EMERGENCY COMMUNICATIONS SERVICE
THIS AGREEMENT is made and entered into this 6th day
of July , 1993 by and between the City of Arcadia, and
the City of Monrovia, each a municipal corporation of the State of
California, hereinafter referred to jointly and severally as
"CITIES." For convenience, Emergency Communication System shall
be hereinafter referred to as "SYSTEM."
WHEREAS, studies by CITIES have disclosed that a shared
"SYSTEM" would greatly reduce the total cost of providing maximum
emergency fire protection and would permit maximum use of equipment
and manpower in cooperative ventures, thereby increasing fire
emergency efficiency and defense capabilities of CITIES; and
WHEREAS, CITIES have the power and authority to provide
emergency fire services, facilities, equipment, personnel and
dispatching for their respective cities, and are providing such
facilities and services at this time; and
WHEREAS, Government Code Sections 6500 et seq. provide that
two or more public agencies by agreement, may jointly exercise any
power common to the contracting parties; and
WHEREAS, the City of Arcadia is centrally located in relation
to
the other city participating
in this Agreement, and
said City
of
Arcadia owns and operates an emergency dispatching
facility
which is capable of providing emergency communications service to
one or more cities, and

WHEREAS, CITIES desire to enter into an agreement for fire
department emergency communications services.
NOW, THEREFORE, for and in consideration of the covenants
herein contained, performed and to be performed, CITIES do hereby
mutually agree as follows:

The City of Arcadia shall provide to CITIES fire reporting and
dispatching services through an emergency communications system.
The communication center of said SYSTEM will be located in and
operated by the City of Arcadia.
II.
With the exception of the first years pro -rated cost, the
annual cost of maintenance and operation of the fire department
SYSTEM shall be allocated among CITIES, based on actual cost as
determined by Arcadia utilizing the following formula:
Population + ASSESSED VALUE + Number of Alarms

Commencing with the third year annual cost increases shall be
proportionate to the actual cost of maintenance and operation with
a maximum permitted increase no greater than the annual increase
of the consumer price index for Los Angeles, Long Beach, and
Anaheim as published by the Bureau of Labor Statistics.
In the event any additional city enters the Agreement for
consolidated fire department dispatching and commences
participation in the use of the facility at a later date, the
CITIES shall share in any savings based upon further economies of

scale generated by the other jurisdictions inclusion.
III.
The percentage cost of providing emergency communications
service shall be based upon the city's official records of the
preceding year as follows:

EXAMPLE: Arcadia estimates the cost for 1993 -94 to be
approximately $309,689. Utilizing the formula as
indicated in section III, Arcadia's percentage would be
59% or $182,717 of total cost; Monrovia's percentage of
cost would be 41% or $126,972. However, the first year
Monrovia's cost will be pro -rated at approximately
$106,972. All subsequent years will use the formula as
described in Section III.
The same formula shall be used in each succeeding fiscal year,
using population, assessed value, and alarm statistics for the
preceding calendar year. Population shall be based on statistics
of the State Controller, the assessed valuation as shown in the
current years edition of "The Taxpayer's Guide" as published by the
controller for Los Angeles, County, and alarm statistics shall be

based upon official records of each city. The preceding years
statistics shall be provided to the City of Arcadia by February 1
of each year for computation of cost.
The cost of maintenance and operation of the SYSTEM shall
include the following items:
a. Telephone
(1) Fire reporting 9 -1-1 transfer lines from the city's
PSAP. Number to be determined by contracting city.
(2) Telephones and radio equipment within the
communications center directly related to SYSTEM.
b. Alarm alerting and paging system equipment within the
communications center.
(1) Telephone line charges to each fire station for
hardwired receipt of alarms.
(2) Alarm acknowledgement telephone line charges from
each fire station.
(3) Encoding and paging equipment located within the
communications center.
(4) Computer telephone lines, modems, associated
computer equipment, i.e. hardware, software, decoding equipment,
alarm equipment and any associated equipment located at city's fire
stations are excluded and shall be maintained by each city.
(5) CFIRS alarm reporting data will be provided directly
from the communication center to cities' fire
stations via computer if cities provide the
necessary approved equipment to receive CFIRS data.

C. Personnel
(1) Sufficient number of qualified fire dispatchers
shall be maintained continuously on duty at the
communications center; to receive and dispatch
emergency calls at no less than the existing level
of city's service.
d. Maintenance and /or replacement of equipment within the
communications center necessary to provide communications
to cities.
e. Equipment maintenance contracts relating to equipment
necessary to provide communications to cities.
f. Arcadia's building and equipment cost not classified as
special or extra.
g. Normal operating materials or equipment deemed necessary
to provide service & not classified as special or extra.
h. Depreciation cost of equipment specific to the provision
of fire department emergency communications service.
i. General Liability Insurance
IV.
Any special or extra telephone or electronic equipment or
additional service that may be desired by a city, which is in
excess of the standard equipment and service as set forth in this
AGREEMENT, shall be paid for by the city requesting said additional
services.

V.
Non - emergency business calls will not terminate in the
communications center. Each city shall be responsible for
providing and maintaining its own non - emergency fire department
business telephone system. Non - emergency business telephone
systems shall in no way reflect either upon the operation or the
cost of the emergency reporting system.
VI.
The City of Monrovia will receive and transfer fire department
E911 calls to the City of Arcadia Communications Center. The City
of Arcadia will provide to the City of Monrovia communications
services as necessary to provide emergency fire department
dispatching services.
VII.
All installation, maintenance, and repair orders, relating to
this agreement shall be directed through the Arcadia Fire Chief or
his authorized representative.
VIII.
Each city shall provide run card and dispatch procedures for
their units, as well as accurate mapping, and other related fire
protection information necessary for efficient fire dispatching.
This information, and all subsequent information shall be the
responsibility of each city, and all changes shall be sent to the
Arcadia Communications Center. The Arcadia Communications Center
shall utilize a computer aided dispatch system. Each city shall

provide geobase data as necessary for dispatch of emergency
equipment.
The City of Arcadia shall bill the City of Monrovia quarterly
for their share of costs, and City of Monrovia shall pay the
specified amount within thirty (30) days after such billings.
The responsible authorities for this AGREEMENT shall be the
fire chiefs and city managers or city administrators of CITIES.
Operational procedures relating to dispatching of personnel and
equipment shall be agreed upon by the CITIES fire chiefs. Said
procedures and policies shall be maintained in an operating manual
that identifies each city's responsibilities. Each city shall be
responsible for the proper disposition of its business telephone
calls. The Fire Chiefs or their authorized representatives shall
meet once per month to review operational procedure; minutes shall
be recorded and maintained.
XI.
Government Code Sections 895, et seq. shall govern this
Contract with respect to liability imposed on any city, or CITIES,
as a result of or arising out of this Agreement and use of the
emergency communications SYSTEM. Monrovia shall hold harmless,
defend and indemnify Arcadia against any claims, liability, or
suits arising out of or related to any calls for service emanating
from Monrovia or any persons making requests for service within
Monrovia city limits ( "Monrovia Users" herein), other than any
claim, liability or suit which results from the sole negligence or
wrongful acts or omissions of Arcadia's personnel.
Monrovia shall not be responsible for any claims or suits that
arise from or result from calls emanating from Arcadia or any
persons making requests for service within Arcadia city limits
( "Arcadia Users" herein). Arcadia shall hold harmless, defend and
indemnify Monrovia against any claims, liability or suits arising
out of or related to Arcadia Users.
XII.
The term of this Agreement shall be three (3) years
terminating on June 30, 1996, subject to cancellation by either
party upon six (6) months prior written notice to the other party.
Unless cancelled as set forth herein, this Agreement shall be
automatically renewed for an additional three (3) year term
commencing July 1, 1996 subject to the same six (6) month
cancellation provision during the renewed term. Each City shall
perform all obligations under this Agreement until the noticed
cancellation date.
