HomeMy WebLinkAboutC-1621, r 4 T Y 01 /1I,(,` A.NA UT" r, _t, RK AMENDMENT NUMBER ONE TO THE TECHNICAL ASSISTANCE AGREEMENT BETWEEN THE DEPARTMENT OF THE ARMY AND CITY OF ARCADIA FOR DESIGN OF WATER INFRASTRUCTURE IMPROVEMENTS THIS AMENDMENT is entered into by the Department of the Army (hereinafter "the Government ") and the City of Arcadia (hereinafter the "Sponsor ") with respect to the Technical Assistance Agreement executed on September 8, 1998 between the Department of the Army and the City of Arcadia for design of Water Infrastructure Improvements. WITNESSETH, that WHEREAS, the parties have entered into the Technical Assistance Agreement and desire to amend certain Articles of its provisions. NOW, THEREFORE, the parties agree that the referenced Technical Assistance Agreement shall be amended as follows: 1. Add paragraph G. To ARTICLE I (DEFINITIONS): G. The term "additional SOW" shall mean the additional Scope of Work describing the technical assistance work to be provided, which is attached to this Amendment and which shall not be considered binding on either party and is subject to change by the Government in consultation with the Sponsor. 2. The third and fourth sentences of paragraph A of ARTICLE III (METHOD OF PAYMENT) are amended to read as follows: As of the effective date of this Amendment, the estimated cost of technical assistance is $722,000.00 and the Sponsor's share of estimated cost of technical assistance is $180,500.00. In order to meet the Sponsor's cash payment requirements for its share of the estimated cost of technical assistance, the Sponsor must provide a cash contribution currently estimated to be $40,500.00 in addition to the Sponsor's $140,000 cash contribution specified in the original agreement. The dollar amounts set forth in this Article are based upon the Government's best estimates, which reflect the technical assistance in the SOW and in the additional SOW, projected costs, price -level changes, and anticipated inflation. 3. Add sentence at the end of ARTICLE XIII (LIMITATION ON GOVERNMENT OBLIGATIONS): The Appropriations Committee has approved funds under the General Investigations Program to complete the Cities of Arcadia and Sierra Madre study as provided in the Energy and Water Development Appropriations Act, 1999 (Public Law 105 -245). 4. All other provisions of the Technical Assistance Agreement remain unchanged. IN WITNESS WHEREOF, the parties hereto have executed this Amendment, which shall become effective upon the date it is signed by the District Engineer for the U.S. Army Corps of Engineers, Los Angeles District. DEPARTMENT OF THE ARMY CITY OF ARCADIA Los Angeles District Attachment - Additional Scope of Work Mn CERTIFICATON REGARDING LOBBYING The undersigned certifies, to the best of his or her knowledge and belief that: (1) No Federal appropriated funds have been paid or will be paid, by or on behalf of the undersigned, to any person for influencing or attempting to influence an officer or employee of any agency, a Member of Congress, an officer or employee of Congress, or an employee of a Member of Congress in connection with the awarding of any Federal contact, the making of any Federal grant, the making of any Federal loan, the entering into of any cooperative agreement, and the extension, continuation, renewal, amendment, or modification of any Federal contract, grant, loan, or cooperative agreement. (2) If any funds other than Federal appropriated funds have been paid or will be paid to any person for influencing or attempting to influence an officer or employee of any agency, a Member of Congress, an officer or employee of Congress, or an employee of a Member of Congress in connection. with this Federal contract, grant, loan, or cooperative agreement, the undersigned shall complete and submit Standard Form -LLL, "Disclosure Form to Report Lobbying," in accordance with its instructions. (3) The undersigned shall require that the language of this certification be included in the award documents for all subawards at all tiers (including subcontracts, subgrants, and contracts under grants, loans, and cooperative agreements) and that all subrecipients shall certify and disclose accordingly. This certification is a material representation of fact upon which reliance was placed when this transaction was made or entered into. Submission of this certification is a prerequisite for making or entering into this transaction imposed by Section 1352, Title 31, U.S. Code. Any person who fails to file the required certification shall be subject to a civil penalty of not less than $10,00 and not m7 -L- $100,000 for each such failure. Very trul yours, C. tep en Bucknam President Attachment cc: Pat Malloy, City of Arcadia Bruce Inman, City of Sierra Madre CJASM991,et.doc Cities of Arcadia and Sierra Madre Water Infrastructure Restoration Study — Fiscal Year 1999 Scope of Work - Design of Water System Improvements General The "Cities of Arcadia and Sierra Madre Water Infrastructure Restoration Special Study" conducted by the U.S. Army Corps of Engineers, Los Angeles District (Corps), describes water system performance and vulnerability to earthquake - induced damage for the Cities of Arcadia and Sierra Madre (study area) which are located in northwest Los Angeles County, California. The report recommends projects included in the study which would provide increased water system performance in the event of a major seismic event. This Scope of Work is comprised of the design of specific recommended construction projects for the Cities of Arcadia and Sierra Madre. These design project improvements will help mitigate existing deficiencies in the water systems which contribute to the potential for inadequate water supplies during emergency events. The objective of these projects is to significantly reduce the extent to which the water system are the limiting factor in supplying critical water demand following a major earthquake. Services Required Overview This Scope of Work consists of the design of specific water system improvements in the study area to achieve the stated objective. To effect the design that is most appropriate for the components, the Architect- Engineer is to: r • Study the existing water systems and their operations in the study area • Conduct site visits, as necessary • Participate in meetings to present proposed design status, consult with the Corps and City, representatives, discuss issues /concerns, and interface with water system operations personnel Cities of Arcadia and Sierra r 're FY99 Scope of Work • Conduct new or update existing base technical studies as needed (e.g., ground water. analyses, well location suitability studies, etc.) and • Consider specific equipment recommendations from City representatives (specific motors, valves, etc.) In addition, the Architect - Engineer is to: • Perform periodic rigorous in -house quality control reviews • Provide all engineering design plans and specifications in hard copy format, reproducible format and electronic data format as agreed to by the Corps and Cities • Utilize Auto CAD R13 or other design software approved by the Corps and Cities for the preparation of construction plans • Utilize Word Perfect 6.0 for Windows for the preparation of technical specifications and incorporate into the Cities' "boilerplate" standard provisions and contract documents. Pre - Design Research and Studies The Architect- Engineer shall conduct the following research and studies, as appropriate, in accordance with the design of the program components. O Review of Existing Data Conduct a thorough review of all existing facilities data, studies, operational records and any other pertinent data to acquire the knowledge of existing conditions. O Conduct Studies /Research Conduct specific technical studies /research to provide the essential data needed to effect proper design of components including, but not limited to ground water analyses, well site location suitability studies, soils investigations, studies to evaluate the need for shoring during construction, site hydrology studies and utilities location searches. O Conduct Surveys Conduct site surveys and establish pertinent topographical data as needed for the preparation of design components. 2 Cities of Arcadia and Sierra V' FY99 Scope: of Work Formulation of Plans and Specifications The Architect- Engineer shall prepare construction plans and technical specifications in formats as stated herein or as approved by the Corps and Cities for the following projects. O Pressure Reducing Valves (PRV) (Zones 1 to 2, 2 to 3, and 3 to 4) DESIGN: FINAL DESIGN IN FY99 (From 25% of 30% Design to 100% Design) Prepare final (100 %) plans and specifications for the replacement of existing closed zone valves with pressure reducing stations and construction of zone inter -ties as required. The locations are as follows: 6 --inch PRV at Michillinda Avenue at Colorado Boulevard 2. 8 -inch PRV at Huntington Drive at Baldwin Avenue 3. 8 -inch PRV and 12 -inch inter -tie line at Camino Real Avenue and Holly Avenue O Gas Storage Tanks, Backup Fuel Supply and Re -Equip Existing Generators DESIGN: FINAL DESIGN IN 1FY99 Prepare final (100 %) plans and specifications for the installation of environmentally approved fitel storage tanks capable of maintaining operations a minimum of six (6) hours. This shall include the following: 1. Convert Peck Road well standby pump and St. Joseph "C" booster pump from natural gas to diesel and provide fuel storage to maintain operations at 100% of the production capabilities for a minimum of six (6) hours. 2. Re -equip existing portable generator at Orange Grove Plant to maintain full plant operations at 100% for a minim of six (6) hours. City of Sierra Madre O New 2,000 (minimum) gpm Well at St. Joseph Site DESIGN: FINAL DESIGN IN FY99 (From 25% of 30% Design to 100% Design) Prepare hydrogeological report and final (100 %) design plans and specifications for the construction of a well at the St. Joseph site with a minimum capacity of 2,000 gpm. This well is an essential component of the System Reliability Inter -tie (noted below) with the City of Arcadia and would be installed at the St. Joseph site in the City of Arcadia. L! Cities of Arcadia and Sierra N e FY99 Scope of Work The well would provide an additional water supply of 2,000 gpm (minimum) to the City of Sierra Madre. The City of Arcadia could utilize the well for potential emergencies concurrent with a guarantee for the City of Sierra Madre to receive a minimum of 2,000 gpm of water in the event of an emergency. O 12 -inch Diameter Inter -tie with the City of Arcadia in Sierra Madre Boulevard DESIGN: FINAL DESIGN IN FY99 (From 25% of 30% Design to 100% Design) Prepare final (100 %) plans and specifications for the construction of approximately 2,500 feet of parallel 12 -inch diameter pipe within Sierra Madre Boulevard (approximately from Monterey Lane to Santa Anita Avenue) to convey the 2,000 gpm of water to the City of Sierra Madre from Arcadia by the well proposed above. This inter -tie would be beneficial in the event of an emergency demand (e.g., major seismic event), because the City of Sierra Madre does not currently possess the supply capacity required to meet maximum -day demands if their largest well (Well 45) was out of service for maintenance or repair. O Reconstruction of the Mira Monte Reservoir (West) 41 DESIGN: FINAL DESIGN IN FY99 (From 25% of 30% Design to 100% Design) Prepare final (100 %) plans and specifications for the reconstruction of the reservoir to current -day standards with the intent that it can remain fully operational following a major seismic event. Mira Monte Reservoir #1 is an oval concrete, partially buried reservoir with a capacity of 1.1 MG. It is anticipated during a major seismic event that structural damage will occur resulting in the loss of water storage due to extensive reservoir cracking or structural failure. O Zone 93 Looping Pipeline in Sturtevant Drive DESIGN: FINAL DESIGN IN FY99 Prepare final (100 %) plans and specifications for the construction of approximately 2,000 feet of 8 -inch diameter pipe within Sturtevant Drive (approximately from Mountain Trail to Oakdale Drive) to provide water users at high elevations on the east side of the City of Sierra Madre's service area with a reliable water service. Where applicable, control panels for facilities are to be compatible with existing telemetry systems, or include programmable controllers for use with future telemetry systems. 5 C itics of Arcadia and Sierra N c FY99 Scope of work Construction plans and technical specifications prepared under this portion of the scope shall be submitted at the following; intervals: 30% Design Review - Submit 30% design review plans and specifications for review by Corps and City. Drawings shall be accompanied by a description of status of design; design - related problems, concerns or issues; and a schedule for attaining nulestones and final completion. Attend a meeting to discuss the design after review of the 30% design submittal by the Corps and City. Prepare a modified schedule for completion, if needed, based upon comments received at the 30% design review meeting or in writing. 70% Design Review - Submit 70% design review plans and specifications incorporating into the design all comments and recommendations made at the time of the 30% review or subsequent to that meeting. Provide status report of design and attend a 70% review meeting. Provide a schedule of completion. Prepare a revised schedule based upon the comments on the 70% review, if necessary. 100% Design Review - Submit complete plans and specifications reflecting all comments received to date. Submit complete technical specifications and engineering construction cost estimate for review. Attend 100% design review meeting. Final Submittal - Submit final plans and specifications incorporating all comments to date. One set of final drawings shall be ink on 24" by 36" mylar. Ten blueline sets of all drawings shall be provided. Submit final technical specifications incorporating previous comments in a format ready to solicit bids from contractors. One reproducible set and ten copies of the technical specifications and engineering construction cost estimate shall be submitted. Note that plans and specifications shall be prepared separately for each Arcadia/Sierra Madre project element to allow for individual bidding and phasing the work. In addition, the Architect- Engineer shall prepare construction plans and technical specifications in formats as stated herein or as approved by the Corps and Cities for the following project. O Grove Reservoir Reconstruction — City of Sierra Madre DESIGN: PARTIAL DESIGN (70 %) IN FY99 Prepare plans and specifications for the reconstruction of the 2.8 MG Grove Street Reservoir which serves Zone 2 in the City of Sierra Madre. In accordance with the Final Special Study Report, there is a potential for structural damage to the reservoir. By reconstructing the reservoir to current -day standards, the reservoir can be expected to remain fully operational following a seismic event. This includes the repair of all cracks, and the inspection, cleaning and coating of appurtenances and exposed metal surfaces. C Cities of Arcadia and Sierra M FY99 Scope of work Construction plans and technical specifications prepared under this portion of the scope shall be submitted at the following intervals: 30% Desie,n Review - Submit 30% design review plans and specifications for review by Corps and City. Drawings shall be accompanied by a description of status of design; design- related problems, concerns or issues; and a schedule for attaining milestones and final completion. Attend a meeting to discuss the design after review of the 30% design submittal by the Corps and City. Prepare a modified schedule for completion, if needed, based upon comments received at the 30% design review meeting or in writing. 70% Design Review - Submit 70% design review plans and specifications incorporating into the design all comments and recommendations made at the time of the 30% review or subsequent to that meeting. In addition, the Architect - Engineer shall prepare visioneering services in concert with City of Sierra Madre staff and the Program Manager representing the City in formats as stated herein or as approved by the Corps and City for the following project. O Vision eering Services for Mira Monte and (Prove Reservoirs —City of Sierra Madre DESIGN: FINAL DELIVERABLE IN FY99 Prepare draft and final computer graphic presentations using state -of -the -art computer techniqucs to portray various views of both the Mira Monte and Grove Reservoirs upon completion. Included in this task are presentations (minimum of three) to the City of Sierra Madre City Council and/or public interest groups.
