Rev. Swedenberg, Church of the Good Shepherd - Methodist Mayor Conrad T. Reibold , ROLL CALL PRESENT: ABSENT: Councilmen Balser, Considine, Forman, Turner, Reibold None MINUTE APPROVAL (12-21-65) On MOTION by Councilman Turner, seconded by Councilman Forman and carried unanimously the Minutes of the regular meeting of December 21, 1965 were APPROVED. HEARING (Tierney) Mayor Reibold declared the hearing open on the application for a business permit of Francis X. Tierney, dba Arcadia Gardens Miniature Golf, 135 E. Live Oak Avenue, and acknowledged the presence of the new owner, Mr. Tierney. .J- if I No one desiring to speak to the matter the hearing was CLOSED on MOTION by Councilman Considine, seconded by Councilman Balser and carried unanimously. It was noted by the City Manager that there is presently a barricade at the end of the driveway leading into an alley which is under construction; that it will be from 60 to 90 days before completion. It was then MOVED by Councilman Considine, seconded by Councilman Balser and carried unanimously that a business permit be issued said applicant upon the condition that the barricade be removed. /, I s~ The City Manager explored his report dated December 21, 1965 recommending improvements in the water supply system to assure a continuation of a safe and drinkable water supply. The report indicated the water level fluctuations from 1960 through 1965. advised that a complete study of the equipment needed at eleven ^ ~ocations revealed an estimated cost of the installation of ~/~ chlorinization treatment equipment at $87,100 with $70,600 for uJ~y equipment and $16,500 for housing of the equipment. COMMENDATION (Panatier) WEST ARCADIA ZONING :1/(30 17:6706 On MOTION by Councilman Forman, seconded by Councilman Balser and carried unanimously, the City Council indicated its intention to amend Ordinance No. 1314 as introduced January 4, 1966 in accordance with the City Manager's communication of January 4, 1966 as follows: Section " 9263.3.3 9263.3.9 9363.3.10 (Setbacks) to be omitted (Wheel Stops) to remain as introduced (Loading Requirements) amend to comply with proposed 'D' regulations (Walls) amend to comply with proposed 'D1 regulations I " " 9263.3.15 In continuance of the acquisition of property to be developed into a neighborhood park site adjacent to the Camino Grove School, it was MOVED by Councilman Forman, seconded by Councilman Considine and carried on roll call vote as follows that the recommendation of the Land Acquisition and Disposal Committee be approved and that property owned by Ernest C. Hoffman at 1432 S. Sixth Avenue be acquired at $30,000; that the Mayor, City Clerk, City Manager and City Attorney be and they are hereby authorized to execute such documents as may be necessary in form approved by the City Attorney, and that the sum of $30,200 be transferred from Capital Projects Account No. 285 in the General Fund to Capital Improvements Account No. 632 - Park Site Acquisition - South Sixth Avenue: AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman, Turner, Reibold None None It was MOVED by Councilman Turner, seconded by Councilman Forman and carried on roll call vote as follows that the City accept the work as completed by Paul Sanker Company, landscape contractor in the beautification of Santa Anita Avenue from Huntington Drive to Colorado Boulevard, and that final payment be made in accordanc~ with the contract. AYES: Councilmen Balser, Considine, Forman, Turner, Reibold NOES: None ABSENT: None On MOTION by Councilman Balser, seconded by Councilman Turner and carried on roll call vote as follows the City Manager was authorized to proceed with the refurbishing of the administrative offices (estimated cost $3,558.09), funds are reflected in the current budget Council Contingency Account No. 409-28 in the General Fund; AYES: NOES: ABSENT: .' Councilmen Balser, Considine, Forman, Turner, Reibold None None I The City Council acknowledged receipt of a communication from' the Southern California Municipal Athletic Federation, Inc., advising of its presentation to the City Recreation Director, John F. Panatier, of its 1965 Merit Award. On MOTION by Councilman Balser, seconded by Councilman Forman and carried unanimously the communication from S. L. Francom concerning additional commercial rezoning in the West Arcadia area was ordered FILED. 2. 1-4-66 REFUND DENIED -J,' &fvWL 10RDINANCE NO. 1314 amended REINTRODUCED ORDINANCE NO. 1315 INTRODUCED !J//3b I 17':6707 On MOTION by Councilman Balser, seconded by Councilman Turner and carried on roll call vote as follows the request of the Arcadia Christian Reform Church, 1735 S. Baldwin Avenue, for a refund 'of $125 in connection with the filing of a conditional use permit application was DENIED, It was noted that there is no provision for refund of fees of this nature and the Church will be informed of the City's policy. It was MOVED by Councilman Forman, seconded by Councilman Balser and carried unanimously that Ordinance No. 1314 as introduced be amended by eliminating Section 9263.3.3, and by amending Sections 9263.3.10 and 9363.3.15 as recommended by the City Manager in his communication dated January 4, 1966. Whereupon the City Attorney presented and read the title of Ordinance No. 1314 as thus amended, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING THE ARCADIA MUNICIPAL CODE BY REPEALING SECTIONS 9263.2.7, 9284.1.2 AND 9284.1.7 THEREOF AND AMENDING DIVISIONS 3 AND 4 OF PART 6 OF CHAPTER 2 OF ARTICLE IX THEREOF (C-2 AND C-3 REGULATIONS)." MOTION by Councilman Considine, seconded by Councilman Turner and carried on roll call vote as follows that the reading of the full body of Ordinance No. 1314 as amended be waived: AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman, Turner, Reibold None None Councilman Considine further MOVED that Ordinance No. 1314 be REINTRODUCED. Motion seconded by Councilman Turner and carried on roll call vote as follows: AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman, Turner, Reibold None None The City Attorney presented for the first time Ordinance No. 1315 reclassifying certain properties south of Duarte Road and west of Baldwin Avenue. Councilman Forman suggested an amendment to the ordinance as drawn and MOVED that the property on the south side of Naomi Avenue to a point 381 feet easterly from Golden West Avenue be reclassified to Zone C-l which would be more compatible than C-2 inasmuch as the subject property would be facing C-l developments. Councilman Balser seconded the motion with the comment that in his opinion the difference would be minor. The motion was carried as follows with Councilmen Considine and Turner commenting that they would vote for the change only because it would be an improvement over what they had. AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman, Turner, Reibold None None The City Attorney then presented for the first time Ordinance No. 1315, read the title thereof, and explained that the corrections just authorized had been made. Said Ordinance is entitled: "AN 3. 1-4-66 ORDINANCE NO. 1316 INTRODUCED UNIFORM BUILDING CODE 17: 6708 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING SECTION 9233.12 OF THE ARCADIA MUNICIPAL CODE BY CLASSIFYING IN ZONES C-l AND C-2 PORTIONS OF THE CITY OF ARCADIA BOUNDED BY DUARTE ROAD ON THE NORTH, BALDWIN AVENUE ON THE EAST, GOLDEN WEST AVENUE ON THE WEST AND CAMINO REAL ON THE SOUTH." MOTION by Councilman Forman, seconded by Councilman Turner and -carried on roll call vote as follows that the reading of the full body of Ordinance No. 1315 be waived: AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman, Turner, Reibold None None I Councilman Forman further MOVED that Ordinance No. 1315 be introduced. Motion seconded by Councilman Balser and carried on roll call vote as follows: AYES: NOES: ABSENT: Councilmen Balser, Forman, Reibold Councilmen Considine, Turner None The City Attorney presented for the first time, explained the content and read the title of Ordinance No. 1316, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING THE ARCADIA MUNICIPAL CODE BY REPEALING SECTIONS 9265.2.4 AND 9265.2.5 THEREOF AND AMENDING DIVISION 5 OF PART 6 OF CHAPTER 2 OF ARTICLE IX THEREOF (C-M REGULATIONS)." MOTION by Councilman Balser, seconded by Councilman Forman and carried on roll call vote as follows that the reading of the full body or Ordinance No. 1316 be waived: AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman, Reibold, Turner None None Councilman Balser further MOVED that Ordinance No. 1316 be introduced. Motion seconded by Councilman Forman and carried on roll call vote as follows: AYES: NOES: ABSENT: Councilmen Balser, Considine, Forman, Turner, Reibold None None The City Attorney advised that he appeared before the Supreme Court recently under an amicus curiae brief involving the City of Bakersfield and the application of the Uniform Building Code in the City of Bakersfield vs. Miller case; that the matter was argued and submitted and that it may be some months before a decision is made. I He advised further that the Sub-committee of the Criminal Procedures Committee of the Assembly will hold a hearing in Baldwin Park; that he has requested time to make a presentation at the meeting - that it will deal solely with Home Rule and State Pre-emption; that he will try to submit his presentation to the City Council prior to submission to make certain that he is not contravening the thinking of the City Councilor the staff. 4. 1-/:-66 TURNER ~ ISIDEWALK PROGRAM E- J1~/ ~ ADJOURNMENT I 17:6709 Councilman Turner advised that he will not be a candidate for re-election to the City Council in the forthcoming general municipal election; that he has enjoyed the nearly four years he has served and for varying reasons he cannot seek re-election; that it has not been an easy decision to make. The individual Councilmen expressed regret at the announcement and commented on the assistance given by Mr. Turner during his tenure. Councilman Balser stated in part th~t he was extremely proud of the way the first' phase of the sidewalk'program has been received by the residents, and MOVED that staff be requested to proceed with the preparation of a study on the second phase of the program; i.e., ar~a adjacent to the Dana Scnool. Councilman Forman seconded the motion which was carried unanimously, after some discussion on the cooperation of the PTA and comments of all Councilmen as to their entire satisfaction of the program thus far. Councilman Considine expressed appreciation to the City Manager for . I ./. .. the traffic control being effected at Naomi and Baldwin Avenues. The meeting,was adjourned sine die' at 8:35 P.M.
