STAFF REPORT
OFFICE OF THE CITY ATTORNEY
DATE: October 6, 2026
TO: Honorable Mayor and City Council
FROM: Michael J. Maurer, City Attorney
By: Linda Rodriguez, City Clerk
SUBJECT: RESOLUTION NO. 7714 APPROVING AND ADOPTING AN AMENDED
CONFLICT OF INTEREST CODE PURSUANT TO THE POLITICAL REFORM
ACT OF 1974
CEQA: Not a Project
Recommendation: Adopt
SUMMARY
The Political Reform Act of 1974 (Government Code Section 81000, et seq.) requires
every local agency to review its Conflict of Interest Code (the “Code”) biennially to
determine whether the Code remains accurate and up-to-date or requires
amendments.
As part of the City’s biennial review, amendments to the Code have been identified
as necessary to ensure it accurately reflects the City’s current organizational
structure and designated positions. It is recommended that the City Council adopt
Resolution No. 7714, approving and adopting an amended Conflict of Interest Code
pursuant to the Political Reform Act of 1974.
BACKGROUND
The Political Reform Act (the “Act”) requires all public agencies to adopt and maintain
a Conflict of Interest Code that establishes the rules for disclosure of personal assets
and prohibits public officials from making or participating in governmental decisions
that may affect personal assets. The Conflict of Interest Code must specifically
designate all agency positions that make or participate in the making of decisions

and assign specific types of personal assets to be disclosed, which may be affected
by the exercise of powers and duties of that particular position.
The Act further requires that an agency regularly review and update its Code, as
necessary, when directed by the code-reviewing body or when change is necessitated
by different circumstances (Sections 87306 and 87306.5).
Pursuant to the Act, the City adopted a Conflict of Interest Code that was last
amended and approved by the City Council on October 4, 2022. As the City’s code-
reviewing body, the City Council is responsible for approving amendments to the
Code. Staff has reviewed the Code and has determined that amendments are
necessary to designate new positions, revise disclosure categories and titles of
existing positions, and remove the titles of positions that have been abolished and/or
no longer participate in or make governmental decisions.
Government Code Section 87303 provides that no code or amendment to a code
shall be effective until it has been approved by the code-reviewing body. Attached is
a redline version of Arcadia’s proposed Conflict of Interest Code.
DISCUSSION
While the majority of the positions listed the Code remain accurate, the Code must
be amended to: (1) include new positions to be designated; (2) revise the titles of
existing positions; (3) delete titles that have been abolished; and/or (4) remove titles
that no longer make or participate in governmental decision-making. Attached to
Resolution No. 7414 is a redline version of the proposed amended Conflict of Interest
Code showing the revisions to be made.
Government Code Section 87303 provides that no Code or amendment to a Conflict
of Interest Code shall be effective until it has been approved by the code-reviewing
body. City Council’s adoption of Resolution No. 7714 would satisfy this requirement.
ENVIRONMENTAL ANALYSIS
The proposed action does not constitute a project under the California Environment
Quality Act (“CEQA”), as it can be seen with certainty that it will have no impact on the
environment.

constitute a project under the California Environmental Quality Act (“CEQA”); and
adopt Resolution No. 7714 approving and adopting an amended Conflict of Interest
Code pursuant to the Political Reform Act of 1974.
