IN THE AMOUNT OF $514,861.10 FOR THE ROAD REHABILITATION OF SANTA ANITA AVENUE FROM LONGDEN AVENUE TO LIVE OAK AVENUE PROJECT AND APPROVE A 10% CONTINGENCY Recommendation: Approve SUMMARY On February 17, 2009, the President signed into law the American Recovery and Reinvestment Act of 2009 (ARRA), of which a portion will fund infrastructure improvement projects throughout the nation. The City of Arcadia will likely receive approximately $2 million for road improvement projects. The Road Rehabilitation of Santa Anita Avenue from Longden Avenue to Live Oak Avenue Project is the first project to receive federal approval and be advertised for bids. Staff recommends that the City Council award a contract in the amount of $514,861.10 to Silvia Construction, Inc., for the Road Rehabilitation of Santa Anita Avenue from Longden Avenue to Live Oak Avenue Project. DISCUSSION On February 17, 2009, the President signed into law the American Recovery and Reinvestment Act of 2009 (ARRA). The ARRA provides $27.5 billion supplemental funding to Federal Highway Administration (FHWA) projects to be apportioned to the states after certain takedowns. California's share is estimated to be $2.57 billion. The City of Arcadia share is approximately $2 million. Staff Report September 1, 2009 Page 2 City personnel have submitted applications for various road improvement projects to the California Department of Transportation (CALTRANS). Caltrans together with the Federal Highway Administration (FHWA) and the Metropolitan Transit Authority (MTA) have reviewed and approved the Road Rehabilitation of Santa Anita Avenue from Longden Avenue to Live Oak Avenue Project. Notices inviting bids were published and bid packages were distributed to area contractors. The following eleven (11) bids were received on July 28, 2009: Bidder Silvia Construction, Inc. An alternate bid item in the amount of $63,000 for additional paving repair work will be exercised by the city resulting in a total contract amount of $514,861.10. Because this project is funded by Federal ARRA funds, it must follow the Federal funding guidelines and requirements. Staff established a Disadvantaged Business Enterprise (DBE) participation goal for this project of 3%. Although contractors must make a good faith effort to meet the City's DBE goal, it is not an absolute requirement. The low bidder presented 0% DBE participation for the project, but filed the required good faith effort documents. Upon review, staff has determined that a reasonable good faith effort was made to consider DBE contractors. Staff has reviewed the bid documents for content and has investigated the Contractor's background and their recent projects for competency. It is staff's opinion that Silvia Construction, Inc. can satisfactorily perform the work required and recommends that the City Council award a contract in the amount of $514,861.10 to Silvia Construction, Inc. for the Road Rehabilitation of Santa Anita Avenue from Longden Avenue to Live Oak Avenue Project. Staff Report September 1, 2009 Page 3 FISCAL IMPACT This project will be funded 100% by Federal ARRA monies. State approval of the ARRA Program Supplemental Agreement No. 009-N allows reimbursement to the City of up to $600,000 for approved ARRA projects. RECOMMENDATION It is recommended that the City Council authorize the City Manager to enter into a contract with Silvia Construction, Inc. in the amount of $514,861.10, approve a 10% contingency and waive any abnormality in the bid or bidding process.
