SUBJECT: RESOLUTION NO. 6693 AMENDING RESOLUTION 6670 SETTING
FORTH LEGALLY ENFORCEABLE SPEED LIMITS ON DUARTE ROAD
Recommendation: Adopt
SUMMARY
On March 17, 2009, the City Council adopted Legally Enforceable Speed Limits for 52
segments on 31 arterial and collector streets citywide. As part of the new adoption, the
two speed limit segments on Duarte Road were kept at 35 miles per hour.
Upon re-review of the roadway conditions and consultation with the local Traffic Court,
staff has revised the data sheet with a recommendation to amend the segment limits
and the speed limits accordingly. The two segments shall be adjusted by moving the
transition point from El Monte Avenue to Santa Anita Avenue. The first segment will
extend from the westerly City Limits to Santa Anita Avenue and will retain the 35 miles
per hour speed limit. The second segment will extend from Santa Anita Avenue to the
easterly City Limit (Fifth Avenue) and will be set at 40 miles per hour. Staff recommends
the adoption of Resolution 6693 setting forth legally enforceable speed limits on Duarte
Road.
BACKGROUND
In late 2008, staff undertook a comprehensive Engineering and Traffic Survey (E&TS) of
all street segments with previously adopted speed limits to re-establish enforceable
limits. After implementation of the new speed limits, the local Traffic Court expressed
concerns that the speed limit on the easterly segment of Duarte Road was not
enforceable due to the fact the data used was inappropriately applied to the entire
segment of Duarte Road. After consultation with the Traffic Court, it was determined
that the best application was to adjust the Duarte Road segment transition line from El

Monte Avenue to Santa Anita Avenue, keep the 35 mph speed limit for the westerly
segment, and raise the speed limit to its appropriate level (40 mph) on the segment east
of Santa Anita Avenue.
DISCUSSION
All factors used in determining the speed limit for Duarte Road were re-examined and
confirmed as to their validity. Speed survey data for Duarte Road is as follows:

As can be seen in the above table the 85th percentile speed for both segments would
have increased the speed limit to 40 mph and 45 mph respectively. However due to a
higher than normal collision-rate (1.51 accidents/MVM) the previously recommended
speed limit in the 2009 survey was downgraded to 35 mph for the entire segment. This
is what the Traffic Court disallowed.
To correct this discrepancy, the segment transition point will be moved to Santa Anita
Avenue due to roadway conditions such as land use, spacing of traffic signals, and
other factors. This will adjust the two segments; westerly City Limits to Santa Anita
Avenue, and Santa Anita Avenue to the easterly City Limits (Fifth Avenue). Due to the
higher than normal accident rates the 85th percentiles can still be downgraded
accordingly. The westerly segment will be set at 35 mph and the easterly segment set
to 40 mph.
The Police Department has consulted with the local Traffic Court judge who confirms
that this revision is enforceable.

FISCAL IMPACT
There is no fiscal impact of this action.
RECOMMENDATION
That the City Council adopt Resolution 6693, a resolution of the City Council of the City
of Arcadia, Amending Resolution 6670 Setting Forth Legally Enforceable Speed Limits
On Duarte Road.

RESOLUTION NO. 6693
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ARCADIA, CALIFORNIA, AMENDING
RESOLUTION 6670 SETTING FORTH LEGALLY
ENFORCEABLE SPEED LIMITS ON DUARTE ROAD
BETWEEN THE EAST AND WEST CITY LIMITS
WHEREAS, in accordance with California Vehicle Code Sections 22357
and 22358, Sections 3221 and 3222 of the Arcadia Municipal Code authorize the
City Council, on the basis of an engineering and traffic survey, to increase or
decrease the prima facie speed limit otherwise allowed by state law on certain
streets in order to facilitate the orderly movement of vehicular traffic in a manner
that is reasonable and safe; and
WHEREAS, the City of Arcadia has recently conducted an engineering and
traffic survey which together with earlier such engineering and traffic surveys,
indicates that a speed less than that otherwise permitted by state law on Duarte
Road would facilitate the orderly movement of vehicular traffic and would be
reasonable and safe; and
WHEREAS, the City Council desires and intends to keep in place without
interruption those certain increases and decreases in the prima facie speed limit on
certain streets set forth in Arcadia Municipal Code Sections 3221 through and
including 3221.23 and Sections 3222 through and including 3222.9; and
WHEREAS, the City Council adopted Ordinance No. 2190 which permits
the City Council, by resolution, to increase or decrease the prima facie speed limit
on certain streets based on an engineering and traffic survey, while at the same
time removing from the Arcadia Municipal Code those certain increases or
decreases in prima facie speed limits in existence at the time of adoption of
Ordinance No. 2190.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, DOES HEREBY FIND, DETERMINE AND
RESOLVE AS FOLLOWS:
SECTION 1. On the basis of an engineering and traffic survey
conducted by the City, an increase in the speed otherwise permitted by State Law
on Duarte Road between Santa Anita Avenue and Fifth Avenue would facilitate
the orderly movement of vehicular traffic and would be reasonable and safe.
Therefore, the prima facie speed limit on a portion of Duarte Road between Santa
Anita Avenue and Fifth Avenue shall be as follows:
Duarte Road between Santa Anita Avenue and Fifth Avenue, forty (40)
miles per hour.
SECTION 2. The increase in prima facie speed limits set forth in this
Resolution shall be effective upon the effective date of this Resolution, and City
Staff are hereby authorized and directed to erect and install appropriate signs upon

the applicable street giving notice of the foregoing prima facie speed limit.
SECTION 3. This Resolution shall take effect upon its adoption.
SECTION 4. The City Clerk shall certify to the adoption of this
Resolution.
