NOTICE TO BIDDERS
SEALED BIDS will be received in the office of the City Clerk, City Hall, 240 West
Huntington Drive, City of Arcadia, California 91007, up to 11:00 a.m. on November
18, 1992, at which time they will be publicly opened and read in the office of
the City Clerk, Arcadia City Hall, for the following project:
INSTALLATION OF SUPERVISORY CONTROL AND DATA ACQUISITION SYSTEM (SCADA)
WORK ORDER 692
The work consists of:
The furnishing and installation of a Supervisory Control and Data
Acquisition System (SCADA).
All work shall be commenced 15 days after receipt of notice to proceed and be
completed 120 calendar days thereafter.
A complete job walk will be conducted on October 28 and 29, 1992 at 9:00 a.m. at
11800 Goldring Road. ANY PROPOSED BIDDER NOT ATTENDING THE JOB WALK WILL NOT BE
ALLOWED TO SUBMIT A BID FOR THIS PROJECT.
Copies of the specifications are available for examination without charge at the
office of the Water Manager at Arcadia City Hall. Copies of the specifications
may be obtained from the Water Manager for a purchase price of $10.00 per set,
which sum will not be refunded. A charge of $4.00 (non - refundable) will be made
for mailing.
Bids shall be submitted on forms furnished by the City Water Manager. Each bid
must be accompanied by cash, certified or cashier's check payable to or bidder's
bond on the City's bond form in favor of the City of Arcadia by a surety company
authorized to do business in the State of California, and subject to approval of
the City Attorney, in an amount equal to at least ten percent (10 %) of the amount
of the bid, such guarantee to be forfeited should the bidder to whom the contract
is awarded fail to timely execute the contract and deliver the necessary bonds
and insurance certificates as specified in the contract documents.
Bidders are hereby notified that pursuant to Section 1770 et seq. of the Labor
Code of the State of California, the City Council of the City of Arcadia
incorporates herein by reference the general prevailing rate of per diem wages
as determined by the Director of Industrial Relations of the State of California.
Copies of the prevailing rate of per diem wages are on file in the office of the
City Engineer and will be made available to any interested party on request. In
accordance with the Labor Code, no workman employed upon work under contract to
the City shall be paid less than the above referenced prevailing wage rate.

Any classification omitted therein shall be paid not less than the prevailing
wage scale as established for similar work in the particular area, and all
overtime shall be paid at the prevailing rates as established for the particular
area. Sunday and holiday time shall be paid at the wage rates determined by the
Director of Industrial Relations.
All bids are to be compared on the basis of the Water Manager's estimate of the
quantities of work to be done.
No contract will be awarded other than to a contractor licensed in accordance
with the provisions of Chapter 9, Division 3 of the Business and Professions
Code.
The latest Edition of the "Standard Specifications for Public Works Construction"
including all Supplements (Green Book), are included by reference as a part of
the specifications for this project.
All bids shall be based on the content of the contract documents which consist
of the Notice to Bidders, Information Required of Bidder, Contract, Special
Provisions, the Bid, Technical Specifications, Faithful Performance and Labor and
Materials Bonds, which are by this reference incorporated herein and may be
obtained at the office of the City of Arcadia, 240 West Huntington Drive,
Arcadia, California. Special attention of prospective bidders is called to the
bid requirements and "Special Provisions" which contain the instructions to
bidders. Said "Special Provisions" authorize the Contractor to substitute
securities in lieu of the 10% retention in accordance with and pursuant to
Section 22300 of the Public Contracts Code.
The City of Arcadia reserves the right to accept or reject bids, to waive any
irregularity and informality in the bids or the bid process, and to retain all
bids and guarantees for a period of sixty (60) days for examination and
comparison, all as specified in the contract documents.

INSTRUCTIONS TO BIDDERS
BID DOCUMENTS
Bidders shall complete the bid documents in accordance with the provisions
of Section 2 -1 of the General Provisions. Should it be necessary to
disassemble the documents for the purpose of bid preparation, the
documents shall be reassembled in the original form prior to submission to
the City. In addition, bidders shall provide the bid prices on the
bidding schedule both in words and figures. In the event of a difference
between a price quoted in words and a price quoted in figures for the same
quotation, the words shall be the amount bid. In the event that the
product of a unit price and an estimated quantity does not equal the
extended amount quoted, the unit price shall govern, and the correct
product of the unit price and the estimated quantity shall be deemed to be
the amount bid. If the sum of two or more items in a bidding schedule
does not equal the total amount quoted, the individual item amounts shall
govern and the correct total shall be deeded to be the amount bid.
AWARD OF CONTRACT
The contract will be awarded to the lowest, responsive, responsible bidder
in accordance with Section 2 of the General Provisions. The lowest bid
will be determined on the basis of the total price of the bid items. Unit
prices are solely for the purpose of establishing bases for contract price
adjustment(s) in case any change of work involving any of these items
should be necessary and will not be used for determination of the lowest
bid.
POSTPONEMENT OF OPENING
The City reserves the right to postpone the date and time for receiving
and /or opening of bids at any time prior to the date and time established
in the Notice Inviting Bids. Postponement notices shall be mailed to
bidders in the form of addenda.

Gentlemen:
Pursuant to the Notice Inviting Bids for the above described work, the
undersigned, as a bidder, declares that he has carefully examined the location
of the proposed above described work and that he has read and examined the
contract documents and is familiar with all bid requirements, and hereby proposes
and agrees, if this bid is accepted by the City of Arcadia, that within ten (10)
working days, excluding Sundays, after written notice of award of the contract
is mailed to bidder, bidder will execute and deliver to City Attorney the
contract form provided by the City Attorney. Contractor will also furnish all
labor, materials and services necessary to perform and complete all work required
by the contract documents and all addenda thereto issued by said City prior to
the opening of bids, for the above described work for the unit price set forth
in the bidding schedule which is attached hereto and by this reference is
incorporated herein.
Bidder further agrees that upon failure to do so as above described, then the bid
guarantee furnished by said bidder shall be forfeited to said City as liquidated
damages for such failure.

within the time stipulated in said contract documents, and to accept in full

enters into a written contract in accordance with the contract documents and
files the two bonds with said City, one to guarantee faithful performance and the
other to guarantee payment for labor and materials, and the insurance
certificates, in accordance with the contract documents, then this obligation
shall be null and void; otherwise it shall remain in full force and effect.
In the event suit is brought upon this Bond by the City and judgment is
recovered, said Surety shall pay all costs incurred by the City in such suit,
including a reasonable attorney's fee to be fixed by the Court.

and to perform and complete the same in a good and workmanlike manner all
the work pertaining thereto shown on the Specifications therefor; to
furnish at his own cost and expense all tools, equipment, labor, services,
and materials necessary therefor (except such materials, if any, as in the
said specifications are stipulated to be furnished by the City), and to do
everything required by this contract, special provisions, technical
specifications, and all addenda issued by City to the foregoing prior to

2. For furnishing all said materials and labor, services, tools, and
equipment, and doing all work specified herein, also arising out of the
nature of the work aforesaid, or from the action of the elements, or from
any unforeseen difficulties which may arise or be encountered in the

except such as in said specifications are expressly stipulated to be borne

bid is on the unit price basis, the total price for the several items
furnished pursuant to the specifications, as set forth in
Contractor's bid heretofore filed by him and accepted by City, at the times
and manner specified in the Contract Documents.

3. Contractor agrees to perform the work according to the terms of this
Contract for price(s) named in the bid, and City agrees to pay the same at
the time, in the manner, and upon the conditions stipulated in the said
contract documents.
4. Subject to the provisions of this Contract, all terms, covenants,
conditions, and provisions hereof shall inure to and shall bind each of

5. The Notice Inviting Bids, Information Required of Bidders, Contractor's
Bid, Special Provisions, Technical Specifications, and all addenda issued

incorporated in and made part of this contract by reference and are
collectively referred to therein and herein as "Contract Documents."
6. Contractor shall be responsible for compliance with the Apprenticeable
Occupations Regulations of Labor Code, Section 1777.5, including
compliance by all subcontractors.

NOW, THEREFORE, if said Contractor and his Subcontractors shall well and
truly do and perform all the covenants and obligations of said Contract on his
part to be done and performed at the times and in the manner specified herein
including compliance with all Contract specifications and quality requirements,
then this obligation shall be null and void, otherwise it shall be and remain in
full force and effect;
PROVIDED, that any alterations in the work to be done, or in the material
to be furnished, which may be made pursuant to the terms of said Contract, shall
not in any way release said Contractor or the Surety thereunder, nor shall any
extensions of time granted under the provisions of said Contract release either
said Contractor or said Surety, and notice of such alterations of extensions of
the Contract is hereby waived by said Surety.
In the event suit is brought upon this Bond by the City and judgment is
recovered, said Surety shall pay all costs incurred by the City in such suit,
including a reasonable attorney's fee to be fixed by the Court.
