HomeMy WebLinkAboutItem 09a - Regular Meeting Minutes of September 16, 2025 1 09-16-2025 ARCADIA CITY COUNCIL REGULAR MEETING MINUTES TUESDAY, SEPTEMBER 16, 2025 CALL TO ORDER – Mayor Kwan called the Closed Session to order at 6:00 p.m. ROLL CALL OF CITY COUNCIL MEMBERS Sharon Kwan, Mayor Eileen Wang, Mayor Pro Tem Dr. Michael Cao, Council Member Paul P. Cheng, Council Member David Fu, Council Member PUBLIC COMMENTS – No one appeared. CLOSED SESSION a. Pursuant to Government Code Section 54956.9 (d)(1) to confer with legal counsel regarding the matter of Moises Anguiano v. City of Arcadia, Arcadia Public Works Services Department; and Does 1-30, inclusive (Case No. 23AHCV00981). b. Pursuant to Government Code Section 54956.9 (d)(2) to confer with legal counsel regarding the Workers’ Compensation matter of Brett Bourgeous (Claim #22- 162513 and Claim #24-176675/WCAB Case No. ADJ18717812). The Closed Session ended at 6:21 p.m. No reportable action was taken. Regular Meeting City Council Chambers, 7:00 p.m. 1. CALL TO ORDER – Mayor Kwan called the Regular Meeting to order at 7:00 p.m. 2. INVOCATION – Mohammad Ahad, Mosque of San Gabriel 3. PLEDGE OF ALLEGIANCE – Mohammad Ahad, Mosque of San Gabriel 4. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Cao, Cheng, Fu, Wang, and Kwan ABSENT: None 2 09-16-2025 5. REPORT FROM CITY ATTORNEY REGARDING CLOSED/STUDY SESSION ITEMS City Attorney Maurer reported that prior to the Regular Meeting, the City Council met in a Closed Session to discuss the two items listed on the posted agenda and indicated that no reportable action was taken. 6. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto had nothing to report. 7. PRESENTATIONS a. Presentation of Mayor’s Certificate of Commendation to the Homeowners’ Associations and Architectural Review Boards for their dedication and efforts in preserving the beauty of Arcadia. 8. PUBLIC HEARING a. Temporary Use Permit No. TUP 25-11 to allow Social House Holidays LLC to host the Enchant Christmas Light Maze and Market in the south parking lot of Santa Anita Park at 285 W. Huntington Drive during the holiday season. CEQA: Exempt Recommended Action: Approve Senior Planner Chipres presented the Staff Report. Mayor Kwan opened the Public Hearing. Jason Babel, Applicant and Senior Vice President of Social House Entertainment, appeared and presented a PowerPoint presentation of the proposed Enchant Christmas Light Maze and Market event. Julicia Batres, an Arcadia resident, appeared and expressed concerns about potential noise and increased traffic from the proposed event on her family and surrounding neighbors. In response to Ms. Batres’ comment, Mr. Babel reiterated that the event will comply with the City’s noise ordinance; he indicated that the event is intended to be community-friendly and nondisruptive to residents; and he noted that he has hosted this event in other communities, without experiencing noise issues. In response to Council Member Fu’s inquiry, Mr. Babel provided the anticipated dates of operation. 3 09-16-2025 Mayor Kwan closed the Public Hearing. Mayor Kwan reopened the public hearing to allow Mayor Pro Tem Wang to address the one public speaker. In response to Mayor Pro Tem Wang’s inquiry, Ms. Batres indicated that she lives across the street from Santa Anita Park on Huntington Drive. Mayor Kwan closed the Public Hearing. After discussion, a motion was made by Council Member Cao, seconded by Council Member Fu, and carried on a roll call vote to approve Temporary Use Permit No. TUP 25-11 to allow Social House Holidays LLC to host the Enchant Christmas Light Maze and Market in the south parking lot of Santa Anita Park at 285 W. Huntington Drive during the holiday season. AYES: Cao, Fu, Cheng, Wang, and Kwan NOES: None ABSENT: None 9. PUBLIC COMMENTS Benny Yee, an Arcadia resident, appeared and expressed his opposition to the censure of Mayor Kwan and served the City with a lawsuit. Sonia, an Arcadia resident, appeared and expressed her frustration over the censure of Mayor Kwan, and encouraged residents to stay informed and participate in community discussions. The following speakers appeared and expressed their support for the proposed 2026 Open Streets event organized by Active San Gabriel Valley; and encouraged the City to participate by submitting a letter of support by October 9: Michelle Kim Kai T. Tori Takenchi Thomas Ringo Suen Mark Bievotte Kean T. Topher Mathers Carlton Maese, an Arcadia resident, appeared and requested that the City Council consider placing an item on a future agenda to repeal its water conservation ordinance, noting that it was adopted in 2022, in response to drought conditions that no longer exist. In response to several speakers requesting Arcadia’s participation in the proposed 2026 Open Streets event, City Manager Lazzaretto stated that prior to the comments heard this 4 09-16-2025 evening, the City was unaware of the proposal to have Arcadia participate, and that staff would bring back an item for City Council consideration at the October 7 meeting. In response to Mr. Maese’s comment, City Manager Lazzaretto explained that state law requires cities to practice water conservation and that the state views drought conditions as ongoing, thereby, requiring ongoing water restrictions; he further stated that discussions on water rates will occur in the upcoming months and encouraged Mr. Maese to participate in those public meetings. 10. CONSENT CALENDAR a. Special and Regular Meeting Minutes of August 19, 2025, Special Meeting Minutes of August 26, 2025, and Special and Regular Meeting Minutes of September 2, 2025. CEQA: Not a Project Recommended Action: Approve b. Resolution No. 7647, authorizing the City Manager, or designee, to execute a grant agreement with the California Department of Transportation to fund development of Arcadia’s Active Transportation Plan. CEQA: Not a Project Recommended Action: Adopt c. Resolution No. 7655 authorizing a supplemental budget appropriation in the amount of $22,144 from the Asset Seizure Fund; and approving a purchase order with Nappi Fabrication Designs for customized trailer cabinets in an amount not to exceed $37,072. CEQA: Not a Project Recommended Action: Adopt and Approve d. Appointment to the Senior Citizens Commission (Golden Senior Club). CEQA: Not a Project Recommended Action: Make Appointment to Fill Unexpired Term e. Professional Services Agreement with Linkture Corp. for design of the motor control center at Peck Well in an amount not to exceed $50,000. CEQA: Not a Project Recommended Action: Approve f. Professional Services Agreement with Phoenix Water Solutions for the Water Meter Dial Replacement Project in the amount of $224,400. CEQA: Exempt Recommended Action: Approve 5 09-16-2025 g. Purchase Order with Valley Power Systems, Inc. for the purchase of one portable emergency generator for the Whispering Pines Booster Station in the amount of $66,576.25. CEQA: Not a Project Recommended Action: Approve h. Purchase Order with DeLillo Chevrolet for the purchase of two 2025 Chevrolet Silverado 2500HD pickup trucks in the amount of $124,270.96. CEQA: Not a Project Recommended Action: Approve i. Purchase of ammunition from San Diego Police Equipment Co., Inc. in an amount not to exceed $107,054. CEQA: Not a Project Recommended Action: Waive the Formal Bid Process and Approve Mayor Kwan pulled item 10.i – Purchase of Ammunition, from the Consent Calendar for a separate discussion, and requested that City Manager Lazzaretto explain why staff recommended waiving the formal bidding process. City Manager Lazzaretto explained that the Police Department’s weapons require specialized ammunition; he indicated that this ammunition is available only through a sole authorized dealer and distributor, and therefore, staff recommends that the City Council waive the bidding process and authorize the purchase. It was moved by Council Member Cao, seconded by Council Member Cheng, and carried on a roll call vote to approve Consent Calendar Items 10.a through 10.i. AYES: Cao, Cheng, Fu, Wang, and Kwan NOES: None ABSENT: None 11. CITY MANAGER a. Mills Act Application No. MILLS 25-01 for a ten-year Mills Act contract between the City of Arcadia and the Property Owner of the historic “Brod-Papp House” located at 1203 Oakwood Drive. CEQA: Not a Project Recommended Action: Approve Senior Planner Arreola presented the Staff Report. A motion was made by Council Member Fu, seconded by Council Member Cao, and carried on a roll call vote to approve Mills Act Application No. MILLS 25-01 for a ten-year Mills Act 6 09-16-2025 contract between the City of Arcadia and the Property Owner of the historic “Brod-Papp House” located at 1203 Oakwood Drive. AYES: Fu, Cao, Cheng, Wang, and Kwan NOES: None ABSENT: None 12. AB 1234 REPORTS FROM MAYOR AND CITY COUNCIL (limited to legally required reports). City Attorney Maurer explained that this section has been limited to legally required reports pursuant to AB 1234. Council Member Fu had nothing to report. Council Member Cao had nothing to report. Mayor Pro Tem Wang announced that on September 13, she attended Taste of Arcadia. Council Member Cheng announced that on September 13, he attended Taste of Arcadia. Mayor Kwan announced that on September 4, she attended the Chinese American Museum’s 29th Annual Historymakers Awards Gala, and that on September 13, she attended Taste of Arcadia. 13. REQUEST FOR FUTURE ITEMS Council Member Cheng requested City Council support to place an item on a future agenda to discuss the 2026 Open Streets event – Mayor Pro Tem Wang and Council Member Cao concurred. 12.
