of ricochets.
17. Props and /or sets used in tactical shooting courses
shall be constructed to minimize the danger created by
ricochet.
18. Every participant shall be required to wear eye and
ear protection while engaged in shooting or while in the
immediate vicinity of the firing line.
19. The use of soft body armor is encouraged in all
tactical shooting courses and in those courses which employ
reactive targets.
20. All participants shall use only Department approved
firearms and equipment while on the range.
21. Each weapon shall be subject to a basic safety
inspection and approved for use by a member of the Firearms
Training Unit prior to use on the range.

22. A safety check of weapons shall be initiated
following any break in training or whenever participants have
been allowed to leave the training site.
23. Clothing and footwear appropriate to the course of
fire and terrain of the range shall be required.
24. Firearms instructors must be easily identifiable.
Instructors will wear Department approved shirts, jackets
and /or hats to facilitate identification.
25. Firearms Training Unit instructors in certified
courses should have successfully completed a P.O.S.T.
certified Firearms Instructor Course or its equivalent.
26. Firearms Training Unit instructors are encouraged
to participate in periodic Firearms Instructor' update
courses.
27. Participants should be instructed to wash their
hands and face thoroughly after shooting to remove any lead
particles or other debris deposited as a result of the
weapon's discharge.
C. First Aid and Emergency Protocol:
A first aid kit and Ambu -bag ventilator shall be present
for immediate access at each training site. The items will be
under the control of the Police Department Range Safety
Officer.
In the event of injury to a training participant or
other individual on site, the following procedures shall be
used:
1. Immediately administer first aid as appropriate for
the injury.
2. Summon emergency medical aid to assist the injured
party.

D. Safety With Firearms:
No firearm has a will of its own. A weapon never "goes
off" unless something causes the discharge. The concept of
safety is central to the handling of firearms and our
training. The following principles must be remembered by all
persons handling a firearm:
1. All guns are always loaded. No exceptions. Don't
pretend, be deadly serious about this concept.
2. Never let the muzzle cover (or point at) anything
you are not willing to destroy.
3. Keep your finger off the trigger until your sights
are on target.
4. Be sure of your target. Know what it is, what is
in line with it, and what is behind it. Don't shoot at
anything you have not positively identified.

E. Firearms Rance Conduct Rules:
1. Unload all firearms to be used on the indoor range
at the loading /unloading box prior to entering the range
proper. When at outdoor ranges, use the designated
loading /unloading area at the firing line.
2. Loading of firearms will only be on the firing line
with guns pointed down range at the command of the
rangemaster, or at the loading /unloading box when leaving the
range.
3. Keep your handgun holstered except when on the
firing line. All firearms are to remain in the holster or
have the actions open until the shooter is on the firing
line.
4. Always check to see if a firearm is loaded when
taking it from another person or picking it up, regardless of
who had it last.
5. All persons on the range must stay alert, listen
to, and follow commands from the rangemaster. If your are
not sure of what to do, stop and ask the rangemaster for
assistance. Use common sense.
6. Stand firm on the lane. Plant your feet and do not
fidget.
7. Do not turn around with any weapon in your hand.
Holster the weapon or clear the chamber on rifles and
shotguns first, then turn.
8. Do not let the handgun dangle in your hand.

9. Keep the muzzle pointed down range during
manipulation. Insert loaded magazines with the pistol still
holstered unless you are doing a tactical reload during a
firing exercise.
10. Keep the trigger finger outside the trigger guard
when the weapon is in motion.
11. No person is to go forward of the firing line until
the rangemaster has checked to make sure all shooters are
aware of the movement and their firearms are unloaded.
12. If you need to work with your weapon off the firing
line, inform the rangemaster before leaving the line.
13. Shooters may not leave the firing line until the
rangemaster has checked to make sure their weapon(s) are
unloaded and has given the "clear to move" signal.
14. When working with rifles or shotguns, keep the
actions open, except when on target or during a tactical
drill.
15. Do not engage in any horse play. Any such conduct
or mishandling of firearms will be documented by the
rangemaster and may result in disciplinary action.
F. Firearms Safety at Home:
Possession of a firearm requires constant diligence to
ensure safety for your family, friends, and yourself. A
single moment of inattention can lead to tragedy. The
ultimate responsibility for firearm(s) in your possession
rests with you.
1. Penal Code Section 12035, makes it a felony if a
firearm is left unsecured and a child (under 14 years of age)
uses the firearm in a crime or injures /kills him /herself or
another.

2. When children are in the home, all firearms left
unattended by an adult must be secured either in a locked
area, container, or have the individual firearm disabled
using one of various firearm locks currently available.
3. Some of the firearm locks available are; cable
type, trigger locks (key or pressure type), and nylon ties.
Keys and combinations must be kept under control by the adult
responsible for the gun.
4. Locked containers include; safes, cabinets,
individual gun cases, rooms or closets, and vehicles or
vehicle trunks. Keys and combinations must be kept under
control by the adult responsible for the gun.
5. Disabling the firearm by simply unloading it is not
a viable alternative to properly securing it as a crime can
be committed with an unloaded firearm.
6. Disassembling the firearm to prevent it from being
fired is acceptable, but may not prevent it from being used
in a crime if it is still recognizable as a complete firearm.
In addition, some children may be able to re- assemble the
firearm.
7. Loading and unloading firearms requires the same
caution, or perhaps more, at home as it does when you are on
the range, or anywhere else. Remember, bullets can easily
penetrate walls, floors, roofs, doors, and furniture.
8. During dry firing practice, all live ammunition
shall be separated from the firearm and all loading devices.
The weapon should always be pointed in a safe direction with
a safe backdrop. (Refer to safety rules in Sections C and D
of this policy.)
